SUBJECT: NONSTANDARD IMPROVEMENT AGREEMENT FOR A DRIVEWAY AT 801 CLIFF DRIVE
RECOMMENDATION:
Authorize the execution of a nonstandard improvement agreement for
the construction of a brick driveway in the public right of way.
DISCUSSION:
Mr. Dudley Johnson of 801 Cliff Drive has requested that he be
allowed to construct a used -brick drive approach within the public parkway
area in front of his residence. Attached is a copy of Mr. Johnson's request
and a sketch of the driveway.
Council Policy L-2 requires that standard concrete drive approaches
be used within the public rights of way. Council Policy L-6 provides for the
issuance of a permit for construction with prior City Council approval if the
approval is consistent with the public interest.
Cliff Drive, in this area, does not have sidewalks. A brick drive-
way and approach are consistent with other improvements along Cliff Drive.
Mr. Johnson has agreed to execute a nonstandard improvement agreement which
provides for him to pay any added costs that might be incurred, related to a
concrete drive versus a brick drive,if the City were to have to perform work
in the parkway area. The agreement also requires the owner to assume lia-
bility for claims resulting from the driveway's being brick in the public
right of way.
It is recommended that the request be approved and that a non-
standard improvement agreement be executed.

Dear Mr. Webb:
Per our conversation, I am submitting a sketch of our new driveway
that is intended to be all used brick. It is my understanding
that because the front 10' - 12' of our yard actually belongs to
the City that we must obtain approval to construct the driveway.
Hopefully, this sketch will be sufficient to prepare whatever
documentation is needed to complete the drive. Thank you for your
help in this matter.
