Mr. Klobe's position is inconsistent with the LCP and no substantial issue should be recommended to the Commission. 1. The density ranges in the CLUP are for a geographic areas and are not intended to be applied to individual parcels. 2. The density range is the anticipated density for the area for planning purposes and was never intended to set a minimum density for a parcel. Applying the higher minimum densities to RS or RT lots would necessitate two-family development on RS lots and multi-family development (three or more units) on two-family designated lots. The result of these two examples would be inconsistent with the RS or RT land use category of the CLUP and the permitted uses for the corresponding R-1, R-BI, and R-2 zones. 3. The certified LCP Implementation Plan allows single-unit dwellings in R-2 and RM, and is therefore consistent with the certified CLUP. You must be aware of the fact that there have been many dozens of permits issued by the Coastal Commission and the City since the certification of the CLUP in 2005 based on the points noted above. If you were to apply the planning density range minimum at this time, it would be extremely unfair to the property owner (and many others) who are simply following the current rules. In other words, misapplying the LCP would be a drastic and unfair changing of the rules and the result is 180 degrees in the opposite direction of the City's certified Local Coastal Program. Please contact me so we can discuss this before you complete your staff report.
