EXECUTE SERVICE AGREEMENT WITH HARBOR
TOWING AS AN OFFICIAL POLICE TOW
TRUCK OPERATOR.
BACKGROUND: Section 5.15 of the Municipal code requires the
City Council to designate two official Police tow truck services
within the City. The official Police tow truck services are
on-call, on a weekly rotational basis, for any Police emergency
situation where a tow truck is required. Service agreements
between the tow truck services and the City.:are executed for a
two-year period, with one agreement expiring each year. The
current agreement with Harbor Towing expired February 7, 1980.
The initial deadline for bids was December 27,1985,with no
complete bids recieved. The City Clerk was authorized to re -
advertise for bids and reschedule the Public Hearing for February
24, 1986.
Complete bids were recieved from Newport Center Towing ar.d
Harbor Towing prior to the closing date of January 29,1986.
Police Department inspections of both companies indicate both
comply with the Municipal Code for Official Police Toy;. Harbor
Towing is recommended over Newport Center Towing for the following
reasons:
1) Harbor Towing has two more tow trucks, one
with a four ton greater capacity than those
of Newport Center Towing.
2) Harbor Towing is less than hall the distance
that Newport Center Towing is from the Peninsula,
where approximately seventy-five percent of
Police tows occur.
3) Harbor Towing has -a fifteen year proven pi:�r-
fo-rmance record with our police department.

SUBJECT: INSPECTION OF NEWPORT CENTER TOWING

On Friday, January 24, 1986, I made an inspection of the vehicles and facility at
Newport Center Towing. The location of the company is 16372 Construction Circle
East #5, Irvine, 92700. This inspection was requested by Glen EVERROAD of the
City's Finance Department. Newport Center Towing has requested to be considered
for an Official Police Towing position for this city.
An inspection of the facility was conducted. The location consists of a small ..
two room office with an adjoining garage. The front office has a Automobile Club
computer/teletype, as well as a two-way radio dispatch console. On the front of
the office windows is the company name, telephone number, and "normal" business
hours. The business hours listed are from 0700 to 1900, Monday thru Friday, closed
Saturday and Sunday.
she attached garage area is large enough to hold at least two vehicles. It appeared
that the garage area is utilized as a repair shop for minor repairs (battery, hoses,
belts, etc.).
The storage yard is located near the office/garage building. It is actually three
separate storage yards, two of which have a common center fence. All three storage
areas are surrounded by a (6) foot chain length fence. All the yards have lockable
gates. The area is lighted during darkness, and is routinely patroled by Irvine
Security. Total area of the three storage yards is approximately 12,000 square
feet. Vehicle capacity of the yards is approximately 105 motor vehicles, not
including motorcycles. The entire facility is less than (8) miles from NBPD.
An inspection of the company's fleet of (5) tow trucks was conducted. I found no
discrepancies or observed no equipment defects on any of the trucks. All trucks
were in good working order and found to be in compliance with this department's
"Report Of Tow Truck Inspection" form. The exterior appearance of the vehicles
can only be described as excellent.
The only negative comments I can make are as follows: The listed business hours
ire not in compliance with the City's Official Police Tow requirements (0700-1900
even days a week). I noticed that there was no public telephone anywhere near the
Facility. This is not required per city policy, but is normally present.at all
Official Police Towing facilities that I have ever inspected or visited.
Despite the aforementioned negative observations, I found the facility and vehicles
of Newport Center Towing to be in compliance with present city policy.

EXHIBIT A
Newport Center Towing, Inc. started in business in 1968 at
the Shell Service Station at 990 East Coast Highway and Jamboree
Rd., Newport Beach, Calif. The 1—isiness was then solely owned
by Mr. Don Brown. Mr. Brown, a.g4. 58, and the President of
Newport Center Towing has been in the service station business
for over 30 years, with locations in Pasadena, Newport Beach and
Laguna Hills.
Mr. Rick Ruffalo, age 34, the Vice President and manager of
Newport Center Towing started working for Mr. Brown in August of
1969. After spending 2 years in the U.S. Navy, he returned to
Mr. Brown's employ and soon became the manager of Newport Center
Shell. In 1978 he was successful in securing a contract with
the Auto Club in Newport Beach and the company has had that
contract renewed for 7 consecutive years. In 1983 Newport
Center Towing was incorporated as a California Corporation, and
now has a valid City of Irvine Business Permit (43582), in
addition to its Newport Beach Business License permit (04228).
In addition to its contract with the Auto Club, Newport
Center Towing also entered into a contract to tow for the City
of Irvine.
Newport Center Towing has a total of 7 employees with
drivers living in Irvine, Costa Mesa, and Santa Ana, which
provides excellent coverage for the City of Newport Beach.

EXHIBIT B
Newport Center Towing, Inc. has a 1,400 square foot office
building with 3 adjacent 4,000 square foot storage yards at
16372 Construction Circle East in Irvine, Calif. 92714. The 3
storage yards are level and each has a storage capacity of 35
vehicles which provides a total storage capacity of 105
vehicles. The storage lots are secured by 6 foot high chain
link fencing and are lighted at night.
The 1,400 square foot building has an inside storage
capacity of 6 vehicles. Additionally, there is sufficient
automotive repair parts, stock and equipment for qualification
as a Licensed Certified Repair Facility.

Newport Center Towing utilizes the services of George L.
Brown of Laguna Niguel for its insurance needs. They presently
have 3 major policies which are:

Empire Fire and Marine Insurance Company

This policy is a Garage Keepers Liability policy with
$500,000.00 limits. (see attached).
2. Policy #BAP A 12-44-5
Century -National Insurance Company
12200 Sylvan Street, North Hollywood, CA 91606
This policy covers the vehicles owned by Newport Center
Towing and has liability limits of $600,000.00 and
$60,000.00 for uninsured motorists. (see attached).
3. Policy #CU -2255
S & H Insurance Policy
180 South Lake Avenue, Pasadena, CA 91101
This is a commercial umbrella policy with policy limits
of $1,000,000.00. (see attached).
Mr. Ruffalo advises Newport Center Towing that he foresees
no problem areas in meeting the terms of Newport's Tow Agreement.
The limits can be changed several ways for total compliance and
the City of Newport Beach can be named as an additional named
insured.

Sir:
On Tuesday, December 31, 1985, I inspected the vehicles and facility at
Harbor Towing.' The location of the facility is 964 W. 17th Street, Costa
Mesa.
I inspected (7) tow trucks and found all to be in compliance with city
and department requirements. The company also provides a motorcycle trailer
capable of towing (2) motorcycles in an upright position.
I also inspected the facility and noted no discrepancies in regards to
city requirements.
