TITLE: Confirmation of Appointment to the Housing Element Update
Advisory Committee to Fill an Unscheduled Vacancy
ABSTRACT:
The Housing Element Update Advisory Committee was created pursuant to Resolution
No. 2020-6 to serve as a forum for public participation, to guide a focused update of the
Housing, Land Use and Circulation Elements of the General Plan, and to build upon the
progress already established by the General Plan Update Steering Committee.
Due to the resignation of Ed Selich, an unscheduled vacancy was created.
RECOMMENDATION:
a) Determine that the action is exempt from the California Environmental Quality Act
(CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines
because it will not result in a physical change to the environment, directly or indirectly;
and
b) Confirm Michelle Thrakulchavee as Mayor Brad Avery's appointment to the Housing
Element Update Advisory Committee.
DISCUSSION:
On January 14, 2020, the City Council adopted Resolution No. 2020-6 which dissolved
the General Plan Update Steering Committee and established the Housing Element
Update Advisory Committee, comprised of a Chair, Vice Chair, and residents of the
community with specific expertise who are appointed by the Mayor and confirmed by the
City Council.
On January 18, 2021, Ed Selich resigned from the Housing Element Update Advisory
Committee, thus creating an unscheduled vacancy for the seat with knowledge and
experience financing unique housing projects other than affordable and/or senior housing
projects.

Pursuant to Resolution No. 2020-6 and City Council Policy A-2 (Boards, Commissions
and Committees), the City Clerk prepared and posted a Notice of Unscheduled Vacancy
on Tuesday, January 26, 2021, in the City Clerk's Office, at the Central Library, on the
bulletin board in the City Council Chambers, and on the City's webpage; and also had the
notice published in the Daily Pilot on Saturday, January 30, 2021. As provided in the
notice, applications were accepted until Saturday, February 6, 2021. The City Clerk's
Office received seven applications.
Mayor Brad Avery appointed himself and Council Member Will O'Neill to the Ad Hoc
Appointments Committee. At the conclusion of the application period, the applications
were forwarded to the Ad Hoc Appointments Committee for review and scheduling of
interviews, which occurred on Thursday, March 18, 2021.
Mayor Brad Avery considered the recommendation of the Ad Hoc Appointments
Committee and is recommending that his appointment to the Housing Element Update
Advisory Committee of Michelle Thrakulchavee be confirmed by the City Council. A copy
of the application is attached hereto as Attachment A.
The Housing Element Update Advisory Committee's term will sunset without further
action upon completion and submittal of a certifiable Housing Element to the California
Department of Housing and Community Development.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
