RECOMMENDATION:
Staff recommends that the Parks, Beaches & Recreation (PB&R) Commission consider
the proposed public park amenities that were presented at the December 1, 2020
meeting.
FUNDING REQUIREMENTS:
No City funding required. The proposed public park will be developed and maintained by
the applicant.
BACKGROUND:
On December 1, 2020, the PB&R Commission reviewed the proposed public park and
found the proposed amenities to be practical, useable and appropriate for the general
public. The PB&R Commission recommends approval and acceptance of the proposed
park to the City Council. The staff report, draft minutes of the meeting and an updated
park plans including the recommended changes from the December 1 PB&R Commission
meeting are attached as Attachments A, B and C, respectively.
DISCUSSION
The proposed project including its proposed public park was scheduled for the January
12, 2021 City Council meeting. The project was continued to January 26, 2021 meeting
in order for staff prepare written responses to comments. Among the comments received,
there was an alleged violation of the Brown Act by an individual who was not able to
attend the December PB&R Commission meeting in person and felt that the lack of a call-
in option violated their rights to be involved in the project discussion.

The City Attorney’s Office reviewed and determined that there was no such violation.
However, out of abundance caution this item is being presented again to the Commission
for reconsideration and affirmation of the previous determination.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the Commission considers the item). The property owners within 300 feet
of the project site were noticed.
