Page 1, MEMBERS PRESENT: “(Ex Officio Member) Will O’Neill”
Comment: I don’t believe it’s quite correct to describe Mr. O’Neill as an “ex officio” member.
According to the enabling resolution, the member by reason of office is the City’s current
Mayor. Mr. O’Neill might more properly be described as the “Mayor’s designee.”
Page 1, Item IV.a, paragraph 1: “Committee Member Sandland requested the minutes reflect
that the Basic Compatibility Qualities can be found in the California Airport Land Use
Commission (ALUC) Planning Handbook.”
Comment: As best I can tell, there is no document with the title stated. The reference
appears to be to Appendix D of Orange County’s JWA Airport Environs Land Use Plan;
specifically, to “Table B Basic Safety Compatibility Qualities” on pages 138 and 139 of the
174-page PDF. These say they are copied from Table 9B of the California Airport Land
Use Planning Handbook (January 2002).
However, the term “Basic Safety Compatibility Qualities” does not appear in Caltrans’
currently posted version of the California Airport Land Use Planning Handbook, which is
dated “October 2011” and contains no Chapter 9. The closest thing is the “Basic
Compatibility Policies” for each safety zone listed in the multi-part Figure 4 starting on page
4-20 (page 124 of the 455-page PDF). The HEUAC may wish to review these, as Caltrans’
policies appear to have been somewhat revised and may not agree with the earlier ones
copied in the JWA AELUP.
Page 2, Item “b”, paragraph 1: “Deputy Community Development Director Jim Campbell
advised that the City continues to send letters to property owners to determine their interest in
redeveloping their properties.”
Page 3, paragraph 1, sentence 2: “A project in the pipeline is a project at any stage in the
entitlements process, but it must be first occupied after June 30, 2021 to be counted toward the
sixth cycle RHNA.”
Page 4, full paragraph 3: “In reply to Committee Member Sandland's inquiry, Chair Tucker
related that the discussion of the Newport Center Area covered out outer parcels and parcels
within the shopping center.”

Page 6, full paragraph 2: “Jim Mosher clarified that the Coronado apartments are currently
known as 880 Eight 80 Newport Beach.”
Page 6, full paragraph 5: “Debra Allen commented that the scenarios are shocking and
requested the HEUAC maintain the height limits in the sight plane ordinance Sight Plane
Ordinance.”
Page 7, last part of paragraph 8: “Amending the Housing Element is a General Plan
amendment, but it does not trigger a Greenlight vote. When the Land Use Element is updated to
reflect the Housing Element policies, staff anticipates the update triggering a Greenlight vote.”
Comment: These statements are inconsistent with the language of City Charter Section 423
(Greenlight). It mentions the Land Use Element, and at that, only the 1988-1998 version, only
to the extent it defines statistical areas. It says a public vote is triggered by any general plan
amendment that adds specified amounts of density or intensity to a statistical area.
Page 8, Item “d”, paragraph 4: “In reply to committee Member Steven's Stevens' inquiry, Mr.
Barquist advised that the May timeframe is not a requirement, but …”
