Big Canyon Restoration Project — Phase 2A: Contract Contingency
Increase, Contract No. 8208-2 (20X12)
On June 9, 2020 City Council awarded a construction contract for the Big Canyon
Restoration Project — Phase 2A to Environmental Construction, Inc. (ECI) for a total bid
price of $985,348. During the course of construction, an additional 4.0 acres of trees in
Big Canyon were determined to be infested with the polyphagous shot hole borer. The
City was fortunate that the bidding for the original contract was very competitive and there
is sufficient grant funding available for the additional work. At this time, staff requests an
increase to the approved 15 percent contract contingency to 36 percent to allow for this
additional unforeseen infested tree removal work.
RECOMMENDATION:
a) Find the requirement for environmental review under the California Environmental
Quality Act ("CEQA") is satisfied by the January 22, 2019 Council adoption of
Resolution No. 2019-9, A Resolution of the City Council of the City of Newport Beach,
California, Adopting Mitigated Negative Declaration No. ND2018-001 (SCH
No. 2018081098) for the Big Canyon Coastal Habitation Restoration and Adaptation
Project - Phase 2A (PA2018-078), including the Mitigation Monitoring and Reporting
Plan, prepared for the Big Canyon Coastal Habitat Restoration and Adaptation Project
- Phase 2A (PA2018-078), pursuant to the California Environmental Quality Act, State
CEQA Guidelines and City Council Policy K-3; and
b) Authorize a revised contingency of $353,500 (approximately 36 percent) to cover the
cost of unforeseen work not included in the original contract.
FUNDING AVAILABILITY AND REQUIREMENTS:
Sufficient funding is available in the current Capital Improvement Program budget for
approval of the increased contingency. The proposed project, including the additional
work, will be expensed to Account No. 13801-980000-20X12 (Environmental
Contributions) for the Big Canyon Restoration Project — Phase 2A project.

The City and Newport Bay Conservancy (NBC) have been working together cooperatively
on a plan to restore the Phase 2A area of Big Canyon Nature Park. NBC has been
awarded two grants totaling $1,688,731 to fund the implementation of the Phase 2A
restoration. The additional costs have been reviewed and formally accepted by NBC.
Staff recommends an increase of the approved contingency from $147,000
(approximately 15 percent) to $353,500 (approximately 36 percent) to cover the additional
unforeseen work not included in the original contract.
DISCUSSION:
On June 9, 2020, City Council awarded a construction contract to Environmental
Construction, Inc. (ECI) for the Big Canyon Restoration Project — Phase 2A located in the
central portion of Big Canyon Nature Park that straddles Big Canyon Creek. The attached
location map shows the project area (11.3 acres in Phase 2A plus 1.6 acres from Phase
1B) permitted by the regulatory agencies and covered by grant funding. As originally
envisioned, a 6.8 -acre portion would be cleared of non-native Brazilian Pepper Trees and
replaced with native trees and plants. The remaining 6.1 -acre area was planned for
selective removal of individual Brazilian pepper trees and other non-native trees found
within healthy groves of willows. It was envisioned that the selective removals would be
performed by ECI in the Phase 2A area, and performed by the California Conservation
Corps in the Phase 1 B area.
However, examination of each willow by project biologists found that about 4 acres of
willows have been infested with the polyphagous shot hole borer and require removal.
As this type of clearing requires heavy equipment, it would not be appropriate work for
the California Conservation Corps staff who only use chain saws. The plan has been
redesigned to allow ECI to perform the additional clear cutting and reallocated portions of
the Phase 2A to the California Conservation Corps for selective removals.
The anticipated total clear-cut acreage is now 10.8 acres, a 60% increase over the
originally anticipated 6.8 acres. Funding to restore these additional areas requires
increasing the grant -eligible contingency to implement tasks to clear trees, chip the cut
trees, haul -off mulch for disposal, stockpile and solarize the chipped infested -willows,
grade to remove roots and debris, apply soil supplements, install temporary irrigation, and
provide additional plants and hydroseed.
An additional 20 working days has been added to the contract to allow the contractor to
complete the proposed additional work. The new completion date is March 21, 2021.
After completion of the restoration, a 120 -day Plant Maintenance and Establishment
Period will commence pursuant to the original contract.
