Item 1. Authorization for the City Attorney to Take Action to Support
Orange County Sheriff Don Barnes' Challenge to an Order Releasing
Approximately 1,800 Inmates from Orange County Jails
I don't recall this matter being "A -1'd", so I assume it was requested by the City Attorney through
the City Manager with the new Mayor calling a special meeting as provided for under
Government Code Subsection 54956(a). That said, I am pleased to see this scheduled for
public discussion, and not relegated to a closed session as often seems to happen with legal
matters.'
As a threshold matter, it would have been helpful to provide a link to the court order in question.
Especially since the agenda item title (above) does not quite match the recommended action on
page 1 of the staff report, one referring to release of inmates and the other to reduction of
inmate population "in congregated living areas" -- which might possibly be accomplished by
means other than release.2
Copies of the 32 -page order are available via a link in an article in the Voice of OC, as well as
from the ACLU.
While I understand the frustration with the thought of dangerous criminals3 being released into
the general population, it would also have been helpful to explain more clearly the current status
of the case, exactly what Sheriff Barnes' effort to "challenge the order" consists of and what
effect the City's participation in that challenge might have. The Voice of OC article quotes
Sheriff Barnes as saying We are evaluating the order, its impacts and our options for appeal."
This seems particularly important in view of the Funding Requirements section of the staff report
saying merely: "The adopted budget contains sufficient funding for this item." But Newport
Beach has a roughly $320 million operating budget. How much is the Council being asked to
invest in this effort, and to what effect?
From Judge Peter Wilson's order, which seems to rely on a recent appeals case that has
already become published law (In re Ivan Von Staich, 56 Cal.App.5t" 53), it appears that to date
Sheriff Barnes, although previously given an opportunity, failed to provide an adequate
response to the allegations raised regarding conditions in the County jail.
' In this case, I think the public discussion is unavoidable since this matter does not appear to qualify for
any of the litigation -related open meeting exceptions in Government Code Section 54956.9: it is not
litigation to which the City is currently a party, nor to which it is exposed, nor which it is considering
initiating.
2 Footnote 4 at the bottom of page 30 of the order says the Court uses the term "release" "to mean the
discharge of detained individuals from the physical confines of the Orange County Jail, not necessarily
release from all forms of custody."
3 1 believe some of the inmates are merely awaiting trial and have not yet been found guilty of the crimes
of which they stand accused.

While the City can decry the consequences of the order, what evidence does it plan to provide
to overcome the finding of "deliberate indifference" on which the order rests?
To be sure, there seems to be a difference between the case Judge Wilson relies on as
precedent and this, in that in the former it was alleged the unhealthful condition could be easily
relieved by transfer of inmates to other facilities, while here the Sheriff claims no other facilities
are available.
But the whole point of the City participating in this exercise is particularly unclear since Sheriff
Barnes has been quoted in news media as intimating he has no intention of implementing the
order, much as he has said he has no intention of enforcing other COVID-19 related mandates.
So if the order will not be enforced, why is there a need for the City to spend money challenging
it?

I have been attacked showing a property before, I run the beach trails and now have to carry a stun
gun. I have talked to MANY landlords and small business owners who have been ROBBED on a grab
and go (hard to identify with masks) or vandalized. The are hurting and they are pleading -Please
protect the citizens who have sworn to serve.

Dear Newport Beach City Council Members,
My family and I reside in Newport Coast and have just learned about the court-ordered mandate to release
criminals from the Orange County jails. It is reprehensible to think about dangerous and violent criminals
being let out into our community. I strongly urge the City to file a legal brief in support of Sheriff Barnes'
position to refuse early release. The risks of COVID-19 to inmate populations should not be weighed more
heavily than the risks of crime to citizens in our community should such release occur. From DA Todd Spitzer's
statement released 12/12/20, "inmates released early before serving their full sentence or on $0 bail went out
and new crimes at rates at nearly triple normal recidivism rates: 44% for early release inmates and 38% for $0
bail defendants. A sample of their crimes: auto theft, burglary, robbery, assault, weapons, theft and
narcotics" and I even understand murder has occurred from a recently released 23 -year old. Early release of
prisoners should not be an option and from this data, foreseeable criminal risks would appear highly
predictable to occur. Daisy Ramirez, from the ACLU of Southern California, calls for greater humanity of
incarcerated people, stating they "should not be put in mortal danger." What about the mortal danger to our
OC community that has already been documented with crimes and even murder from the recently released
incarcerated people? There must be safer solutions than allowing these criminals to be released. Judge Peter
Wilson's order to support the ACLU stance to prioritize the health of inmates over the health and safety of the
greater OC population does not serve the public nor justice. We need an advocate to defend and protect the
community of law-abiding citizens; clearly the ACLU and Judge Peter Wilson support criminals over
community.

Good afternoon Mayor Avery and City Council—
We are writing in strong support of authorizing our City Attorney to file a legal brief supporting
Orange County Sheriff Don Barnes position to not release 1800+ inmates. The order by Judge Peter
Wilson last Friday is absurd and we believe it to be a gross and negligent order.
We encourage all of you on Council to reach out to our neighboring cities and their city council's and
ask them to stand with all of you in backing Sheriff Barnes.
There is absolutely no need to release inmates back into our communities with charges stemming from
murder to child molestation. These inmates are despicable and need to be reformed for their crimes
before they are ever allowed the opportunity to return to society.
Reducing the Orange County jail population by 50% to "protect inmates" from Covid-19 is truly an
atrocity. It appears that only 0.3% of the inmates have died from Covid-19. The numbers don't add up
and protecting hardened criminals health should not be prioritized over the safety of law abiding
citizens like us in Newport Beach and the other 3.1 million Orange County residents.
We look to each of you to keep our City of Newport Beach safe and we would appreciate any efforts
all of you can make to support Sheriff Barnes in preventing these inmate releases.
We would like to thank Councilman O'Neill for keeping our community informed and educated on
this most important issue as well as the many other issues that affect the citizens of our great city,
county and state. We are truly grateful for his service and thank all of you as well.

Sheriff Barnes position to NOT provide early release to criminals. This is frightening to me. Safety of
our law abiding citizens should be the highest priority. There had been a rash of burglaries in my
neighborhood ( I already had packages stolen this holiday,) and drug addiction is ubiquitous among
criminals. I work in the addiction field and I know that an addict will do whatever it takes to get their
fix, even if it means breaking the law. I pray you will be proactive about this issue and not let these
criminals out into our beloved city.

Barnes of the Orange County Superior Court Order calling for the early release of 1,800 felons into
our communities.
Not only does the release of convicted felons pose a tremendous risk to the physical safety of Orange
County residents, but it also has the potential for even greater spread of COVID to the general public
due to the felons' COVID exposure in the prison setting.

There is no reason to shorten nor commute sentences of those who have committed a crime that lands them in jail. If this
is to be done, I think our respected, elected officials should take at least three of the criminals to his/her home for the
duration of their sentences.

I support the proposal to file a legal briefing in support of OC Sheriff's position. I support the time and cost associated to
you do.
I have 2 boys 4 & 6yrs old, we live in Newport heights. They have already witnessed guns drawn at a neighborhood
home, questioned police helicopters, and while they think that is exciting to see right now, they are also aware of the
increase of neighborhood break ins and the double check of our locks every night.
I do not want to increase the opportunity of something to happen to us. I would rather be taken down by COVID than a
criminal prematurely released.

I am strongly in favor of the NB City Council authorizing the City Attorney to file a legal brief supporting the OC Sheriff's
position on releasing inmates. We are living in an insane world where hard-working small business owners are
prosecuted for trying to make an honest living, yet convicted criminals are released back to the streets. Public safety for
law-abiding Americans should take precedent over any concern of COVID spread in jails. I will not stand for my family
being subjected to any additional risk because violent criminals might catch a virus with a 99% (or higher) survival rate.
I am absolutely disgusted with what is happening in California. The new LA County DA, after destroying San Francisco, is
now bringing his "talents" down south where he will continue to dismantle our justice system. We need to fight back
hard to save Orange County, and it needs to start now with our support of Sheriff Barnes.

actually have to beg and plead with our judges in order to keep criminals in Jail.
1100% support our Sheriff in appealing this ruling and for the DA to file an amicus brief to show the dangers of this
decision. We can't release1,800 criminals, it's unconstitutional.
We pay more than our fair share of taxes to stay safe in our communities. This isn't politics, this is simple law and order.
Please let the community know exactly what we have to do in order to make sure these criminals stay in jail and our
streets are safe.

Dear Newport Beach City Council Members,
My family and I reside in Newport Coast and have recently learned about the court-ordered mandate to
release criminals from the Orange County jails. It is reprehensible to think about dangerous and violent
criminals being let out into our community. I strongly urge the City to file a legal brief in support of Sheriff
Barnes' position to refuse early release. The risks of COVID-19 to inmate populations should not be weighed
more heavily than the risks of crime to citizens in our community should such release occur. From DA Todd
Spitzer's statement released 12/12/20, "inmates released early before serving their full sentence or on $0 bail
went out and new crimes at rates at nearly triple normal recidivism rates: 44% for early release inmates and
38% for $0 bail defendants. A sample of their crimes: auto theft, burglary, robbery, assault, weapons, theft
and narcotics" and I even understand murder has occurred from a recently released 23 -year old. Early release
of prisoners should not be an option and from this data, foreseeable criminal risks would appear highly
predictable to occur. Daisy Ramirez, from the ACLU of Southern California, calls for greater humanity of
incarcerated people, stating they "should not be put in mortal danger." What about the mortal danger to our
OC community that has already been documented with crimes and even murder from the recently released
incarcerated people? There must be safer solutions than allowing these criminals to be released. Judge Peter
Wilson's order to support the ACLU stance to prioritize the health of inmates over the health and safety of the
greater OC population does not serve the public nor justice. We need an advocate to defend and protect the
community of law-abiding citizens; clearly the ACLU and Judge Peter Wilson support criminals over
community.

Barnes position to not provide early release to criminals.
I am not in favor of releasing inmates based on a virus so that they may go out and harm innocent
citizens, including your own family. I'm outraged that anyone would consider such a reckless thing to
do.

Dear City of Newport Beach City Council,
My husband and I are long time residents of Newport Beach. One year ago I felt safe to walk to the market at night and
walk around my neighborhood for exercise after work and most times that was after dark. I never felt threatened. I was
safe and so grateful that I lived in Newport Beach. Yesterday as I sat in my office at 7:00 am I had to watch helplessly
while a vagrant defecated on my neighbor's yard
and then urinated on the street. Last week for 3 hours all people walking on the sidewalk had to move into the street to
avoid another vagrant that was sprawled across the entire walkway. My husband called the police and they came out
but there was nothing they could do.
And now there is an attempt by some officials to release convicted criminals from our jails.
When are we finally going to say enough is enough and fight to do something about our beautiful city being ruined?
I strongly urge the city to file a legal brief in support of and in joinder of Sherriff Barnes position to not grant early
release to criminals.

We are writing to you to express our concern regarding the recent ruling requiring the OC Sheriff's office to release
inmates in our county.
We respectfully ask that your team contribute to these legal efforts to protect our community from unnecessary risk and
danger. In times of difficulty, it definitely seems like crime runs rampant. And while Covid is a very real risk, the bigger
risk is the likelihood that these offenders will return to crime in order to survive during this very tumultuous economic
time. Beyond that, it is our duty as citizens and neighbors to protect the victims first without fail.

immediately commit new crimes upon release.
What did it cost to arrest and convict these criminals?
