SECTION IV. Reasons Supporting This Appeal
PLEASE NOTE:
• Appeals of local government coastal permit decisions are limited by a variety of factors and requirements of the Coastal
Act. Please review the appeal information sheet for assistance in completing this section.
• State briefly your reasons for this appeal. Include a summary description of Local Coastal Program,Land Use Plan,
or Port Master Plan policies and requirements in which you believe the project is inconsistent and the reasons the
decision warrants a new hearing. (Use additional paper as necessary.)
• This need not be a complete or exhaustive statement of your reasons of appeal; however, there must be sufficient
discussion for staff to determine that the appeal is allowed by law. The appellant,subsequent to filing the appeal,may
submit additional information to the staff and/or Commission to support the appeal request.
I believe the city's approval was inconsistent with the certified LCP. The project replaces a
duplex in the RM zone. The RM zone grants special height and other incentives to allow
construction of multiple units. Reducing to a SFR while taking advantage of the RM incentives
is counter to the intent of the Coastal Land Use Plan.
In particular, the CLUP designation of"RM-F promises (in Table 2.1.1-1 and Policy 2.1.2-1)
that the Implementation Plan will be used to provide, in this area, a residential density in the
range of 30.0-39.9 du/ac (the second highest residential density in Newport Beach). Replacing
this beachfront duplex with a SFR not only allows the builder 4 feet of height more than would
be allowed on a comparable R-1 zoned lot (per the tables in IP Sec. 21.18.030), but it places
this 0.071 acre lot and this 1.06 acre RM block as a whole far outside the CLUP-certified density
range.
