Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Patrick Arciniega, Senior Civil Engineer parciniega@newportbeachca.gov PHONE: 949-644-3347 TITLE: Mission Bay Drive Drainage Project — Notice of Completion for Contract No. 7889-1 (21 R03) ABSTRACT: On October 13, 2020, the City Council awarded Contract No. 7889-1 for the Mission Bay Drive Drainage Project to Bunker Construction, Inc. to capture groundwater that was infiltrating the roadway base and consequently damaging the pavement of Mission Bay Drive. The work is now complete and staff requests City Council acceptance and close out of the contract. RECOMMENDATION: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project; b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of Civil Code; and c) Release Faithful Performance Bond one year after acceptance by the City Council. The street no longer has signs of water bubbling through the pavement. The work necessary to complete this contract consisted of setting up traffic control; excavating pipe trench; removing an abandoned irrigation system; controlling groundwater; installing filter fabric, solid and perforated pipe subdrain, and concrete bag cutoffs; backfilling pipe trench with native material over gravel; connecting cleanouts to perforated pipe; connecting area drains, existing slope drains and cleanouts to solid pipe; trimming or removing small interfering trees and landscaping; and other incidental items to complete the work in place as required by the contract documents. The contracted work has now been completed to the satisfaction of the Public Works Department. A summary of the construction cost is as follows: Original Bid Amount: Actual Cost of Bid Items Constructed: Total Change Orders: Final Contract Cost: $143,983.00 $140,343.00 $15,888.67 $156,231.67 During construction, it was determined that more cleanouts, area drains, concrete cutoff walls and burlap bags were needed than originally planned for. In addition, the connection to the catch basin had to be rerouted from the side to the back of the basin. Also, an unknown existing drain line had to be removed. Lastly, additional planting and grading needed to be performed. These project adjustments resulted in contract change orders totaling $15,888.67. With the completion of the project, the final contract cost is approximately 8.5 percent above the original bid amount. A summary of the project schedule is as follows: Estimated Start of Construction per Annual Baseline Schedule November 18, 2020 Actual Start of Construction Per Notice to Proceed November 16, 2020 Extended Contract Completion Date Inclusive of Extra Work March 8, 2021 Actual Substantial Construction Completion Date December 14, 2020 The project was substantially complete on December 14, 2020 with all subdrain improvements completed to the satisfaction of the Public Works Department. Additional contract time was provided to address concerns raised by the Spyglass Hill Community Association regarding the plants and grading. Final pavement restoration work on Mission Bay Drive is proposed to occur in the fall of 2021, as part of a separate pavement repair project that is currently funded in the FY 2021-22 Capital Improvement Program. 5-2 Mission Bay Drive Drainage Project — Notice of Completion for Contract No. 7889-1 (21 R03) April 13, 2021 Page 3 FISCAL IMPACT: Funds for the construction contract were expended from the following Capital Improvement budget accounts: Account Description Contributions (21 R03) General Fund (21 R03) ENVIRONMENTAL REVIEW: Account Number Amount 13501-980000-21 R03 $ 100,000.00 01201927-980000-21 R03 $ 56,231.67 Total: $ 156,231.67 On October 13, 2020, City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15304 (minor alternations in the condition of land, water, and/or vegetation) of the CEQA Guidelines, because this project has no potential to have a significant effect on the environment NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
