For the Public Record: Councilmembers: September 22, 2020 Agenda Item No. 7 is for restoration of Civic Center Park pathways. The Staff Report shows a request for a Contingency of $20% ($31,000). However, some will be for contingent items, and some for the Dog Park, based on the text. If we can reallocate funds for another portion of the project, that may be desirable. However, standard scope development and bidding practices are still called for. In that case, 1) the 'Unforeseen Conditions' should be identified. This is an open space where the City has done extensive work. The types of contingencies and potential impact can be listed. Part of the reason the paths are being redone is to address damage from Sculpture installation, which was not part of the original Park plan. -Has the vendor agreed to a limit of 20%? 2) Work at the Dog Park should be estimated and bid separately. They could be part of the project, but they should have a separate estimate. a) Based on the text, the Dog Park is a separate scope with separate costs; here it is tied here to 'unanticipated contingencies', which could create complications. -Is the Dog Park included in the 35 Work Days allotted to the Contractor? -If the contingencies run to the $31K and the Dog Park work has already begun, will the funding be available? -Would you anticipate using the full $31K for the Dog Park, or only part? -What is the sequencing to ensure that the unforeseen contingencies and/or Dog Park work would not cancel each other out? b) Did the original Assembly Arts Grant allow for the funding to be used in the Dog Park? "The work necessary for the completion of this contract consists of removing the existing pathway and installing all new pathway in the Civic Center Park between Civic Center Drive and San Miguel Drive. A 20 percent contingency has been requested to allow staff to account for any unforeseen conditions and to work with the contractor to potentially expand the pathway rehabilitation to some other deteriorated path areas near the dog park, north of San Miguel Drive, due to the favorable bids received."
