Re: City of Newport Beach Local Coastal Plan Amendment, LCPA-5-NPB-21-0036-
1, Parts A - D
Dear Mr. Murillo,
On April 29, 2021, the Commission received the above-cited Local Coastal Program
(LCP) Amendment request and issued it No. LCPA-5-NPB-21-0036-1, Parts A-D.
Part A -Residential Design Standards, a request to revise the IP definition of Gross
Floor Area and clarify the applicability of Open Space standards, staff determines to be
a De Minimis LCP Amendment. Part B -Elimination of Amortization Period for
Nonconforming Signs, a request to amend both the IP and LUP to eliminate the
amortization deadline, staff also determines to be De Minimis. Part C -Short Term
Lodging on Newport Island, a request to modify LCPA-5-NPB-20-0070-3-Part A, staff
determines to be a Major Amendment. Part D -Transfer of Development Rights, a
request to resubmit LCP Amendment LC2019-003 to incorporate regulations authorizing
the Transfer of Development Rights within the coastal zone, staff determines to be a
Major Amendment.
After staff review of all the transmitted documents for consistency with the LCP
Amendment submittal requirements of Section 13551-13533, Title 14 of the California
Code of Regulations, we have determined that the submittal of the LCP amendment
request cannot be deemed officially "submitted" until the following information is
submitted to, and received by, the Commission's South Coast Distric~ Office in Long
Beach:
1) Mailing List of Known Interested Parties. Please provide a mailing list (USPS
mailing address or electronic e-mail address) of individuals, local governments,
and/or organizations who are known interested parties, including, but not limited
to, parties who submitted written or verbal comments either prior to or during the
noticed public hearings for Part A, Part B, Part C and Part D LCP amendment
requests at the local government level.
Once the mailing list of known interested parties for Part A and Part B of this LCP
Amendment are received, the proposed amendments shall be deemed
complete/submitted and noticed in the agenda of the next regularly scheduled

meeting of the Commission. If three or more members of the Commission do not
object to the de minimis determination, the de minimis LCP amendments shall
become part of the certified LCP 10 days after the date of the Commission
meeting.
2) Additional Information Regarding Part C-Short-Term Lodging on Newport
Island. The proposed amendment (LC2020-008) related to Short-Term Lodging
on Newport Island includes a provision requiring each short-term lodging unit on
Newport Island provide a minimum of one parking space in a garage or carport.
The same amendment also requires a short-term lodging unit to be owner-
occupied and managed. Please clarify whether the proposed minimum one
parking space requirement applies for the short-term renter only. Is this in
addition to the underlying parking requirement for the subject single-family
residence and/or duplex on the lot? Is there to be a different parking requirement
for the owner-occupant?
3) Revised Resolution of the City Council Authorizing Submittal of LCP
Amendment Related to the Transfer of Development Rights. The proposed
request to resubmit LCP Amendment No. LC2019-003 requires a new resolution
from the City Council of Newport Beach authorizing the revised re-submittal.
The old City Council Resolution 2019-90 unfortunately does not
include/incorporate the changes that the City is agreeable to in this new
resubmittal. A new City Resolution with an Exhibit "A" that identifies the
language of the currently proposed amendment (e.g., including previous
suggested modifications) is thus required.
As the proposed resubmittal would incorporate previous Coastal Commission
suggested modifications, staff could recommend approval as submitted with no
additional suggested modifications necessary within the 60-day period after the
submittal is deemed complete.
Once the requested information is received, staff will review and determine whether
each individual Part of the LCP amendment request is complete. A public hearing on
each matter will be scheduled before the Commission. Thank you for your attention to
