NOTICE IS HEREBY GIVEN th at on Thu rsday, January 23 2020 at 630 pm or soon thereafter as the matter
shall be heard , a public hearing will be conducted in the Co uncil Chamb ers at 100 Civic Center Drive, Newport
Beach . Th e Planning Commission of the City of Newport Beach will consider the folioing application
Re sidential Des ign Standard s Co de and LCP Amendments -Amendment s to Title 20 (Zoning Co de) and Title
21 (\_ocal Coastal Program Impl eme nt ation Pl anl of th e Newport Be ac h Muni cipal Code (NBMC) revising
development stan dard s applica ole t o single-an d wo-unit residenti al deve lopment Specifically, the proposea
amendme nt s wou ld reduce bulk and mass associated with fut ure residential development as fol lows
Revisions to Third Floor Standards
• Third fl oo r step backs would app ly to covered dec k areas (currently applies only to en close d fl oo r area).
• Third flo or si de step backs would app ly to lots 30 fee t wide or greater (currently app lies to lots
wider than 30 feet)
• Third floor sta ndards wou ld apply to Balboa Is land (cu rrently exempt)
• Maximum covered thi rd flo or area (enclosed or unenclosed) limited to 50 pe rce nt of buildabl e area
Uncovered deck area wou ld remain unrestricted .
Clarification of Gross Floor Area
• Unfinished attics with a cei ling height of 6 feet or higher would count as fl oor area (c urrently only
finished attics co unt )
• Cov ered patios, dec ks, and balconies above the fir st fl oor wou ld count as flo or area unl ess
comp letely open on at least two si de s, rath er than one side .
• Carports only ope n on one si de would count as floor area.
Single-Unit and Two-Unit Dwellings in RM Zone
• Exis tin g third floor and open spac e standards applicable to R-1 and R-2 zones wou Id now apply to
single-and tw o-u nit dwe lling s in RM zones .
Pursua nt to the autho rity and criteria contained in the California Environm en tal Quality Act (CEOA)" the
amendment s are statuto rily exempt fr om the CEOA in acco rd ance with Sect ion 21065 of CEOA and'State 1.,EQA
Guide lines Sections 15060 (c)(2), l 5060(c l\3l, and 15378. The proposed action is also exempt from the CEOA
pur suant to State CEOA Guidelines Section 5061 (b)(3), the general rule that CEOA applies only to projects whi ch
have the po te ntial for causing a s1gn 1f1cant effect on the environment
