TITLE: Confirmation of Council Member Joy Brenner's Citizen Appointment
to the Finance Committee
ABSTRACT:
Pursuant to Resolution No. 2018-71, Council Member Joy Brenner may appoint a citizen
advisor to the Finance Committee.
RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Confirm Council Member Joy Brenner's reappointment of Larry Tucker to serve on the
Finance Committee until June 30, 2021.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
The Finance Committee is comprised of seven members, three of which are City Council
Members appointed by the Mayor, and four of which are citizen members appointed by
the Council Members not on the Finance Committee, subject to approval of the City
Council.
On February 9, 2021, Mayor Brad Avery appointed Council Member Noah Blom to the
Finance Committee to fill the seat left vacant by Council Member Joy Brenner's
resignation due to her appointment to the Orange County Mosquito and Vector Control
District Board of Trustees. Larry Tucker was Council Member Blom's citizen advisor to
the Finance Committee. However, with Council Member Blom's appointment, Mr. Tucker
was no longer eligible to serve as Council Member Blom's citizen advisor since the four
citizen members are to be appointed by the Council Members not currently seated on the
committee. This created a vacancy for a term that expires on June 30, 2021, and provided
Council Member Brenner the opportunity to appoint a citizen advisor to the Finance
Committee.

Pursuant to the Maddy Act and City Council Policy A-2 (Boards, Commissions and
Committees), the City Clerk prepared and posted a Notice of Unscheduled Vacancy on
Wednesday, February 10, 2021, in the City Clerk's Office, at the Central Library, on the
bulletin board in the City Council Chambers, and on the City's webpage, and published
the Notice in the Daily Pilot on Saturday, February 13, 2021. As provided in the Notice,
applications were accepted by the City Clerk's Office until noon on Friday, February 19,
2021. At the close of the application period, the City Clerk's Office received three (3)
applications.
Following a review of the applications, it is the desire of Council Member Joy Brenner to
appoint Larry Tucker to serve for the remainder of his term.
It should be noted that the four (4) citizen advisors to the Finance Committee, including
Council Member Brenner's appointment, are appointed annually, on a Fiscal Year Basis,
and the term of all four (4) citizen advisors is scheduled to end on June 30, 2021. The
process to fill the vacancies is provided in Resolution No. 2018-71, City Council Policy A-
2 (Boards, Commissions and Committees), and the Maddy Act. All vacancies will be
noticed according to the Maddy Act and City Council Policy A-2.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.

The quality of life in Newport Beach is directly related to the financial standing of the City. The greater the financial strength of
the City, the better able the City will be to maintain and enhance its public facilities and retain a highly capable workforce, The
City Council has established the purposes and responsibilities of the Finance Committee and I believe my educational
background and work experience, and my 3 years of Finance Committee service, will allow me to assist the Finance
Committee in meeting the Council's expectations.
Although I no longer work in public accounting, I still have the thought process of a CPA. In addition, I have spent many years
in business so I appreciate the importance of fiscal discipline. My service on many City Commissions/Committees tell me that
while staff is very capable, they do benefit from citizen input from those with private world experience.
