CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Jaime Murillo, Zoning Administrator Makana Nova, Senior Planner David Lee, Associate Planner Joselyn Perez, Assistant Planner Afshin Atapour, Planning Technician II. REQUEST FOR CONTINUANCES None. III. APPROVAL OF MINUTES ITEM NO. 1 MINUTES OF DECEMBER 10, 2020 Action: Approved IV. PUBLIC HEARING ITEMS ITEM NO. 2 Annual Review of Newport Beach Country Club – Tennis Club Site Development Agreement No. DA2008-001 (PA2016-196) Site Location: 1602 East Coast Highway Council District 5 Makana Nova, Senior Planner, provided a brief project description of the development agreement review, summarizing the project scope of work for the development of 27 hotel units, a new tennis clubhouse & spa/fitness center, and five residential dwellings. Since the last development agreement review, the City granted an extension of the Coastal Development Permit for one year through November 20, 2021. The parcel map for conveyance purposes was recorded in December of 2019. The tentative tract map has been submitted to Public Works but continues to require additional documentation before proceeding to City Council for acceptance and subsequent recordation. The applicant submitted plans into plan check in 2016 but the plan check has since expired, and the applicant intends to submit new plans updated to the current building code in the near future. The Zoning Administrator opened the public hearing and noted that the applicant was present. One member of the public, Jim Mosher, spoke and inquired about the process for granting the extension of the City’s Coastal Development Permit for the project. Mr. Mosher asked if this letter had been distributed through the City’s weekly staff action report. Senior Planner Nova responded to Mr. Mosher’s inquiry and indicated that the City does not typically distribute extension letters through the City’s weekly staff action report nor is it required by the Zoning Code, but the City could perhaps internally reexamine this policy. The Zoning Administrator closed the public hearing and received and inquired about the status of the plan check since the applicant’s statement indicated that the plan check had already been resubmitted to the City in October of 2020. Senior Planner Nova clarified that to date, the applicant had not submitted revised plans and is still in the process of updating the project design to the current building code requirements. With this MINUTES OF THE MEETING OF THE NEWPORT BEACH ZONING ADMINISTRATOR 01/14/2021 Page 2 of 4 information, the Zoning Administrator received and filed the review of the development agreement for the Newport Beach Country Club-Tennis Club Site. Action: Received and Filed ITEM NO. 3 Larkspur Partners, LLC Residential Condominiums #1 Tentative Parcel Map No. NP2020-016 (PA2020-321) Site Location: 420 and 420 ½ Larkspur Avenue Council District 6 The Zoning Administrator provided a brief project description stating that the request is for a tentative parcel map which will allow each unit of an under-construction duplex to be sold individually. He added that no deviations from Title 19 are requested. The Zoning Administrator did not ask for a presentation from staff. Applicant Alain of IDL Homes, on behalf of the applicant, stated that he had reviewed the draft resolution and agrees with all of the required conditions. The Zoning Administrator opened the public hearing. Seeing that no one from the public wished to comment, the public hearing was closed. Action: Approved ITEM NO. 5 Snell Residence Coastal Development Permit No. CD2020-140 (PA2020-301) Site Location: 502 Via Lido Nord Council District 1 Afshin Atapour, Planning Technician, provided a brief project description stating that this is a request for a Coastal Development Permit to demolish an existing single-family residence and construct a 2,971 square-foot, two-story, single-family residence with an attached 554 square-foot two-car garage. The design includes hardscape, gates, and landscaping. The project complies with all development standards and no deviations are requested. On July 24, 2020, the Community Development Director approved Staff Approval No. SA2020-003 (PA2020-063) the established grade of 11.14 feet based on the North American Vertical Datum of 1988 (NAVD88) for the purposes of measuring principal structure height. An alternative grade of 10.64 feet (NAVD88) was also established for the purpose of measuring height for accessory structures within the 10-foot front setback area. The Zoning Administrator asked for the reasoning and justification of the approved grade determination for the property.
