HomeMy WebLinkAbout2021-32 - REPEALED: Repealing City Council Resolution No. 8195 and Designating Portions of 30th Street and 31st Street in Cannery Village as Two-Way StreetsRESOLUTION NO. 2021-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, REPEALING CITY COUNCIL RESOLUTION NO. 8195 AND DESIGNATING PORTIONS OF 30TH STREET AND 31ST STREET IN CANNERY VILLAGE AS TWO-WAY STREETS WHEREAS, Section 12.52.010 (Placement of Appropriate Signs) of the Newport Beach Municipal Code ("NBMC") directs the City Traffic Engineer to place and maintain signs giving notice of any street or alley designated one-way by the NBMC, ordinance or resolution; WHEREAS, on February 11, 1974, the City Council approved Resolution No. 8195 designating portions of 31St Street and 30th Street in the Cannery Village. area as one-way streets; and WHEREAS, a review of new traffic data indicates that a change in street designation would facilitate the overall flow of traffic in the Cannery Village area. NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows: Section 1: The City Council does hereby repeal Resolution No. 8195 and designates 30th Street between Lafayette Avenue and Villa Way, and 31St Street between Lafayette Avenue and Villa Way as two-way streets. Section 2: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the adoption of this resolution is exempt from environmental review under the California Environmental Quality Act ("CEQA") pursuant Resolution No. 2021-32 Page 2 of 2 to Section 15301 of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because the project involves a negligible change in traffic circulation. Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
