CALL TO ORDER: The meeting was called to order by Chairman
Jean Watt, at 3:30 P.M.

APPROVAL OF The minutes of September 8, 1994, were approved
MINUTES: as submitted.
1. Regional Board Permit, IRWD. Jack Skinner reviewed the issue.
According to Skinner the Regional Board has sent out the revised
permit application with corrections, however he disagrees with
the NEGATIVE DECLARATION and contends there would be significant
environmental effects by allowing up to six million gallons per
day of treated waste water to be discharged into San Diego Creek
from October 1 through April 30. Skinner, using IRWD statistics,
stated that this would increase the nitrates entering Newport Bay
by 27 percent. The City, according to Skinner, has worked very
hard and has achieved improvement in water quality because of a
reduction of nutrients entering the bay from the San Diego Creek
watershed. Skinner contents that nutrients can linger in the bar
for months and this project would jeopardize the progress made in
water quality enhancement and its beneficial uses. Skinner also
pointed out that Bill Bretz, San Joaquin Freshwater Marsh
Steward, opposes this project basically for the same reasons.
Jim Hyde, Environmental Compliance Specialist, IRWD, presented
the proposed project to the committee, describing how the
reclaimed waste water would be brought into the project area,
circulated through a series of existing ponds, stored and finally
discharged. Hyde described the monitoring that would ensure that
water not meeting standards could be kept in the project site
until it met discharge standards. Hyde discussed how the project
would increase waterfowl and wildlife habitat in the creek.
Tom Rossmiller pointed out that the EMA, using a model, will
conduct a flow study of the upper bar and this should assist in
understanding dissolution factors, circulation under all
conditions (storm, low flow). They hope to start the study in
December, 1994.
Houston asked Wolter how long have we had a nitrate problem in
the bay. According to Wolter, this problem was identified by the
City around 185-86, and the algae bloom has been tracked as it
relates to tidal prism, tidal flow, and siltation.
Watt requested the committee to formulate an opinion. Asked for
comments before a vote. Houston pointed out that given the
history of the battle to reduce nitrates, what benefit is there
for the citizens of Newport Beach. Fura and Frenzel felt the
problem of acquiring reclaimed water and associated costs during
the months of high demand should be passed on to the water
district customers. The committee voted unanimous to recommend to
the City Council that they direct the City Attorney to write the
Regional Board informing them of the City's opposition to the
Negative Declaration of the project until the board has evaluated
the potential environmental impacts.
Hyde mentioned that this was a two year demonstration project
and doesn't roll over into a permanent permit until reviewed.
John Wolter stated the City of Newport Beach supports the
development of the San Joaquin Marsh and the benefits to the bay
that would result from the marsh.
2. Review revision of the Noise Element of the General plan.
Luxton passed out the General Plan Noise Element, requested the
committee to review the sections pertaining to Boats and Boat
Party Noise.
3. Joint Harbor Quality Committee and City Council meeting. Watt
discussed the format and requested committee members to volunteer
to report on current committee activities and future committee
goals. The Meeting is Monday, November 14, 1994.
4. Boat Maintenance Guidelines brochure. Armand informed the
committee that this brochure is being revised and asked the
members to review and submit comments at the next meeting.
5. Newport Beach Marine Industry Economic Development Conference.
Watt invited all members to attend this conference. Armand have a
brief description of the goals this conference hoped to achieve.
ADJOURNMENT: Meeting was adjourned at 6:00 P.M.
