Dear Rober I am enclosing copies of resolutions and notices as requested through Bill Weybright of this firm. ( Document No. 1 is a resolution showing that the Planning Commission adopted the Master Plans and is recommending them for adoption by the City Council . They should have 8.dopted a resolution similar to this at the time of their adoption of the Master Plan. Document No. 2 is a resolution for enact- ment by the City Council, indicating that they are in receipt of a recommended plan by the Planning' Commission and that they will hold a hearing thereon. Document No. 3 is a recommended notice of such hearing. Document No. 4 is the resolution for enact- ment by the City Council, adopting the Master Plans. As indicated above, we recommend that the Council adopt the plan by resolution; in a few rare cases we have recommended that this be done by ordinance, but we do not feel that this is applicable in your city. Based on our last discussion. I assume that you are prepared to undertake the preciae plan revisions suggested. The Parks, Beaches and Recreation Commission has re- viewed the precise plans for the several areas which you presented and finds most of them satisfactory; however, they would like revised precise plans for Balboa Pier Park and 19th and Dover in accordance with the changes discussed with• Mr.. Weybright during his last visit to this office. These include: A. Balboa Park: 1. 'The area on the a-esterly 'ond of 'the Hark should be developed for beautification and• a quiet area With a shelter. The existing fire ring area should be retained. 2. The existing parking area should be landscaped at the end of rows as indicated. 3. All active play areas will be concentrated at the easterly end of the area. This includes the addition of a baseball diamond, multi«purpose play field, children's play area, tennis courts, and the retention of an existing parking area for use as a hard-surface play apace. B. 19th and Dover: 1. A baseball field should be added$, overlapping the school, ground. An agreement with school officials permits the ball field to extend approximately 150' on school property. 2, ' The play area should be relocated adjacent to Dover Drive. Page •2- The Commission feels that the plans for Channel Place Park, Bayside Drive Park, and the Corona del Mar State and City Beach need no further revision by your office. In lieu of this, they request that a precise plan for Cliff Drive Park be pre- sented as originally discussed. At the present time a topographic map is available for only a portion of the area; however, a complete map should be completed within a few weeks, and it will be forwarded to your office, along with the Commission's aug- geated plans for the development of the area. August 22, 1957 JUSTIN FREDRIC BARBER JR- Mr. Robert Shelton, City Manager City of Newport Beach City Hall Newport Beach, California Dear Bob: In reply to your letter dated August 20, we definitely did discuss the park and recreation precise plans and you commented that it was too bad that this item was included in the contract, Also, Mr. Webb did not supply this firm with the necessary base maps to produce the Master Plan.. We waited for these and they never came so we drew up our own base maps from subdivision plats from Mr. Webb 'p office. .I listened to the Recreation Commission's suggestions on the morning of August 16. I reported to you, Mr. Drawdy and Mr'. Longmoor that nothing we could draw up would satisfy them even if we chose to act as their draftsman because their ideas had not jelled. Mr. Drawdy, Mr. Longmoor and yourself then agreed that in consideration for the base maps which we had had to pre- pare we would be relieved of the precise park planning. We have also stated we will attend additional meetings without special compensation as outlined. Furthermore, we spent over $1400 to produce a very outstanding format for your Master Plan. We could have produced it at a lesser, price - somewhere around $200. In consideration of the foregoing statements, we do not intend to prepare any further precise planning for the Park and Recreation groups; however, we will , still revise the Master Park Plan and Table for clarification. I shall attempt to answer your letter of August 22nd. I am amazed at your interpretation and conclusions of our conference relative to your performance under the contract which Mr. Wise made with our city council. In the first instance, I, or either or both of the commissions do not have any authority to change the provisions of that con- tract. The only purpose of our conference was to ascertain what further work you propose to perform under the contract so that the City Administration and Commissions involved could plan their considerations b.B the Yrocommendations which you have pro- posed. The interpretations of our discussions as expressed in your letter of August 22nd are all wrong. The only exclusion from your contract performance in our conference was that we felt the contract did notr `quire you to make district maps covering new subdivisions. take particu- lar note of your statement wherein you produced an outstanding format at a cost of $1,400.00 which could have been produced for approximately $200.00. Nobody connected with the City of Newport Beach specified that such an expensive format should be prepared for consideratioIof the Commissionlinvolved. Page 2 to Mr. Barber, after consultation with our people involved withlour work, it is our considered conclusions that we do not desire to have further dealings with you personally or by correspondence relative to your firms ' performance under the contract. On the other hand, Mr. Wise, made the contract with our City Council. He knows the scope of work which the contract intended to cover. If Mr. Wise has the time to give his per- sonal attention to complete the contract satisfactorily and guide our commissions through the necessary procee(Ungs to com- plete an acceptable master plan, we shall appreciate it. If this is not possible; we would prefer to declare that your performance under the contract is unsatisfactory and re- quest the Commissions involved to prepare their own reccommen- dations for a master plan. It is not my recol- lection that we established a clear relation between these two features of the contract, concluding that they cancelled each other out. Mr. Webb facts strongly that the City met its oblipatioa under the contract to provide base maps and other partiwnt data* Mr. Gingrich reports that he and his Comaiasion were left with the im- pression that yen intended to make revisions to at least am* of the precise park plans heretofore submitted. The balance of the atipulations in your letter appear to reflect our uadersteuding. Perhaps any confusion could be cleared up if you would advise as to what further work, if any, you in- dicated to the Parks, Beaches and Rocroation Commission you were willing to do on the precise plans, or we can talk it over next ties you or harry are here. (2) We will prepare a revised map and chart of the park and recreation plan which will be easier to interpret. It is my understanding that we are obligated to submit recommendations for the follow- ing units of the Master Plan: 1 . The Land Use Plan 2. The Street and Highway Plan 3. The Recreation Plan and as special projects to do, the following: 1 . Make special studies on the Pacific Electric Right- of-Way regarding possible development . 2. Prepare recommendations for revisions to the Zoning Ordinance . 3. Prepare precise plan for three or four specific recreation sites as requested by the Recreation Commission (as a part of the Recreation Plan) .. We also agreed to furnish consulting service to the Planning. Commission and Council as we had in the past, but with- out additional charge . I requested Len Knittel to arrange his field trips to coincide with Planning Commission Meeting dates, so that he could attend Planning Commission Meetings and be more helpful in their current problems . While this took more of his time than I anticipated, I think that it has been helpful to the Planning Commission and has aided Len in understanding the problems of the city. Therefore, I wish to continue this pattern. The contract stipulated that the City furnish up-to-date base maps needed to carry out our work. The maps were not available, so in the interests of keeping on schedule we drafted property line and street line maps at 1" - 500 feet . We had not discussed rewriting the subdivision ordinance, nor is it included in our agreement with the City. Therefore, I feel that it would be an extra item. As to the Citizens' Capital Improvement Committee, we wish to cooperate in any way we can to assist the committee and furnish basic data. I have told Len that he could meet with them if he can arrange night meetings that fit into his schedule while at Newport Beach - otherwise, I feel that meetings at other times should be on a per diem basis . I think that if you refer to our letter of April 2, 1956, written to the Council, you will get a brief and clear picture of what was the intent of our agreement. Dear Bob : - I have noted your comments concerning the effectiveness of the present Zoning Ordinance in eliminating non-conforming uses . As you stated, such uses are now removed only when they cease for a six month period. It is also true that a change in ownership does not nulify a non-conforming use, and such a control cannot be legally accomplished. The best control available to tighten the laws eliminating the non-conforming uses is to set up an authority to cause the amortization of non-conforming buildings by establishing a time schedule of amortization for each such building. Leonard Knittel will discuss this with you at the next scheduled planning meeting. If the above procedure is established, I would say we are doing almost all that we can to hasten the elimination of such uses. Additional items such as a section "Non-Conforming Use of Land"; changing Section 9105 .7 (f) by reducing percent of area destroyed can also be included to give better control . We were pleased to hear the news about the possibility of securing the acreage under consideration for a park and school site near the Harbor Highlands area at a figure of $2500.00 per acre. The Board authorized me to inform you that it wishes to secure not less than ten acres which will include the acreage necessary for the streets adjoining the part of the property to be purchased by the school. There was some discussion of the possibility of increasing that to ten acres net if that would work out better as our plans develop but, the official action specified ten acres gross. I have been accumulating a few and we wish to ask your advice on the following questions, namely: First, under the provisions of the zoning ordinanc6 No. 635 there are three methods of instituting amendments; by petition of the property owner, resolution of intention by the city council, and resolution of intention by the Planning Commission. Now the question in my mind is do all proposed amendments and all applications for variance under the zoning ordinance have to be referred to the Planning Commission for study and recommendation, or may the city council institute amendments, hold their own hearings, make the amendments and grant the vaxia.nce without referring them to the Planning Commission for recommendation. Second, when any amendment is proposed by any one of the throe methods of initiating an amendment and the Planning Commission holds hearings thereon in accordance with the ordinance, may the Planning Commission make recommendations on the amendment to the city council other than the exact provisions contained in the petition or resolution of intention? In other words, is the Planning Commission confined to either denying or favorably recommending the amendment as petitioned or may the Planning Commission after studying the data preseAted during the hearings and its investigation therein make recommendations to the City Council on a different basis than contained in the petition of resolution of intention. How much latitude does the Plannin;; Commission have in considering any amendment as to the recommendations it may desire to make on the proposed amendment. Also how much latitude has the Planning Commission in making recommendations on variances applied for, we have a, case in -2- point on a proposed amendment and that is in regard to the All American Marl:.et on the 101 highway in Corona del Mar. We informally suggested to the owners of the All American property that they apply for a change in the zoning from 01 to C1H on all the property facini; the boulevard. It so happened that there are five lots in this property, but in their application for an amendment to change from 01 to C1H they only applied for the change of zone on lots 1 and 2. The first hearing has been held on this application and the second hearing is coming up at the next meeting. I am under the impression that the Commission will not desire to change lots 1 and 2 to C1H and leave lots 3, 4 and 5 as purely cl. After the second .hearing is held does the Planning Commission have the right if it so desires to recommend to the city council that the 5 lots 1, 2, 3, 14 and 5 be rezoned as c1H2 Third, does the city council have the authority to issue use permits under the zoning ordinance No. 635 without any action thereon by the Planning Commission. It is my interpretation of the ordinance that the city council does not have nay right to issue use permits nor have any access to the vehicle of use permits except in the case of an appeal on the action of the Planning Commission on an application for a use permit. Fourth, it is anticipated that the Planning Commission will soon be involved in a controversy centering on the use of the Incinerator of the Ward and Harrington Lumber Company on highway 101. You perhaps remember that the City and the lumber company became involved in a law suit over the use of this incinerator. I am informed that the lumber Company lost their suit and the lumber company is now exploring the possibilities of securing approval of the incinerator with possible improvements In the operation of the incinerator to remove the neighborhood objections. The lumber company property is now in 02 zone and the incinerators are prohibited in the ml zone. 1,7111 you please advise us as to what the status of such an incinerator is under the new ordinance and any procedure if any the lumber company may use to secure permission to operate an incinerator on their property. Fifth, we have progressed satisfactorily on the hearings on all the corrections to the ordinance on account of the omission of certain zones on the original maps and the changes desired to take care of the problems on Lido Isle. Our second and last hearings on all these problems come up at our next Planning Commission meeting. 17111 you please advise me whether you are going to prepare the corrected maps or is it your intention to have the local Engineering office prepare and carefully check these maps for the platea to complete all the zoning maps for the new ordinance. We might advise that the Planning Commission passed a resolution of intention to hold hearings on your subdivision ordinance -3- and that the first hearings trill be at our nett meeting. What is the status of your street and highway plans and when do you think you desire us to start proceedings on this project? We hope that all the above problems brill keep you busy for a couple of minutes and will appreciate a full and complete dissertation on all the above points. Would also appreciate it if you would send us two copies of the latest edition of the State Planning Act. Have a feeling that some questions are going to arise wherein we are going to have to refer to the state lair to substantiate our position on some problems that are in the offering. The City Council may initiate action on amendments by adoption of a resolution of intention, but they may NOT adopt any amendment without referring the matter to the Planning Commission for public hearings and recommendations (see sec. 9io6. 52. ) As to a variance, neither the City Council nor the Planning Commission may initiate action to grant a variance and no applicant can by-pass the Planning Commission for variance directly through the City Council. Application must be made to the Planning Commission. (see sec. 9106.33 and .34. ) 2. The Planning Commission has considerable discretion in making; their recommendations after hearings are held on any one of the methods of starting the amendment procedure, for example, (a) The Commission may reduce the area originally petitioned for re-zoning or called for in the resolution of intention, but it may not expand the area. (b) the Commission may modify the petition or resolution, i. e. , the applicant petitions for C-2 the Commission may recommend C-1 if in its opinion that seems proper, however, the Commission could not recommend a 0-2 district if 0-1 was petitioned for without holding hearings on that basis. In the case of the All American Market, the Commission may not expand or enlarge the area to be re-zoned without adopting a ' resolution of intention and holding hearings on all lots involved. 3. The City Council does not have the Authority to grant use permits unless the case is before them on appeal from the action of the Planning Commission, 4. On the incinerator, you have my letter regarding the necessity of amending the Ordinance. 5. On the zoning maps, if I remember correctly, we have already changed the maps by adding the areas formerly omitted. However, the local engineering office had better check to make sure that the proper designations are on those areas. If there is any question I'll fly down the end of this month and double check. Walter Hahn is now in the process of writing the Street and Hit,hway Plan report. He promises to keep at it until, its completion. The new edition of the State Planning Act is not in print as yet. Off4treet Parking Plans for the Cities of Los Gatos, Berkeley, Salinas, Watsonville and Redwood City have been completed. Zonin Zoning studies, including land use studies, zoning ordinances and plans have been completed for the Cities of Napa, Walnut Creek, Benicia, Los Gatos, Rio Vista, Fairfield, Mountain View, Fortuna, Arcata, Soledad, Gonzales, Greenfield, King, Vallejo, South San Francisco, Concord, and such studies are now underway or nearing completion for the Cities of Berkeley and Sonoma. Industrial Surveys Industrial Surveys including site maps, industrial area inventories and hand- books have been prepared for the Crocker Estate, City of Benicia, County of Solano, Oakland Chamber of Commerce and County of Humboldt. Subdivision Control Ordinances for controlling subdivision development have been prepared for the Cities of King, Mountain View, and Concord, and for Marin, Sonoma, Humboldt, and Monterey Counties. Subdivision and Commercial Center Design Plans and studies for subdivisions and commercial centers have been pre- pared for the Land Development Corporation, San Francisco; Salinas Valley Engineering Company, Salinas; D. J. Jordan and Associates, Vallejo; Rancho Benicia Company, Vista; Solano Builders, Vallejo; J. M. Maddux, Santa Rosa; and plans are now underway for two subdivisions at Vallejo for C. C. DeVore and Associates, and for Charles Custock. Miscellaneous Special studies and reports covering land use, zoning, community development and economics have been completed for the Bay Farm Island Company,, Stoneson Brothers, Lang Realty Company and Standard Oil Company. Swimming pool site plans have been prepared for Rio Vista and Benicia, and a Civic Center site plan has been completed for the City of,Rio Vista. A special study was made and a report prepared for the Benicia Military Affairs Committee relative to Benicia as a site for a General Distribution Depot for the United States Army. Hahn, Campbell and Associates have developed an effective organization to render community planning service on a practical and economical basis.
