TITLE: Civic Center Park Pathway Replacement — Award of Contract
No. 7879-1 (21 P12)
ABSTRACT:
The pathways through the sculpture garden area of the Civic Center Park are
deteriorating and are in need of replacement. The City has received state grant
funding for their replacement. Staff has now received construction bids for the Civic
Center Park Pathway Replacement Project and requests City Council approval to award
the construction contract to Civic Construction Associates.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301 (d) (Restoration of deteriorated or damaged existing
facility) of the CEQA Guidelines, because this project results in negligible or no
expansion of existing capacity;
b) Approve the project drawings and specifications;
c) Award Contract No. 7879-1 to Civic Construction Associates for the total base bid
amount of $155,000.00, and authorize the Mayor and City Clerk to execute the
associated construction contract; and
d) Establish $31,000.00 (approximately 20 percent) contingency to cover the possible
cost of unforeseen conditions, as well as some anticipated extra work and/or material
quantities.
FUNDING REQUIREMENTS:
The FY 2019-20 California State Budget appropriated a Local Assistance Specified Grant
of $500,000 through the State of California Department of Parks and Recreation for the
Sculpture Exhibition in Civic Center Park. The grant funding was designated for the Civic
Center Park Sculpture Exhibition Phases V and VI, and the park pathway.

Up to $215,000 of the award was allocated to the pathway replacement project and
included in the adopted FY 2020-21 Capital Improvement Program budget. In
accordance with the grant guidelines, the project must be completed by
December 31, 2021 and will be funded on a reimbursement basis.

Several areas of the walking paths through the sculpture garden area of the Civic
Center Park have deteriorated and require replacement. The original pathway was
installed in 2013 with the construction of the Civic Center complex. Failures along the
pathway are now widespread due to issues with defective path paving materials,
unanticipated loading from on-going art installation equipment, as well as the general
erosion expected of a natural material.
The project replaces the pathway with a decomposed granite surface modified with a
concrete binder to add the desired strength. The proposed pathway will be more
resilient and better able to handle the occasional equipment loads.
At 10 a.m. on August 27, 2020, the City Clerk opened and read the following bids for
this project:

The low bid amount is approximately 20 percent below the Engineer's Estimate of
$190,000. The low bidder, Civic Construction Associates, possesses a California state
contractor's license classification "A" as required by the project specifications. The
contractor is registered with the California Department of Industrial Relations as required
by California law to work and bid on public contracts. A check of the contractor's
references indicates satisfactory completion of similar projects for other local public
agencies.
The work necessary for the completion of this contract consists of removing the existing
pathway and installing all new pathway in the Civic Center Park between Civic Center
Drive and San Miguel Drive. A 20 percent contingency has been requested to allow staff
to account for any unforeseen conditions and to work with the contractor to potentially
expand the pathway rehabilitation to some other deteriorated path areas near the dog
park, north of San Miguel Drive, due to the favorable bids received.
Pursuant to the Contract Specifications, the Contractor will have 35 consecutive working
days to complete the work. The Contractor is required to maintain pedestrian access
through the park during construction.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this project exempt from the California
Environmental Quality Act (" CEQA") pursuant to Section 15301 (d) (Restoration of
deteriorated or damaged existing facility) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because the replacement or reconstruction of existing
structures and facilities will have substantially the same purpose and capacity as the
structure replaced.
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
