NEWPORT BEACH ZONING ADMINISTRATOR MINUTES 100 CIVIC CENTER DRIVE, NEWPORT BEACH ZOOM THURSDAY, MARCH 25, 2021
REGULAR MEETING – 10:00 A.M.
I. CALL TO ORDER – The meeting was called to order at 10:00 a.m. Staff Present (Remote): Jaime Murillo, Zoning Administrator Chelsea Crager, Associate Planner

IV. PUBLIC HEARING ITEMS ITEM NO. 2 Bay Island No. 1, LLC Residence Coastal Development Permit No. CD2020-132 (PA2020-260) Site Location: 1 Bay Island Council District 1
Chelsea Crager, Associate Planner, provided a brief project description stating that the project is a coastal
development permit (CDP) for the demolition of an existing single-family residence and construction of a new single-family residence at 1 Bay Island, including a request for an adjustment to off-street parking requirements
with a parking management plan. Bay Island is a private residential island that is accessible by a pedestrian bridge which also supports golf carts. In 1997, a Planned Residential Development (PRD) overlay was
approved to establish development standards for the island. Currently, residents of Bay Island park vehicles at a parking garage at 501 West Bay Avenue.
The development site is within the RM Coastal Zoning District, which allows for the development of single-
family residences. The CDP is conditioned to continue to provide parking spaces at the 501 West Bay Avenue parking garage, which will serve as the parking management plan. The development fronts the Newport Bay
and is protected by a bulkhead maintained by the Bay Island Association. The project is conditioned for principal structures to be waterproofed up to 10.7 feet (NAVD88). Public access is provided at street ends through the Balboa Peninsula. The development may be visible from
public viewing areas and complies with development standards including a maximum height of 29 feet where 33 feet is allowed. The project is conditioned to include a construction management plan.
Zoning Administrator Murillo asked Associate Planner Crager to respond to written correspondence from Mr. Jim Mosher. Ms. Crager noted that the parking management plan consists of the offsite parking provided at 501 West Bay Avenue. The PRD was not adopted into Newport Beach Municipal Code (NBMC) Title 21;
therefore, the site is regulated also by RM Coastal Zoning District standards. The development standards table in the staff report incorrectly states that the proposed height of the new development is 33 feet; the proposed
maximum height is 29 feet. Typographical errors in the resolution can be corrected. Applicant Tyler Wilson, on behalf of the Owner, stated that he had reviewed the draft resolution and agrees with all of the required conditions.

The Zoning Administrator opened the public hearing. One member of the public, Jim Mosher, spoke and stated that he appreciated staff’s response to his written comments. He stated that the resolution mentioned public access at street ends; however, access is also
provided along Edgewater Avenue. The Zoning Administrator closed the public hearing. The Zoning Administrator incorporated Mr. Mosher’s corrections to the resolution. He also moved Fact 3 in support of Finding B to Fact 9 in support of Finding A. Fact 2 in support of Finding B is also updated to include
lateral access along the beach front and the park adjacent to the Bay Island Bridge. Action: Approved as amended

None. VI. ADJOURNMENT The hearing was adjourned at 10:14 a.m.
The agenda for the Zoning Administrator Hearing was posted on March 18, 2021, at 5:10. p.m. on the digital display board located inside the vestibule of the Council Chambers at 100 Civic Center Drive and on the City’s website on March 18, 2021, at 5:00 p.m.
