Dear Ms White:
The above referenced property is currently located within the PC7 (Park Newport
– UP1412, UP1557 Zoning District) and is designated as RM (Multiple Residential)
within the Land Use Element of the General Plan. The property is not located
within a Planned Unit Development or an overlay district. However, the property is
within the Coastal Zone.
The properties abutting the subject parcel to the north, south, east and west are
located in the PC7 (Park Newport – UP1412, UP1557) Zoning Districts and the
General Plan land use designation is RM (Multiple Residential) respectively. The
properties to the north west are located in the PC7 (Park Newport-
UP1412,UP1557) Zoning Districts and the General Plan land use designation is
OS (Open Space). The property located the north is Big Canyon Park and the
Zoning District is OS (Open Space) and the General Plan land use designation is
OS (Open Space).
At the time building permits were finaled, the building requirements were in
substantial conformance with the development standards of the City of Newport
Beach Municipal Code. If the subject property does not comply with the current

regulations, it is nonconforming and is subject to Chapter 20.38 (Nonconforming
Uses and Structures) of the Newport Beach Municipal Code.
The development regulations for the site were established by Use Permit No.
UP1412, which was originally approved December 5, 1968, and amended in
October 18, 1973, by the Newport Beach Planning Commission. Hyperlinked is a
copy of the associated Planning Commission minutes, which list the required
conditions of approval. During the development review plan check process and at
the time the building permits were finaled, the project was determined to be in
compliance with the conditions of approval specified in Use Permit No. UP1412
and the Newport Beach Municipal Code (NBMC). If the subject property does not
comply with the current regulations, it is considered to be nonconforming and is
subject to Chapter 20.38 (Nonconforming Uses and Structures) of the NBMC.
Research of the permit and entitlement history of the property verifies that
discretionary approvals were acquired from the City of Newport Beach Planning
Division for development of the properties:
• Use Permit No. UP1412
Approved by the Planning Commission on December 5, 1968, to allow for
1304 dwelling units and additional ancillary facilities (recreation building,
convenience shopping, etc).
• Use Permit No. UP1608
Conditionally Approved by the Planning Commission on July 6, 1972, to
remove temporary constructions signs, permit the installation and
maintenance of a temporary sign until October 1, 1972, and remove
temporary leasing signs by October 1, 1972.
• Use Permit Amendment UP1412
Approved by the Planning Commission on October 18, 1973, to convert
existing model apartments to transient apartments, install a film shop in the
recreation area, and install an additional tennis court.

The subject property does not have any active complaints on record. For
