A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH ADOPTING AMENDMENT
NO: 23 TO THE MASTER STREET AND HIGHWAY
PLAN
WHEREAS, the Planning Commission and the City Council
have heretofore adopted a Master Plan which includes as a unit
thereof a Master Street and Highway Plan, with revisions; and
WHEREAS, studies by the Planning Commission reveal
that since the adoption of said Master Street and Highway Plan
there have been changes in conditions which indicate that said
Plan should be amended to show new alignments, additions, street
name corrections and classification changes; and
WHEREAS, the Planning Commission of the City of New-
port Beach, after notice as required by law, has held a public
hearing on the proposed amendment and has recommended the adoption
of the amendment to the Master Street and Highway Plan; and
WHEREAS, the City Council, after notice as required
by law, has held a public hearing on said proposed amendment; and
WHEREAS, the City Council has determined that it is
desirable to amend said Master Street and Highway Plan as recom-
mended;
RESOLVED that the City NOW, THEREFORE, BE IT y Council
of the City of Newport Beach does hereby adopt Amendment No. 23
to the Master Street and Highway Plan as shown on a map entitled
Exhibit "A", attached hereto, designating thereon that 32nd
Street between Newport Boulevard and Lafayette Avenue and also
32nd Street between Balboa Boulevard and Seashore Drive shall
be added to the City of Newport Beach Master Street and Highway
Plan as a secondary highway.
BE IT FURTHER RESOLVED that Seashore Drive between
32nd and 33rd Streets shall be extended as a local street on the
City of Newport Beach Master Street and Highway Plan.

APPROVED The Planning Director and City Engineer
addressed the Commission regarding this
proposed amendment.
After discussion , .the Commission adopted Motion x
Resolution No . 721 recommending to the City Second x
Council 'that the Master Street and Highway All Ayes
Plan be amended to -designate the future loca-
tion of- the Newport Freeway along an alignment
running generally westerly of Superior Avenue
and that Newport Boulevard be retained on the
plan with the designation of a "Major Street" .

The Planning Director addressed the Commission
regarding this amendment . ,
Mr. Louis A. Kaufman of 112 - 32nd Street
inquired as to whether this was a precise
alignment. Mr. Nolan , City Engineer, stated
that it was not but that the Public Works
Department would like to resolve this problem
as soon as possible and hoped to have it fixed
precisely within a year.
After discussion , 'the Commission adopted Motion x
Resolution No. 722 recommending to the City Second x
Council that the Master Plan of Streets and, All Ayes

At its meeting on June 5 , 1969 the Newport Beach City Planning
Commission held a public hearing to consider Master Plan Amend-
ment No . 23 to add portions of 32nd Street to the Master Plan
as a secondary highway . Copies of the following are attached .

After discussion , the Planning Commission unanimously voted to

Subject: Extensions of 32nd Street and of Seashore Drive
Dear Mr. and Mrs, Kaufman;
This is a follow-up to the letter dated May 23, 1969 from the
City's Planning Director, Laurence Wilson, regarding the above
matter,
A number of alternate alignments are possible for the extensions
of Seashore Drive and 32nd Street to a point of intersection, The
alignments shown on the drawing transmitted with Mr. Wilson's letter
were located entirely on vacant property, however other alignments
are possible which could affect your property at 112 - 32nd Street.
There is no plan for or conaitment to any precise alignment at •this
time. We intend to make a study determining the precise alignment
for all of 32nd Street from Seashore Drive to Lafayette Street in
the near future. It is expected that the study will be completed
in approximately one year, and that property owners will then be
able to plan accordingly.
With regard to your question concerning rumors about an Ocean
Front road, there is no plan for such a road. The official position
of the City Council is stated in the following minute resolution:
"This Council of the City of Newport Beach has no intention of
constructing a street or road along the ocean front beach, nor to
embark on a program of studies intended to lead to such construction."

Amendment to add 32nd Street between Newport Boulevard
and Lafayette Avenue and also between Balboa Boulevard
and Seashore Drive as a secondary highway; also ,
Seashore Drive between 32nd and 33rd Streets is proposed
to be extended as a local street.
Background
In March , 1968, the Newport Beach Traffic , Parking and Operations
Study , prepared by Wilbur Smith and Associates , was presented to the
City Council . Among the many findings and proposals contained in
this study was the recommendation that 32nd Street from Lafayette
Avenue to Seashore Drive ultimately be improved to secondary street
status -- four-lane undivided . Also included was the proposal that
Seashore Drive be extended from its present termination at 33rd Street
to a connection with 32nd Street.
That portion of 32nd Street between Newport Boulevard and Balboa
Boulevard is already designated as a secondary street on the Master
Street and Highway Plan . Over the past two years , the City has been
acquiring the necessary right-of-way for widening of 32nd Street along
this particular section . Funds have been tentatively provided in the
budget for fiscal year 1969-70 for start of acquisition of property
along 32nd Street between Newport Boulevard and Lafayette Avenue.
Analysis
The need for this change in status of 32nd Street was confirmed by
the Wilbur Smith and Associates ' study . Their findings indicated
that traffic volumes in the summer of 1967 , between Lafayette Avenue
and Newport Boulevard , were 5 ,000 vehicles per day ; volumes between
Newport and Balboa Boulevards were 8,000 vehicles per day . The pro-
jections for the year 1990 indicate that these same sections will
carry between 16 ,000 and 19 ,000pand 20 ,000 vehicles per day , respec-
tively . To accommodate these future traffic volumes , the Smith
report determines that four travel lanes will be required .
In order to provide proper circulation between 32nd Street and Sea-
shore Drive , Seashore Drive should be extended between 33rd and 32nd
Streets .

Recommendation
In light of the foregoing discussion , the Staff recommends that
the Master Street and Highway Plan be amended to designate all
of 32nd Street between Lafayette Avenue and Seashore Drive as
a "Secondary" street and that Seashore Drive be extended as a
local street between 33rd and 32nd Streets . These changes will
untimately lead to the widening and improvement of 32nd Street
in order to accommodate projected increased traffic volumes .

the improvement of the Newport area, but

in authority, like .yourself. regarding this
extension of Seashore drive, and also the
extension of 32nd street to the ocean, with
a tie-up to a ocean road down to the city
and town of Newport. These we have read in
the local newspapers , plus more rumors.

It is requested that the following changes to the Street Master
Plan be initiated as soon as possible:
1. Show the Newport Freeway on a Superior Avenue alignment .

No. 6927, adopted on February 10, 1969. This proposed
revision to the Master Plan was informally approved by

: . 1n respect to the appraisement of the properties involved in the above
a project,, it would appear that we now need a definitive statement from the City
as to their policy toward the permitted uses of some of the remainder parcels.
These include:

unit. Some parcels remaining will be close to 2000;i but slightly

1 would like to know whether or not, in this instance, the
City would issue a variance to permit two units on these sites
I in the after condition. 1 might mention that the County of Orange
reportedly does now have a section within their zoning ordinance
which permits usage of a substandard lot for its original permitted
cf usage when a condemnation action has taken an area which results
in the remainder retaining at least 80%,af the previous minimum.

Further a variance can be obtained to accommodate full usage
when greater percentage takings occur and such variances can be
initiated at the request of the condemning agency rather than the
property owner. This would result in a definite answer to the ques-
tion of whether or not there existed a reasonable probability that
such a variance could be obtained.
2. Front and Rear Yard Setbacks
Subject parcels on 32nd Street presently have a 10' front
-setback requirement. Could this be reduced in the after condition
and to what extent? We note that 30th St„ after the widening, was
accorded a 5' setback.
Similarly, since a nonresidential zone adjoins these parcels
to rear and,in the after condition, some lots will be greatly reduced

SUBJECT: WIDENING OF 32ND STREET, BALBOA TO NEWPORT BLVD.
As you know from our conversation on the above subject,
the traffic study will recommend that 32nd Street be
widened. Therefore, the Public Works Department is
proceeding with steps toward acquiring the necessary
right of way and designing the street.
We have met with an appraiser and will be getting a
preliminary area appraisal . This appraisal will include
severance damage costs so an evaluation can be made as
to whether to purchase the entire land section along the
east side of 32nd or just the amount needed for the
right of way.
We are enclosing a drawing and an air photo marked up
to illustrate the areas needed for the street widening
project. As you can see, most of the improved property
will be affected by the project.
It is requested that you advise us as to your plans for
the area following the project in both of the following
events:
1 . If the City only purchases the minimum right of way
and leaves the property that would make a legal size
lot in the hands of private individuals.
2. If the City buys the entire section -
a. Do you plan any kind of City redevelopment?
b. Do you plan on selling to one purchaser to
redevelop in relation to use of adjacent
property?
A trade might be negotiated with the shopping
center for land needed for the right of way.

NEWPORT BOULEVARD FOR THE WIDENING OF 32ND STREET
We have been advised that the Lerner Oil Company has acquired a lease on the
property at the northwest corner of Newport Boulevard and 32nd Street at $500
per month net for 10 years.
With this information in mind, a meeting was held between Mr. George H. Jones ,
our appraiser, Ben Nolan, and Project Engineer, Don Webb, to discuss possible
advantages and disadvantages of immediately acquireing the parcel of right-of-way
on the property needed for the widening of 32nd Street.
Some of the points brought out follow:
1. A triangular parcel of approximately 800 sa, ft. will be required
to widen 32nd Street.
2. The existing lot size is approximately 70 feet by 100 feet.
3. Because of the reduction in frontage and area, it is questionable that
the remaining 6200 square feet would be adequate for a service station.
If this is true, a substantial severance damage would result from the
right-of-way acquisition.
RECOMMENDATIONS:
1. If the new lessee plans to use the existing facilities with little or
no modifications, wait to purchase property until is needed (2-3 years).
This approach would allow time for the business to make good or fail
as the service stations previously operated at this location have done.
If the latter occurs , the new lessee would be in a less favorable position
to claim high property value and severance damages. Conversely, if the
new business is successful , the value of the property and probable damages
to it would be relatively unchanged by the delay in acquisition.
2. Should the new lessee plan to construct substantial new improvements, it
) would be to ou advantage to acquire the property at this time.

The City's position regarding bargaining was discussed. Mr.
Hurlburt pointed out success has been achieved in the past by offering
the appraisal price and not varying unless new facts of disclosed;
thus letting people know Just where they stand. He suggests we do this.
We will follow this approach.
Mr, Hurlburt was advised two owners have indicated an urgent
desire to sell: He authorized sale to the first owner accepting the
appraisal price.
Much of the property to be acquired is now improved with in-
come units, Disposal of these improvements was discussed4 Since ac-
quisition will take several years, it may be to the City's advantage to
rent the property in the interim. Mr. Devlin pointed out if this is
donee all receipts must go back into the Gas Tax Fund should the property
be purchased with Gas Tax Funds, Mr. Hurlburt concurred, He authorized
the Public Works Department to contact a property manager such as Ralph
Maskey to discuss a possible management arrangement,

fence around certain properties on Balboa Boulevard on the south-
westerly side opposite the prolongation of 32nd Street. You are
further authorized and directed to approve the use of the subject
property for equipment and materials storage by the contractor who
will be installing sewer lines in the Balboa Peninsula area for the City
during the next four or five months.
Such authorization will be accompanied with conditions and
restrictions necessary to protect the citizens in the area from all
possible nuisances related to the utilization of this facility. It
is essential that this job move ahead as expeditiously as possible in
order that there may, be no undue expenses incurred by the City and
also in order that this project might be completed prior to the summer
months.

RECOMMENDATIONS:
1 . Authorize modification of the 32nd Street widening ,project to also
include design of the 32nd Street and Seashore Drive extensions
westerly of Balboa Boulevard.
2. Adopt a resolution authorizing the. Mayor and the City Clerk to
execute an agreement with Shuirman-Simpson Civil Engineers for
the subject engineering services.
DISCUSSION:
Included in the current budget is a project for the widening of 32nd Street
from Newport Boulevard to Balboa Boulevard; this project provides for preparation of
the plans by a private engineer. An additional project for the extension of 32nd Street
westerly of Balboa Boulevard and for the extension of Seashore Drive to 32nd Street is
tentatively scheduled for the 1971•-72 fiscal year.
In order to coordinate design features such as the establishment of grades
for drainage, and for over-all economy, it would be desirable to combine the design of
both projects in a single engineering services agreement. (The current project .includes
the construction of intersection improvements on the westerly side of Ba-lboa Boulevard
so as to enable the construction of the traffic signal facilities in their ultimate
location. )
A proposal has been received from Shuirman-Simpson, Civil Engineers, to perform
the engineering services. This firm is well qualified to perform work of,the type
required, and has satisfactorily completed consulting civil engineering services for the
city in the past.
Compensation will be at their standard hourly rates with a guaranteed maximum
fee of $121500, plus an estimated amount of $600 for the actual cost of Nephoducing plans
and preparing an, aerial photograph. This fee falls within the schedule recommended by
the American Society of-Civil Engineers for work of the type involved.
Funding will be as follows:

Subject: Engineering Services - Widening 32nd Street
The cost of the design work for the current project, estimated to be $9,200,
is eligible for SK financing with County Arterial Highway Financing Program (AHFP)
funds; the other 50% and the remaining cost will be financed with Gas Tax Funds. Current
estimates indicate that adequate funding is available in the present appropriation.
Plans for the two projects will be prepared in a manner that will permit
separate bidding. Construction of the current project is presently planned to be
commenced in January, 1971 .
