OO Discussion Items: a) Nancy Gardner - Review of the revised City of Newport Beach Noise Element Ms. Gardner reported that the Newport Beach Noise Element passed the Planning Commission review and comments and will go to Council. Concerns were expressed with the current law allowing car alarms to run for 45 minutes before a citation could be written. Officer Ludvigson stated this was a state law and the best way to change this is to write a local congressman. The City's best defense is to restrict the hours of use rather than try to implement an unenforceable ordinance. The City of Beverly Hills has an ordinance against leaf blowers without the benefit of enforcement provisions. The Committee discussed other noise concerns such as leaf blowers, lawn mowers, and edgers. b) Jack Keating - Guest speaker from Upper Newport Bay Preserve Mr. Keating reviewed the main activities of the Upper Newport Bay Preserve focusing on the restorations of the upper bay habitat and the education activities. Highlights include Earth Day, Free Fish Day, the Backbay Cleanup Day, outreach programs and tours. Ms. Shelton and Officer Ludvigson are coordinating E.Q.A.C.'s efforts for the September 17th Backbay Cleanup. c) Ray Zartler - Draft of flyer for construction sites Mr. Zartler distributed a rough draft of the Environmental Awareness for Construction or Remodeling Sites Notice. E.Q.A.C. committee members were asked to review and comment on the draft for next month's meeting. The committee discussed avenues of distribution for the Notice. Ms. Watt suggested that Mr. Zartler meet with Raimar Schuller, City of Newport Beach Building Director, for his review and comments. Mike Kilbride will meet with Kevin Murphy, City Manager, for his review and comments. E.Q.A.C. approved the Notice in concept. d) John Ludvigson - Review of Litter Ordinance Officer Ludvigson will present a review of the Litter Ordinance at the October meeting. e) Barbara Shelton - EQAC budget study Ms. Shelton distributed a worksheet for members to review outlining some of E.Q.A.C.'s activities and expected expenses. Ms. Shelton noted that although the budget for the year has been approved, the committee should appoint a member to report on the disposition of funds at each monthly meeting. With more clearly defined activities and expected expenses, it might be possible for a larger budget next year. The E.Q.A.C. budget for this year is $500.00. ©. Staff Reports: a) C.O.N.C.E.R.T. (Clean-up Our Neighborhoods, Communities, Environment, Recycle Things) - Terrance Phillips Terrance Phillips discussed the Council action on the calendar activity. City Council approved an exception to Council Policy A-5 allowing E.Q.A.C. to collect funds on behalf of the City to produce the environmental poster calendar. Mr. Phillips outlined for committee members how much advertising has already been pledged, how the spaces will be sold, appropriate advertising logos and slogans, and stated that the checks from the advertisers are to be made out to the City of Newport Beach. Mr. Phillips will then forward the checks to Dennis Danner, Finance Director. b) Recycling - Paul Peters Due to the excused absence of Mr. Niederhaus, who was attending the Parks, Beaches, and Recreation Committee meeting, the recycling report was given by Paul Peters. The pay per bag refuse collection report is currently under study by Mr. Niederhaus, and will be presented at the next E.Q.A.C. meeting. It was noted that numerous cities throughout Orange County are currently revising their commercial and residential refuse rates. The Solid Waste Coll ection/Recycling Summary (2nd Quarter 94) results were distributed and discussed. The General Services informational brochure regarding refuse collection, recycling, hazardous waste disposal and composting is being printed. As reported, Mr. Niederhaus expressed his gratitude to the E.Q.A.C. committee for the revisions and additions to the brochure. The brochure will be mailed to 27,000 residences within the City. c) E. I. R. (Environmental Impact Reports) - Nancy Gardner Ms. Gardner stated there were no E.I.R.s to report on. d) Newport Green - Ed Hepner Mr. Hepner reported that he has received a low number of replies from the Newport Green program which asks area businesses to share with E.Q.A.C. their programs which help protect the local environment. Comments included concerns whether the distribution method was in error, or whether actual business owners even received the letter. In a meeting with Bill Hamilton, owner of the Cannery Restaurant, is was suggested that the restaurants be contacted individually. Mr. Hepner will also meet with Rush Hill, Chairman of the Economic Development Committee, to discuss other distribution avenues. One tool for possible increased responses, would be the positive coverage Mr. Hepner has lobbied for from the Daily Pilot, Los Angeles Times, and the Register newspapers on responses. e) Beautification Award - Gordon Kilmer Due to the absence of Gordon Kilmer, there was no Beautification Awards report. f) Environmental Achievement Awar - Gregg Schwenk Candi Hubert nominated Ge/Wear, the Environmental Nature Center, and Jan Vandersloot for their environmental efforts in the community. Ed Hepner nominated Le Meridian and the Four Seasons Hotels. The committee concurred that all five nominees would received Environmental Achievement Awards. g) Com osting- Marge Pantzar Ms. Pantzar reported that the composting center located at the Oasis Senior Citizens is operating well. Continued Business Ms. Watt asked if one of the E.Q.A.C. members would accept the lead for next years National Pollution Prevention Week. National Pollution Prevention Week, now entering it's second year, is a nationally coordinated effort to encourage pollution prevention during the third week of September. A proclamation from the Mayor will be presented at the September 12 Council meeting. Ed Hepner, on behalf of E.Q.A.C. and Newport Green, will accept the proclamation. Adjournment There being no further business, a motion was made and approved to hold the next E.Q.A.C. meeting on Monday, October 3, 1994 a the Newport Beach Police Department Auditorium at 7:00 PM.
