Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Tom Sandefur, Assistant City Engineer, tsandefur@newportbeachca.gov PHONE: 949-644-3321 TITLE: 2019-2020 Playground Improvements Project — Notice of Completion for Contract No. 7737-1 (20P01) ABSTRACT: On April 14, 2020, the City Council awarded Contract No. 7737-1, 2019-2020 Playground Improvements, to R.E. Schultz, Inc. (R.E. Schultz) of Orange, California. The work is complete and staff requests City Council acceptance and closeout of the contract. RECOMMENDATION: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project; b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after Notice of Completion has been recorded in accordance with applicable portions of the Civil Code -land c) Release the Faithful Performance Bond one year after acceptance by the City Council. FUNDING REQUIREMENTS: The adopted budget included sufficient funding for this contract. The 2019-2020 Playground Improvements Project was awarded to R.E. Schultz, Inc. (R.E. Schultz) on April 14, 2020 with a Notice to Proceed on Wednesday, August 5, 2020. The contract has been completed to the satisfaction of the Public Works Department and Recreation and Senior Services Department. A summary of the contract cost is as follows: Original Bid Amount: Actual Cost of Bid Items Constructed: Total Change Orders: Final Contract Cost: $ 271,621.50 $ 261,751.50 $ 14,720.00 $ 276,471.50 The final construction cost was 1.8% over the original contract amount. Five change orders were issued to address unforeseen drainage issues, larger cool -topper footings, installation of additional equipment that needed to be replaced and additional rubber surfacing repairs. Additionally, the bid included an additive item to replace the existing sand at Bob Henry Park. The amount of sand replaced was less than the bid quantity; therefore, a portion of this allowance was removed from the contract via a contract quantity reconciliation change order. A summary of the project schedule milestones is as follows: Estimated Completion Date per 2020 Baseline Schedule: November 24, 2020 Project Award for Construction: April 14, 2020 Contract Completion Date with Approved Extensions: September 28, 2020 Actual Substantial Construction Completion Date: September 28, 2020 5-2 2019-2020 Playground Improvements Project — Notice of Completion for Contract No. 7737-1 (20P01) October 27, 2020 Page 3 ENVIRONMENTAL REVIEW: On April 14, 2020, the City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 —Class 1 (rehabilitation of deteriorated facilities) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it results in no expansion of an existing use. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
