The project violates the Newport Beach General Plan Natural Resources Element Goal NR 10 which is: “Protection of sensitive and rare terrestrial and marine resources from urban development” The site is currently undeveloped, but proposed to eliminate a rare plant species, the Southern Tarplant. The Southern Tarplant is listed as a “rare and endangered plant in California and elsewhere” and “seriously endangered in California” by the California Native Plant Society. All of the plants constituting California Rare Plant Rank 1B (such as the Southern Tarplant) meet the definitions of the California Endangered Species Act of the California Department of Fish and Game Code, and are eligible for state listing. This project clearly violates the General Plan goal above of protecting these rare and endangered plants. The project also violates the General Plan Policy NR 10.4 which states: “New Development Siting and Design require that the siting and design of new development, including landscaping and public access, protect sensitive or rare resources against any significant disruption of habitat values. (lmp 2.1)” The project made no effort to avoid these endangered plants. It is not in the City’s benefit to violate its own General Plan Goals and policies and allow these seriously endangered plants onsite to be destroyed by a bunch of million-dollar condo.
