On July 15, 2019, the Zoning Administrator approved Limited Term Permit No. XP2019- 006.This approval is based on the following findings and subject to the following conditions. PROJECT SUMMARY A limited term permit for less than 90 days to allow off-site parking for a marine use, Hornblower Yachts, to dock two additional charter boats (Dream Maker and Hornblower) at 2527 West Coast Highway. A conditional use permit is currently in place that allows for one charter boat (Icon) to dock at 2527 West Coast Highway. The added vessels will utilize two off-site lots at 2077 and 2241 West Coast Highway to accommodate passengers and crew for charter boat operations. ZONING DISTRICT/GENERAL PLAN General Plan: MU-W1 (Mixed-Use Water Related) Zone: MU-W1 (Mixed-Use Water Related) Coastal Land Use: MU-W (Mixed-Use Water Related) Coastal Zoning District: MU-W1 (Mixed-Use Water Related) I.BACKGROUND On December 9, 2004, the Planning Commission approved Off-site Parking Agreement No. 2004-002 and Modification Permit No. MD2004-067 (PA2004-216) to allow off-site parking at 2530 and 2436 West Coast Highway to satisfy the off-street parking requirements for a charter boat service (Icon) and allow tandem parking at the subject property. PROJECT DESCRIPTION The subject property is located on the south side of West Coast Highway, east of Tustin Avenue, within the Mariners’ Mile Specific Plan area. The site is improved with three freestanding buildings totaling approximately 7,440 square feet in area. The two existing buildings fronting on West Coast Highway are presently occupied by retail commercial and office businesses. The remaining two-story building is located to the rear of the property occupied by the Pacific Coast Yacht Club. The applicant proposes to add two additional charter boats to the project site and has submitted a project description (Attachment ZA 2) and operations plan (Attachment No. ZA 3) demonstrating the demand and availability of off-site parking lots is sufficient to serve the proposed charter boat operations. The existing buildings on-site would remain and continue to be leased with no physical improvements. The boat slips on-site have previously been configured to accommodate three slips for larger vessels, including the proposed vessels. Refer to dock plans provided as Attachment No. ZA 4. The existing and proposed Hornblower vessels have the following capacities: • Icon (164 passengers/crew) – existing • Dream Maker (141 passengers/crew) – proposed • Hornblower (51 passengers/crew) – proposed The operations plan identifies the following off-site parking sites are available after 5:30 p.m. weekdays and all day weekends to serve the charter boat operation: 2241 West Coast Highway - 26 spaces 2077 West Coast Highway - 45 spaces The operations plan provides an analysis of typical vessel operations and the resulting parking demand. III. FINDINGS Finding: A. This project has been reviewed, and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act under Class 4 (Minor Alterations to Land) and Class 23 (Normal Operations of Facilities for Public Gatherings). Facts in Support of Finding: 1. Class 4 exempts the minor public or private alterations in the condition of land, water, and/or vegetation which do not involve removal of healthy, mature, scenic trees except for forestry and agricultural purposes. Examples include minor temporary use of land having negligible or no permanent effects on the environment, including carnivals, sales of Christmas trees, etc. PA2019-106 Hornblower Limited Term Permit (PA2019-106) July 15, 2019 Page 3 Tmplt: 02/08/19 2. Class 23 consists of the normal operations of existing facilities for public gatherings for which the facilities were designed, where there is past history of the facility being used for the same or similar kind of purpose. 3. Charter boat operations typically accommodate a large num ber of passengers. The proposed charter boat operations will be a similar to existing charter boat operations that have occurred on the site since 2004. No new physical improvements are required to the existing dock or parking areas to accommodate the additional charter boat operation. Sufficient parking is available in the area to serve the uses on-site based upon the LSA operations plan. Finding: B. The operation of the limited duration use at the location proposed and within the time period specified would not be detrimental to the harmonious and orderly growth of the City, nor endanger, jeopardize, or otherwise constitute a hazard to the public convenience, health, interest, safety, or general welfare of persons residing or working in the neighborhood of the requested limited duration use; Facts in Support of Finding: 1. The limited term permit will allow off-site parking for marine activities, as conditioned. 2. The operation of two additional charter vessels is for an 89-day duration from July 16, 2019 through October 13, 2019. 3. Charter boat operations and off-site parking have been active at the subject property since 2004 and the use has not proven detrimental. 4. The Traffic Engineer has reviewed the application and determined that the off-site parking circulation will function adequately with the site. The use will not be detrimental to the health, safety, peace, comfort, and general welfare of persons residing or working in the neighborhood of such proposed use or be detrimental or injurious to property and improvements in the neighborhood or the general welfare of the City. Compliance with the project description, operations plan, and conditions of approval will ensure safe vehicle circulation and adequate parking is available to serve the marine uses on-site. Finding: C. The subject lot is adequate in size and shape to accommodate the limited duration use without material detriment to the use and enjoyment of other properties located adjacent to and in the vicinity of the lot; PA2019-106 Hornblower Limited Term Permit (PA2019-106) July 15, 2019 Page 4 Tmplt: 02/08/19 Facts in Support of Finding: 1. The subject lot is approximately 0.28 acres in size. Based upon the dock plan and LSA Operational Plan, there is adequate dock area to accommodate the additional charter boat operation, off-site parking, and passenger & vehicle loading without impacting vehicle circulation. 2. The off-site parking lots are located on the south side of West Coast Highway and are with walking distance to the subject property where they will be useful to the proposed boat charter business and the yacht club operations on-site. Finding: D. The subject lot is adequately served by streets or highways having sufficient width and improvements to accommodate the kind and quantity of traffic that the limited duration use would or could reasonably be expected to generate; Facts in Support of Finding: 1. The use of off-site parking lots will not create undue traffic hazards in the surrounding area. Charter patrons will be given maps showing the location of these parking lots and will be instructed to park at the proper location. 2. The limited duration use is for off-site parking for marine activities. Finding: E. Adequate temporary parking to accommodate vehicular traffic to be generated by the limited duration use would be available either on-site or at alternate locations acceptable to the Zoning Administrator; and Fact in Support of Finding: 1. The proposed limited duration use can be adequately accommodated in the off-site parking facilities as identified in the Operational Plan (Attachment No. ZA 3). 2. The off-site lots are in close proximity to the subject property and will be useful to the proposed charter boat operations. Finding: F. The limited duration use is consistent with all applicable provisions of the General Plan, any applicable specific plan, the Municipal Code, and other City regulations. The General Plan land use designation for this site is MU-W1 (Mixed-Use Water Related). The MU-W1 designation is applied to waterfront locations along the Mariners’ Mile Corridor in which marine-related, visitor-serving, commercial and residential uses are intermixed with buildings that provide residential uses above the ground floor. The proposed off-site parking for marine activities is intended to serve marine-related uses in the harbor, is authorized for a limited duration, and will not impede use of the site consistent with the MU-W1 designation. 3. The site is located in the MU-W1 (Mixed-Use Water Related) Zoning District. The MU-W1 designation is intended to apply to waterfront properties along the Mariners’ Mile Corridor in which nonresidential uses and residential dwelling units may be intermixed. A minimum of fifty (50) percent of the allowed square footage in a mixed- use development shall be used for nonresidential uses in which marine-related and visitor-serving land uses are mixed as provided in Table 2-10. Design of nonresidential space to facilitate marine-related uses is encouraged. The MU-W1 zoning district allows temporary uses as specified within the Zoning Code and the proposed limited duration use (off-site parking for marine activities) is consistent with marine-related uses encouraged in this District. 4. The marine uses and off-site parking locations are located within the Coastal Zone. A coastal development permit is not required because the proposed use does not involve development that would result in a risk of adverse environmental effect, adversely affect public access, or involve a change in use contrary to the Coastal Act. The application request is for a limited duration and relocates existing vessels in the harbor utilizing existing parking supplies available and no physical improvements to the site are necessary to accommodate the proposed use. 5. The site is not located within a specific plan area. IV. CONDITIONS (Project-specific conditions are in italics) 1. The development shall be in substantial conformance with the approved site plan except as noted in the following conditions. 2. Anything not specifically approved by this limited term permit is prohibited and must be addressed by a separate and subsequent review. 3. The charter boat operation is authorized for an 89-day duration from July 16, 2019 through October 13, 2019. 4. The combined passenger/crew count for Hornblower and Dream Maker shall not exceed 192 passengers and crew. PA2019-106 Hornblower Limited Term Permit (PA2019-106) July 15, 2019 Page 6 Tmplt: 02/08/19 5.Hornblower and Dream Maker passengers shall be directed to utilize the off-site parking supply available at 2077 and 2241 West Coast Highway after 5:30 p.m. on weekdays and all day on weekends. 6.During the weekdays (Monday through Friday) before 5:30 p.m., charter boat operations for Hornblower and Dream Maker shall be limited to motorcoach (bus) arrivals. 7.Motorcoach (bus) loading and parking shall be prohibited on West Coast Highway. 8.Multiple berthing shall be prohibited as per Newport Beach Fire Department Guideline A.10. As per the Guideline, “Each berth shall be arranged such that a boat occupying the berth can be removed in an emergency without the necessity of moving other boats.” 9.Should the operation of the charter boats become a detriment to the public health, comfort, convenience, safety, and general welfare of the peace and quiet of the neighboring properties and their inhabitants, this permit may be revoked. 10.To the fullest extent permitted by law, applicant shall indemnify, defend and hold harmless City, its City Council, its boards and commissions, officials, officers, employees, and agents from and against any and all claims, demands, obligations, damages, actions, causes of action, suits, losses, judgments, fines, penalties, liabilities, costs and expenses (including without limitation, attorney’s fees, disbursements and court costs) of every kind and nature whatsoever which may arise from or in any manner relate (directly or indirectly) to City’s approval of the Hornblower Limited Term Permit including, but not limited to, Limited Term Permit No. XP2019-006 (PA2019-106). This indemnification shall include, but not be limited to, damages awarded against the City, if any, costs of suit, attorneys' fees, and other expenses incurred in connection with such claim, action, causes of action, suit or proceeding whether incurred by applicant, City, and/or the parties initiating or bringing such proceeding. The applicant shall indemnify the City for all of City's costs, attorneys' fees, and damages, which City incurs in enforcing the indemnification provisions set forth in this condition. The applicant shall pay to the City upon demand any amount owed to the City pursuant to the indemnification requirements prescribed in this condition. APPEAL PERIOD: An appeal or call for review may be filed with the Director of Community Development or City Clerk, as applicable, within fourteen (14) days following the date the action or decision was rendered unless a different period of time is specified by the Municipal Code. As a company, for 39 years, Hornblower’s yachts have sailed past famed landmarks while serving seven California cities and New York City. In addition to dining cruises and classic, scenic, city and wildlife tours, Hornblower Cruises & Events hosts holiday dining cruises and private charters for corporate, school and family groups. Whether an intimate anniversary celebration, a wedding ceremony, a teambuilding event or a birthday bash, Hornblower's professional event planners help clients navigate every detail. Since 1990 Hornblower has offered these same services in Newport Beach. Request Hornblower operates cruises from Charter Yachts at 2527 W. Coast Highway. They are requesting a Limited Term Permit to operate the vessels detailed below from 2527 W. Coast Hwy. This request is the precursor to a request for a Conditional Use Permit and Coastal Development Permit. This request represents a relocation of two boats (Hornblower and Dream Maker) from Hornblower’s other Newport locations to 2527 W. Coast Hwy and continues the ongoing operations Hornblower has in Newport Beach. A detailed operational plan for Hornblower and Dream Maker, including dock layouts and additional parking/rider data, is provided as an attachment. This operational plan includes the existing and proposed hours of operation, staffing and guests, building and boat capacities, modes of transportation (including average vehicle occupancy), and parking characteristics (supply and demand). Typical hours of operation for office and administrative functions are 8:00 a.m. to 5:30 p.m., Monday–Friday. Events (cruises, tours, parties, and private charters) occur Monday–Sunday, with the majority occurring during the weekday nights and on the weekends. The proposed vessels have the following capacities: Dream Maker (141 passengers/crew) Hornblower (51 passengers/crew The existing 2527 W. Coast Hwy site has a 40-space parking lot. In addition, Hornblower is able to utilize various off-site locations in the project vicinity. The operational plan provides a graphic that depicts the two proposed parking locations for Dream Maker and Hornblower. The total 71-space parking supply is summarized below by location and time of day. 2241 W. Coast Highway (26 spaces): Monday-Friday (after 5:30 p.m.) and Saturday-Sunday (all day) 2077 W. Coast Highway (45 spaces): Monday-Friday (after 5:30 p.m.) and Saturday-Sunday (all day) PA2019-106 Guests are either dropped off on-site at 2527 W. Coast Hwy or walk to the site. Paths of travel for pedestrians are from the parking lots located at 2241 and 2077 W. Coast Hwy, along W. Coast Hwy – guests do not need to cross the street. Upon arrival at the site, guest check-in directly on their vessel. Hornblower staff is present every step of the way. Staff is on site, and at the designated parking lots to direct pedestrians, coaches and rideshare arrivals. At the end of an event guests are directed to their transportation for departure. Coast Highway) Operational Plan LSA is pleased to submit this Operational Plan for the proposed Hornblower Cruises & Events project. The project is located at 2527 W. Coast Highway in Newport Beach, California. Figure 1 (all figures attached) illustrates the project site and docks. Based on LSA’s understanding of the proposed project, the applicant proposes to add two boats (Dream Maker and Hornblower) to the Hornblower Cruises & Events operations, which currently has one boat (Icon). The two additional boats represent increased passenger capacity and additional crew, potentially affecting the Hornblower Cruises & Events parking demand. The purpose of this Operational Plan is to detail the proposed changes with the additional boats, as Icon is currently in operation and has adequate parking. The Operational Plan documents the anticipated typical weekday and weekend operations and attendance of Dream Maker and Hornblower. The Operational Plan describes the available parking supply, the parking characteristics, and the future parking demand with implementation of the project. OPERATIONAL PLAN LSA coordinated with the project applicant on the hours of operation, parking locations, capacities of the new boats, future estimates for visitors/guests and staffing, alternative modes of transportation utilized by guests and employees, average vehicle occupancy (AVO), etc. Hours of Operation. Typical hours of operation for office and administrative functions are 8:00 a.m. to 5:30 p.m., Monday–Friday. Events (cruises, tours, parties, and private charters) occur Monday– Sunday, with the majority occurring during the weekday nights and on the weekends. The typical weekday and weekend hours of operation would not change with the project. Parking Supply. Figure 2 illustrates the proposed parking supply of Dream Maker and Hornblower and the pedestrian paths of travel to and from the project site. As shown on Figure 2, 2241 W. Coast Highway (26 parking spaces) and 2077 W. Coast Highway (45 parking spaces) will provide a total of 71 parking spaces for typical weekday nighttime and weekend operations of Dream Maker and Hornblower. Table A shows the anticipated number of people on board Dream Maker and Hornblower during typical weekday nighttime and weekend operations, as well as the maximum capacity of the boats. On average, Dream Maker is anticipated to have 43 people on board (38 guests and 5 crew members) and Hornblower is anticipated to have 22 people on board (18 guests and 4 staff members) for a total of 65 people (56 guests and 9 crew/staff members) during typical weekday nighttime and weekend operations. Dream Maker and Hornblower have maximum boat capacities of 141 people (135 guests and 6 crew members) and 51 people (47 guests and 4 staff members), respectively, for a total of 192 people (182 guests and 10 crew/staff members). Transportation Modes and Parking Demand. Based on information from the project applicant, it is estimated that guests and crew/staff members utilize the following modes of transportation: Personal vehicle – 63 percent Motorcoach – 20 percent Rideshare (Uber/Lyft/taxi) – 15 percent Other (transit/walking/biking) – 2 percent According to the project applicant, it is estimated that the AVO is as follows: Personal vehicle – 3 persons per vehicle Motorcoach – 40 persons per motorcoach Rideshare (Uber/Lyft/taxi) – 1 person per vehicle These transportation mode splits (63 percent personal vehicle, 20 percent motorcoach, 15 percent rideshare, and 2 percent other) and AVO (3 persons per personal vehicle, 40 persons per motorcoach, and 1 person per rideshare vehicle) have been applied to the future guest and staffing projections of Dream Maker and Hornblower. As shown on Table B, typical weekday nighttime and weekend operations (65 total people) would result in 14 parked vehicles and the maximum capacity (192 total people) would result in 41 parked vehicles for Dream Maker and Hornblower. Under a maximum capacity scenario of Dream Maker and Hornblower (41‐space parking demand), it is expected that adequate parking (71‐space parking supply) would be provided for the project.
