Newport Beach Municipal Code Chapter 5.15 regulates official police
tow truck services. This chapter provides that there shall be two
official police tow agencies operating under a contractual
agreement with the City. G&W Towing and Harbor Towing are currently
the two official police tow agencies. Each contract is for a two
year period, expiring on alternate years. The contract with G&W
Towing Inc. expires on January 31, 1993.
Notification of the open bid for official police tow contract was
published in the Orange Coast Daily Pilot, and sent to tow truck
companies currently licensed in the City. The bid period closed on
December 16, 1992, with Jim's Towing and G&W Towing Inc. submitting
bids to provide official police tow services. The Police Department
was requested to inspect the equipment and facilities and report on
the qualifications of each applicant. Copies of the submittal from
G&W Towing Inc., Jim's Towing Service, and the Police Department's
report are attached.
Section 5.15.070 provides that after consideration of an
applicant's ability to satisfy Municipal Code requirements for
standards for tow truck equipment and standard rules of operation
(Sections 5.15.100 and 5.15.110), the City Council shall take into
account the following considerations:
(A) Whether the applicant is qualified on the basis of moral
character, experience in the towing business, and financial
responsibility;
(B) The level and quality of service which would be made
available to the public: such as, accessiblilty and adequacy of
the storage facilities, whether there is an attendant on duty as
opposed to being on call to release vehicles on a 24-hour basis,
and availability of extra pieces of equipment over the minimum
required;
(C) Reasonableness of fees to be charged for service and
willingness to release vehicle without charge if impounded or
stored in the course of carrying out an official police
investigation, upon direction of the Chief of Police;
(D) Physical condition of equipment.
Newport Beach Municipal Code Section 5.13.150 requires a tow truck
driver obtain a permit from the City to operate a tow truck in the
City.
JIM'S TOWING
Jim's Towing (Jim's) has been licensed by the City as a tow truck
operator, for non -police services, since 1987. Jim's has listed
nine (9) tow trucks to be operated as official police tow trucks.
Eight of the nine tow trucks listed by Jim's have been inspected by
the Police Department and found to meet Municipal Code
requirements. Jim's has represented current outdoor storage
facilities at 935 West 18th Street (Costa Mesa) capable of storing
approximately 50 vehicles. Jim's has also indicated the ability to
expand outdoor storage by an additional 65 to 75 vehicles at two
currently unimproved lots in the 1700 block of Monrovia Avenue
(Costa Mesa). Although these two lots do not currently meet
Municipal Code requirements, the applicant has indicated the
ability to bring these lots into compliance within one month if
awarded the contract. Inside storage on 18th Street has the
capacity for five (5) vehicles. Jim's does not employ bilingual
dispatchers. Facilities at 18th Street are reportedly handicap
accessible. Jim's Towing has not provided police towing services
for any city, but does provide service to the California Highway
Patrol. Of the eleven (11) drivers listed by the applicant, one (1)
has satisfied the permit requirements of Section 5.13.150.
G&W TOWING INC.
G&W Towing Inc. (G&W) has been providing tow services in the City
continually since 1973. The Police Department has inspected the
sixteen (16) vehicles listed by G&W, and found them to comply with
Municipal Code requirements. G&W has paved outside storage
facilities at 965 West 18th Street (Costa Mesa) capable of storing
over 300 vehicles. Inside storage at their facility can accommodate
30 vehicles. G&W employees bilingual dispatchers. Their facilities
are handicap accessible. G&W Towing Inc. has been providing police
towing services for this city since 1973, and police tow services
for the City of Costa Mesa since 1981. G&W also provides tow truck
services to the California Highway Patrol, Orange County Marshals
and the Department of Motor Vehicles. G&W Towing Inc. has an
excellent record in providing official police tow truck services in
this city. All twelve (12) of the tow truck drivers employed by G&W
are permitted by this city.

Discussion
The Police Department did not provide, nor did this office's
investigation include, a report on the moral character of the
applicants. G&W has fourteen (14) years more experience in
providing tow truck services in the City of Newport Beach than
Jim's. Jim's has no police tow truck experience, while G&W has
provided official police tow truck services for nineteen (19) years
in this city and eleven (11) years in Costa Mesa. A statement from
each company, addressing their financial responsibility, is
attached.
Both applicants meet Municipal Code standards for tow truck
equipment and storage facilities. G&W Towing Inc. operates seven
(7) more tow trucks than does Jim's Towing, provides at least one
hundred and seventy-five (175) more outside storage spaces and at
least twenty-five (25) more inside storage spaces than does Jim's.
Fees charged by official police tow truck operators in this City
are fixed by Resolution of the City Council. Both G&W and Jim's
have represented a desire to cooperate with the Police Department
in impound fees on official police investigations.
At the request of Council, a review of civil court actions brought
against tow truck operators has been included in the investigation
of these two applicants. Harbor Municipal Court Civil Index records
reflect that during 1991 Jim's Towing was listed as a defendant in
two (2) civil actions while G&W Towing Inc. was listed in four (4)
civil actions. Jim's Towing represented that they provided
approximately twenty thousand (20,000) tow services (non -police
related) while G&W provided approximately twenty five thousand
(25,000) tow services (police and non -police) in 1991. G&W
represented that they prevailed in three of the four suits filed
against the company.
Recommendation
Based on the company's experience in providing both police and non -
police tow truck services in the City of Newport Beach, the level
and quality of service, availability of extra pieces of equipment
over the minimum required and the superior storage facilities of
G&W Towing Inc., the Police Department and the Revenue Division
respectfully recommend G&W Towing Inc. for the official police tow
truck contract.

SCOPE OF SERVICE, CONSIDERATION & TERM OF AGREEMENT
JIM'S TOWING SERVICE IS STRATEGICALLY LOCATED IN THE CITY OF
COSTA MESA AND HAS THE REQUIRED STORAGE FACILITIES, TOW
VEHICLES, MANPOWER, MATERIALS, EQUIPMENT, MACHINERY AND TOOLS
TO SERVICE THE NEEDS OF THE NEWPORT BEACH POLICE DEPARTMENT.
IT HAS ALWAYS COMPLIED WITH ALL FEDERAL, STATE, AND LOCAL
REGULATIONS PERTAINING TO TOWING, IMPOUND, STORAGE, SELLING
OR JUNKING OF VEHICLES. IT IS A SOLIDLY FINANCED COMPANY
THAT IS CAPABLE OF PERFORMING FOR THE TERM OF THE TWO YEAR
CONTRACT.
TOW SERVICE DUTIES
JIM'S TOWING SERVICE IS PREPARED TO PROVIDE PROMPT TOW
SERVICE FOR VEHICLES TAKEN INTO CUSTODY BY THE POLICE
DEPARTMENT, INVOLVED IN ACCIDENTS, OR DISABLED BY OTHER
CAUSES, IMPOUNDED FOR EVIDENCE, IMPEDING THE FLOW OF TRAFFIC,
ABANDONED IN PUBLIC PLACES OR ON PRIVATE PROPERTY, OR FOR
OTHER REASONS WHICH BY LAW ARE WITHIN THE JURISDICTION OF THE
NEWPORT BEACH POLICE DEPARTMENT. JIM'S TOWING SERVICE WILL
ABIDE BY THE REGULATIONS AND DEFINITIONS SET FORTH BY THE
NEWPORT BEACH POLICE DEPARTMENT IN HANDLING ABANDONED
VEHICLES, STRIPPED VEHICLES, VEHICLE PARTS, TRAILERS, HOUSE
CARS AND MOBILE HOMES. THE MAXIMUM CHARGE THAT JIM'S TOWING
SERVICE WILL CHARGE FOR THE AFOREMENTIONED SERVICES WILL BE
THE PRICE OF THE BASIC TOW FEE.

THE COMPANY WILL ALSO REMOVE FROM THE STREET ALL DEBRIS
RESULTING FROM ACCIDENTS IN WHICH TOWING SERVICES ARE
REQUIRED.
DRIVER QUALIFICATIONS
JIM'S TOWING SERVICE REQUIRES THAT ALL DRIVERS BE PROPERLY
AND CURRENTLY LICENSED WITH THE STATE OF CALIFORNIA. ALSO,
ALL EMPLOYED DRIVERS ARE SUBJECTED TO ANNUAL REVIEW OF
DRIVING RECORDS AND ARE SUBJECT TO DISMISSAL IF ACCIDENT OR
VEHICLE CITATION FREQUENCY IS DETERMINED TO BE EXCESSIVE.
ALL PROSPECTIVE NEW EMPLOYEE'S DRIVING RECORDS ARE REVIEWED
FOR ACCEPTABILITY PRIOR TO HIRING.
JIM'S TOWING SERVICE PROHIBITS DRIVERS FROM CONSUMING
ALCOHOLIC BEVERAGES WHILE ON DUTY AND REPORTING TO WORK UNDER
THE INFLUENCE OF ALCOHOL. ALSO, THE COMPANY BEGAN DRUG
TESTING OF ALL NEW PROSPECTIVE EMPLOYEES BEGINNING IN 1988.
THE COMPANY ALSO RESERVES THE RIGHT TO DRUG TEST ANY EMPLOYEE
INVOLVED IN AN ACCIDENT OR WORK RELATED INJURY.
ALL DRIVERS ARE REQUIRED BY COMPANY POLICY TO REPORT PERSONAL
OR WORK RELATED ALCOHOL/DRUG RELATED CITATIONS AND ARE AWARE
THAT CITATIONS OF THIS NATURE COULD JEOPARDIZE THEIR
EMPLOYMENT.
HOURS OF OPERATION
JIM'S TOWING SERVICE WILL PROVIDE 24-HOUR TOWING SERVICE,
7 DAYS A WEEK, 365 DAYS PER YEAR. OFFICE HOURS ARE FROM
7 A.M. TO 5 P.M., MONDAY THROUGH FRIDAY.
RESPONSE TIME
JIM'S TOWING SERVICE IS IN A LOCATION WHERE IT CAN RESPOND TO
ANY POLICE REQUEST WITHIN 15 MINUTES TO ANY POINT WITHIN THE
CITY BOUNDARIES.
ALL 10 TOW VEHICLES IN THE FLEET ARE MAINTAINED IN COMPLIANCE
WITH SECTIONS 24605, 25253, 25300, 27700, AND 27907 OF THE
VEHICLE CODE. ALL TOW VEHICLES ARE RATED OVER THE MINIMUM
REQUIREMENT OF ONE TON, HAVE DUAL REAR WHEELS, CABLE WINCHES
AND THE FLEET IS SUFFICIENT TO HANDLE LARGE TRUCKS, TRAILERS,
TRACTORS AND OTHER HEAVY VEHICLES AND EQUIPMENT.

STORAGE OF VEHICLES
GENERAL
1) JIM'S TOWING ACCEPTS THAT IT MUST STORE ALL VEHICLES,
TOGETHER WITH ALL ACCESSORIES AND EQUIPMENT ON SAID VEHICLES
AND ALL PERSONAL PROPERTY IN EACH VEHICLE, IN STORAGE
FACILITIES APPROVED BY THE CITY FOR OFFICIAL POLICE TOW
STORAGE.
2) JIM'S TOWING SERVICE WILL HOLD NEITHER THE POLICE
DEPARTMENT NOR THE CITY OF NEWPORT BEACH, ITS OFFICERS,
AGENTS OR EMPLOYEES LIABLE FOR THE LOSS OF OR DAMAGE TO ANY
VEHICLES, ACCESSORIES, EQUIPMENT OR PERSONAL PROPERTY TOWED
OR STORED UNDER THIS AGREEMENT.
3) JIM'S TOWING SERVICE WILL DELIVER PERSONAL PROPERTY IN
VEHICLES LISTED ON IMPOUND LISTS TO THE POLICE DEPARTMENT
UPON WRITTEN REQUEb-f NO LATER THAN NINETY (90) DAYS AFTER THE
DATE OF IMPOUND, IF NOT CALLED FOR BY OWNER WITHIN SAID
PERIOD. JIM'S TOWING WILL TAKE ALL REASONABLE PRECAUTIONS
REQUIRED BY THE POLICE DEPARTMENT TO AVOID DAMAGE TO ANY
EVIDENCE, SUCH AS FINGERPRINTS OR STAINS.
FACILITY LOCATION
JIM'S TOWING SERVICE IS LOCATED WITHIN A 5 -MILE RADIUS OF THE
NEWPORT BEACH POLICE FACILITY, WHERE VEHICLE OWNERS CAN CLAIM
THEIR VEHICLES.
STORAGE REQUIREMENTS
JIM'S TOWING SERVICE IS CAPABLE OF TAKING VEHICLES INTO
CUSTODY THAT INVOLVE EVIDENCE AND STORING THEM IN AN AREA
PROTECTED AGAINST ENTRY BY UNAUTHORIZED PERSONS. THE
FACILITY HAS ENCLOSED STORAGE FACILITIES FOR A MINIMUM OF
FIVE (5) VEHICLES AS ORDERED IMPOUNDED BY THE POLICE
DEPARTMENT. THE STORAGE FACILITY HAS A HOLDING CAPACITY FOR
115 VEHICLES. JIM'S TOWING SERVICE WILL TAKE ANY AND ALL
MEASURES NECESSARY TO PREVENT THEFT OR DAMAGE TO VEHICLES AND
THE ACCESSORIES, EQUIPMENT OR OTHER PERSONAL PROPERTY
IMPOUNDED IN THE STORAGE FACILITY.
JIM'S TOWING SERVICE ALSO OWNS TWO PROPERTIES, 1785 AND 1791
MONROVIA AVENUE, COSTA MESA, THAT CAN BE QUICKLY IMPROVED TO
INCREASE VEHICLE STORAGE CAPACITY BY A MINIMUM OF ANOTHER
65 TO 75 VEHICLES.
RELEASE OF VEHICLE
JIM'S TOWING SERVICE WILL BE RESPONSIBLE FOR THE RELEASE OF
ALL VEHICLES STORED UNDER THIS AGREEMENT AND WILL ABIDE BY
THE REGULATIONS OF THE NEWPORT BEACH POLICE DEPARTMENT.
RECORDS
JIM'S TOWING SERVICE WILL KEEP COMPLETE AND ACCURATE RECORDS
OF ALL VEHICLES AND THE ACCESSORIES, EQUIPMENT AND OTHER
PERSONAL PROPERTY, TOWED, IMPOUNDED OR STORED AT THE REQUEST
OF THE POLICE DEPARTMENT. SUCH RECORDS SHALL INCLUDE A
DESCRIPTION OF THE VEHICLE, NATURE OF THE SERVICE, TIME AND
LOCATION OF THE CALL, CHARGES, VEHICLE OWNER'S NAME AND
ADDRESS (WHEN ASCERTAINABLE), VEHICLE LICENSE NUMBER, SERIAL
NUMBER AND POLICE DEPARTMENT CASE NUMBER. ALL RECORDS HEREIN
REQUIRED WILL BE AVAILABLE FOR INSPECTION AT ALL TIMES BY
REPRESENTATIVES OF THE POLICE DEPARTMENT.
PERFORMANCE
JIM'S TOWING SERVICE WILL PERFORM ALL NECESSARY SERVICES IN
AN ETHICAL, ORDERLY MANNER, ENDEAVORING TO OBTAIN AND KEEP
THE CONFIDENCE OF THE COMMUNITY.
INDEMNIFICATION
JIM'S TOWING SERVICE MAINTAINS MORE THAN REQUIRED INSURANCE
COVERAGE (SEE ATTACHED CERTIFICATE OF INSURANCE) AND WILL
INDEMNIFY, DEFEND AND HOLD HARMLESS THE CITY OF NEWPORT BEACH
FOR ANY CLAIMS OR LIABILITY ARISING OUT OF THE TOW AND
STORAGE OPERATIONS PERFORMED UNDER THE POLICE TOW AGREEMENT.

Summary of Significant Accounting Policies
(a) Principles of consolidation --The consolidated financial
statements include the accounts of FBC Industries (an S
Corporation) and Patton Distributing Co. (a general
partnership) in which FBC Industries owns a 75%
interest. All significant intercompany accounts and
transactions have been eliminated.
(b) Inventories --Beer and wine inventories are shown at cost
using the last -in, first -out (LIFO) method. Management
believes that the use of the LIFO method results in a
better matching of costs and revenues.
If the first -in, first -out (FIFO) method had been used,
inventories would have been $541,458 and $195,470 higher
than the inventories reported at December 31, 1991 and
1990, respectively.
Inventories of cooperage and others are determined using
the specific cost method. At December 31, inventories
consisted of the following:

Due to the Tax Reform Act of 1986, additional costs were
required to be capitalized as part of ending inventories
for tax purposes. These costs, referred to as Section
263A costs, were $69,974 and $33,676 in 1991 and 1990,
respectively. Management has elected not to include
Section 263A costs in inventories for financial
statement reporting.

Total depreciation expense was $957,007 in 1991 and
$1,095,708 in 1990. Renewals and betterments that
materially extend the useful lives of property and
equipment are capitalized.
(d) Income Taxes --The Company has elected to be taxed under
the provisions of subchapter S of the Internal Revenue
Code. Under those provisions, the Company generally
does not pay Federal corporate income taxes on its
taxable income. Instead, the stockholders are liable
for individual Federal income taxes on their respective
shares of the Company's taxable income.
The Company pays California franchise tax of 2.5% at the
corporate level, and the stockholders pay California
income taxes on their respective shares of the Company's
taxable income.

rates, as contained in Resolution 91-54.

style is a result of our experience within Newport Beach. This area

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH ESTABLISHING CHARGES FOR
OFFICIAL POLICE TOW TRUCK SERVICES AND
APPROVING THE TOW TRUCK RATE SCHEDULES FOR
SERVICES WITHIN THE CITY OF NEWPORT BEACH FOR
G & W TOWING AND HARBOR TOWING AND RESCINDING
RESOLUTION 90-52.
WHEREAS, Section 5.13.140 of the Newport Beach Municipal Code
provides that each holder of a Certificate of Public Convenience
and Necessity for the operation of a two truck service shall file
with the City a proposed schedule of rates to be charged by said
Certificate holder, said rates to be established by the City
Council upon holding a public hearing; and
WHEREAS, on June 11, 1990, the City Council of the City of
Newport Beach adopted Resolution No. 90-52 approving the tow truck
rate schedules for tow services within the City of Newport Beach
provided by G & W Towing and Harbor Towing; and
WHEREAS, G & W Towing and Harbor Towing has submitted to the
City Council its respective proposed schedule of rates to be
charged for tow services within the City of Newport Beach; and
WHEREAS, Section 5.15.080 of the Newport Beach Municipal Code
provides that the City and the Official Police Tow Service may
review and revise fee schedules, by mutual agreement, at any time,
upon a finding that a rate increase is justified and is in the
public interest; and
WHEREAS, the Official Police Towing Service Certificate
holder, G & W towing, has submitted a request to increase the
towing charges and storage rates based upon the continuing rise in
the cost of doing business; and
WHEREAS, G & W Towing and Harbor Towing proposes a uniform fee
schedule for both the Official Police Towing rate and the schedule
for tow services within the City of Newport Beach, independent from
the Official Police Tow; and
WHEREAS, the City Council held a hearing on May 28, 1991 to
consider the requests.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Newport Beach that the following towing charges, storage rates

and after -hour release fees for Official Police Tow Truck Services
and for the truck rates for tow servi within the City of
Newport Beach for G & W Towing and Harbor Towing are established as
follows:

the Official Police Towing Service companies.
