FOR CONSTRUCTION AND MAINTENANCE
WITHIN THE BAYSIDE DRIVE RIGHT-
BAYSIDE DRIVE.
Approve an Encroachment Agreement permitting the
construction of decorative concrete, concrete pavers and
brick pavers within the Bayside Drive parkway adjacent to
2103 Bayside Drive; authorize the Mayor and the City
Clerk to execute the agreement; and direct the City Clerk
to have the agreement recorded with the Orange County
Recorder.
DISCUSSION:
The subject property has two existing decorative concrete
drive aprons and three (3) foot wide decorative sidewalk existing
along the Bayside Drive frontage. The City has requested that the
owners widen the existing sidewalk to a minimum width of five (5)
feet with the remodel of the existing residence, as Bayside Drive
is a Significant Link roadway.
The owner, Mr. Inoue, has requested that he be permitted
to construct decorative concrete, concrete pavers and brick pavers
for the required sidewalk improvements to match the existing non-
standard improvements in the Bayside Drive parkway. A planter, one
(1) foot wide by (6) feet long, will be constructed at back of
sidewalk between the existing drive aprons to maintain a separation
between the private driveway and the public sidewalk.
The Encroachment Agreement will permit construction of
non-standard improvements within the Bayside Drive parkway as
approved by the Public Works Department, require the property
owners to maintain the non-standard improvements and hold the City
harmless against all liability and costs associated with these
improvements.
