Approve an encroachment agreement with Edward and Judith Selich to permit two brick pilasters and a connecting wooden fence to be built in a storm drain easement at 201 Milford Road; 2. Authorize the Mayor and the City Clerk to execute the agreement; and 3. Direct the City Clerk to record the agreement with the County Recorder. DISCUSSION: The Selichs desire to secure a permit for two brick pilasters that have been constructed in a five -foot -wide storm drain easement that is centered on the common property line between Nos. 201 and 207 Milford Road. The pilas- ters will be joined by a wooden fence that will extend from the front setback line approximately 15 feet to an existing retaining wall that has been con- structed for a number of years on top of the storm drain. The location is shown on the attached sketch. The subject agreement provides that should the City ever have to re- pair or replace the storm drain, the City may, without advance notice, remove the two brick pilasters and connecting wooden fence; and that replacement of the pilasters and fence is the responsibility of the property owners.
