The above referenced properties are currently located within the Multiple -Unit
Residential (RM) Zoning District and designated as Multi -Unit Residential (RM)
within the Land Use Element of the General Plan. The properties are not located
within a Planned Unit Development or an overlay district.
For the properties abutting 2001 Court Street: (1) northward, the Zoning District
is RM and the General Plan land use designation is RM; (2) southward, the Zoning
District is Single-Unit Residential (R-1) and the General Plan land use designation
is Single-Unit Residential Detached (RS-D); (3) eastward, the Zoning District is
Mixed-Use Water Related (MU-WU2) and the General Plan land use designation
is Mixed Use Water Related (MU-W2).
For the properties abutting 2004 West Ocean Front: (1) northward, the Zoning
District is Mixed-Use Water Related (MU-WU2) and the General Plan land use
designation is Mixed Use Water Related (MU-W2); (2) southward, the Zoning
District is RM and the General Plan land use designation is RM; (3) eastward, , the
Zoning District is Mixed-Use Water Related (MU-WU2) and the General Plan land

At the time the building permits were finaled, the building and parking requirements
were in substantial conformance with the development standards of the City of
Newport Beach Municipal Code. If the subject property does not comply with the
current regulations, it is considered to be nonconforming and is subject to Chapter
20.38 (Nonconforming Uses and Structures) of th e Newport Beach Municipal
Code.
Research of the permit and entitlement history of the property verifies that
discretionary approvals were acquired from the City of Newport Beach Planning
Division for development of the property. With the exception of the discretionary
approvals for signs, copies of those approvals are attached. Please contact the
Planning Division for further details on any discretionary application:
2001, 2003, and 2005 Court Street and 2004 West Ocean Front
Variance No. VA0544 approved on July 2, 1959, to allow a waiver of a
portion of off-street parking requirements, a balcony to encroach within one-
foot (1) of the side property line, a one-foot (1) front yard setback on Court
Street, and the construction of 9 apartment dwelling units on 4 C-1 lots.
2001, 2003 Court Street and 2004 West Ocean Front
Use Permit No. UP1538 approved on July 1, 1971, to allow the construction
of a 7-unit apartment building in the C-1 District.
Modification Permit No. MD0441 approved on February 8, 1972, to allow
a 5-foot front yard setback at 2004 West Ocean Front (Ordinance requires
20 feet); a 3-foot side yard setback adjacent to 20th Street at 2001 Court
Avenue (Ordinance requires 4.4 feet); a 4-foot, 1-inch and zero side yard
setbacks on the northwesterly side of 2003 Court Avenue (Ordinance
requires 4.4 feet); a 4-foot front yard setback at 2001 and 2003 Court
Avenue (Ordinance requires 20 feet)
2003, 2004, 2005 Court Street and 2004 West Ocean Front
Use Permit No. UP0529 approved on July 2, 1959, to permit the
construction of 9 apartments with 13 parking spaces on 4 lots (to be
combined into one lot).

This application requests permission to construct two apartment
buildings, with a total of 7 units in a C-l District. In accord-
ance with Section 20.24.030(c) of the Newport Beach Municipal Code,
residential uses are perm'ltted in the Col District subject to the
securi ng of a use permi t.
Subject Property and Surrounding Land Use
The subject property 'Is vacant at present. To the north, across
Court Avenue, there is an apartment building and some older residen-
tial dwellings. To the east, across 20th Street, are new duplexes.
The property to the west, fronting on Court Avenue, has an old house
on the rear portion of the lot. 'fhere are dup'lexes on either side
of that portion of the property fronting on West Ocean Front.
All street improvements, including curb, gutter and sidewalk are
existing.
Developmental Characteristics
The applicant proposes 7 units contained in two separate three story
bui1dings, 291:; feet in height. The );Iuilding facing Ocean Front will
have three two bedroom units and the building on the corner of Court
Avenue. and 20th Street will have two two bedroom uni ts and two three
bedroom units. Coveredparoking for 10 cars is provided in accordance

~Iith the existing parking requirements. Under the parking regula-
tions approved by the Commission on June 17,1971, this development
would require 12 covered spaces. It should be noted that the curb
cuts, as proposed, do not conform to the City Driveway Approach
Policy. This matter was discussed at the City r.ouncil meeting of
June 14, '1971 and "conditi anal approval \~as given to the curb cuts
provided that, in the opinion of the Planning Commission, the use
permit is advisable, ar,d witho~t bias ir, respect to the use permit".
The setbacks, as shown, comply generally with those established in
this area. The setback from West Ocean Ft'ont is 5 feet which is
thl! same as the adjacent residential block. The ~ideyard and rear
ya rd setbacks all conform to res i denti a1 code requi rements, ex.:ept
for the second and third level decks adjacent \0 20th Street. The
Court Avenue setback is 4 feet, except for the second and thi rd
1eval decks, compared to 9 feet for the R-4 property across 20th
Street and 5 feet for the R-3 property across Court Avenue and 20th
Straet,
Analysis
In ac("ordance with Section 20.08.170 of the Newport [leach Muni cipal
Code, residential uses in a "C" District shall comply with the re ..
quirements of the appropriate residentia" district. The applicant
proposes to develop in accordance with R-4 standards ~Ihich permit
one unit per each ~OO sq. ft. of lot area. In this case, the p;·operty
consists of three lots with a total area of 6,240 sq.ft. and 7 units
wou1 d be permi tted based upon the R-4 requi rements.
The enti re block between 19th and 20th Streets and between Court
Avenue and West Ocean Front is zoned R-4. In fact, all ocean front
property, classified for residential use, between 13th Street and
20th Street is zoned R-4. That resi denti a1 property north of Court
Avenue, and its easterly pro·longation, is zoned R-3. Therefore,
staff feels that the appli cant is devo1oping his property in accord-
ance with the most appropriate residential district.
Staff has four primary concerns as regards this development: 1.
Zoning should be consistent with land use; 2. Balconies projecting
to the edge of sidewalks are not usually pprmitted; 3. Access to
the parki n9 spaces should be guaranteed since three lots are involved,
and 4. Even with an access agreement, a Parcel Ma!'l combilling these
parcels should be fi led.
As regards the Zoning question, the five lots fronting on West Ocean
Front immedi ately west of 20th Street are developed as residential
(duplexes) with the exception of the subject property. This repre-
sents 130 feet of frontage. An equal area fronti ng on Court Avenlle
is either vacant or includfld in this application. Due to the parkili(,l
requi ron,ents relati ve to new commerci a1 developments, staff does not
foresee the use of this property as office or commerci al. The off-
street parking necessary to support a commel'cial venture is not
available in this area, espec'lally for the ocean front lots. There-
fore, staff recommends that the Planning Commis~ion initiate hearings

to consider the rezoning of a portion of this block from C-1 to
R-4. However, we do not feel action on this application should
be held up pending the outcome of such hearings.
The Architect has indicated that he desires balconies or decks on
the two sides of the bull di ng at the corn,~r (If Court Aven"e nnll 20th
Street to create a variati on in the setuack. The ba1coni es would
project to within 1 foot of the sidewalk. A similar request was
denied by the Nodifications Committee for the duplex immediately
across 20th Street. The side yard setback for other residential
uses in the area is three feet, and staff cannot recommend the
projecti on of any ba 1 cony or deck that wou1 d encroar.h into a three
foot setback from 20th Street. It should be noted that architec-
tural featur~s may extend 2~ feet into any required sideyard , but
may not be closer than 2 feet from the side property line, \Section
20.0B.150 of the Newport Beach M~\jlicip'll Code.) As for the encroach-
ment on the Court Avenue frontage, it has al ready been pointed out
that the 4 foot setback is less than that required in adjacent
residential blocks, therefore, staff could not recommend any addi-
tional encroachments.
Since three lots are involved, and the City Engineer is not satis-
fied that a Parcel Map by 'itself will solve the problem, easements
guaranteeing perpetual access to the parking spaces, and satisfactory
to the City AttornElY and Traffic Engineer, should be record~d,
The final area of concern is the number of lots involved. This
property was subdivided illegally and then legally (Res'Jbdivision
No. 300 -March lB, 1971), so now we have two parcel s "f two lots
each. The City Engineer has suggested the way out of the dilemma
would be to require a new Resubdivision. combining the lots into
one parcel, and recol'ding all easements on the Parcel Map.
Recommendati on
Staff feels that this application represents the highest and best
possible use of the 1 and in question, and approval of Use Permi t
Application No. 1538 ;s recommended subject to the following condi-

RECOMMENDATIONS:
That if the Planning COl11Tlission grants the Use Permit,'wldch is requ'lred
for the proposed development, that the curb cut application be approved.
DISCUSSION:
Attached is a sketch and a 1 etter from Rolly Pul aski, Archi tect, requesti ng a
number of curb cuts for a parcel located at the southwesterly corner of Court and
20th Street!;.
Council approval is required because the application does not conform to the
following provisions of the Driveway Approach Policy:
RESIDENTIAL ZONES AND RESIDENTIAL USES -SPECIAL REQUIREMENTS
1. The wi dth of the driveway approach bottom shall not exceed 20 feet
except when the driveway is to serve an enclosed three car garage,
in which case the driveway approach bottom may be increased to 25 feet.
2. One additional curb opening will be permitted to a single parcel
subjact to the following conditions: '
a. The total ~Iidth for all oper·ngs shall not exceed
50% of the total frontage of the parcel.
b. The openings shall be separated by at least 24 feet
to retain maximum street parking.
The project will require a use p~rmit In order to permit a residential use in
a commercial zone. The applicant desires to be assured that curb cuts will be appr'oved
if he can satisfy the other requirements for a use permit and a building permit.
