Brown, City Clerk - 949-644-3005, (brown@newportbeachca.gov PREPARED BY: Brandi Goodman-DeCoud, Assistant City Clerk, bgoodman@newportbeachca.gov PHONE: 949-644-3006 TITLE: Resolution No. 2021-10: Eliminating the Inter City Liaison Committee and Repealing City Council Resolution No. 89-132 ABSTRACT: On November 27, 1989, the City Council adopted Resolution No. 89-132 which abolished the Inter City Relations Committee and created the Inter City Liaison Committee and established membership and responsibilities. The committee has not met in several years. If adopted, Resolution No. 2021-10 would eliminate the Inter City Liaison Committee and repeal Resolution No. 89-132. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Adopt Resolution No: 2021-10, A Resolution of the City Council of the City of Newport Beach, California, Eliminating the Inter City Liaison Committee and Repealing City Council Resolution No. 89-132. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. DISCUSSION: The purpose of the Inter City Liaison Committee (Committee) is to develop agreements on common problems and/or the sharing of municipal services on a cooperative basis with the cities of Newport Beach, Santa Ana, Tustin, Laguna Beach, Costa Mesa and Irvine. Its members consisted of two Newport Beach City Council Members, appointed by the Mayor and the City Manager. 4-1 Resolution No. 2021-10: Eliminating the Inter City Liaison Committee and Repealing City Council Resolution No. 89-132 February 23, 2021 Page 2 The Committee has the responsibility to meet at least once a month to review matters of mutual interest. This Committee has not held a meeting in several years. During the January 12, 2021 City Council Meeting, Council Member Will O'Neill, who was appointed to the Committee, proposed disbanding it due to lack of use. Should the City Council desire to disband the Inter City Liaison Committee, it would be appropriate to adopt Resolution No. 2021-10. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). ATTACHMENT: Attachment A — Resolution No. 2021-10 4-2 ATTACHMENT A RESOLUTION NO. 2021-10 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ELIMINATING THE INTER CITY LIAISON COMMITTEE AND REPEALING CITY COUNCIL RESOLUTION NO. 89-132 WHEREAS, the City Council of the City of Newport Beach values the community input and dialogue created by the boards, committees, and commissions within the City that involve residents, interested business persons, and Council members; WHEREAS, the creation of boards, commissions and committees helps the City Council obtain background, history and citizen perspectives on the issues brought before these bodies; WHEREAS, the City Council desires to maintain a list of active boards, commissions and committees that is current and serves valuable purposes; WHEREAS, the City Council previously adopted Resolution No. 89-132 establishing the membership and responsibilities of the Inter City Liaison Committee ("Committee"); and WHEREAS, the City Council desires to eliminate the Committee. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby reaffirm its appreciation for the work done by the Committee. Section 2: The Committee is hereby permanently disbanded and dissolved and all resolutions, including Resolution No. 89-132, and actions establishing the Committee or extending the terms thereof, if any, are hereby repealed. Section 3: Neither the adoption of this resolution nor the repeal of any other resolution of this City shall in any manner affect the validity of the actions or conduct of the Committee taken prior to the effective date hereof, nor be construed as a waiver of any action or conduct of the Committee taken prior to the effective date hereof. Section 4: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. 4-3 Resolution No. 2021 - Page 2 of 2 Section 5: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 6: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Section 7: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
