Those fees are calculated or negotiated. When Used: NBMC requires we negotiate a DA when there is a legislative amendment (General Plan amendment) and 50 + residential units 12 of 16 ➢ We will continue with DAs, BUT ➢ Once the General Plan is updated with all the housing units plus any other type of necessary uses, there will be less opportunity for the City to require a Development Agreement 13 r ➢ What are Development Impact Fees? • One-time charges on new development for impacted facilities • Authorized by the Mitigation Fee Act (Gov. Code 66000) ➢ Who Pays? • Project developer pays for impact(s) caused by new development ➢ How is Fee Established? • Calculated according to "Nexus Study" — documents a reasonable relationship between new development and associated impacts -low is Fee Revenue Used? • Used to fund capital projects or facilities (not maintenance or operations) • Cannot be used to address existing deficiencies 14 Would the Council like to study a Development Impact Fee program? • A consultant that has expertise in this area would be hired • The cost of a consultant is approximately $13,000 per fee impact 2. What impacts would the City Council like to study? • Library, Police, Fire, Water, Sewer, Recreation, Affordable Housing 3. Any specific development would the City Council like to include? • ADUs, Single Family, Multi -Family, Office, Retail, Industrial 4.
