HARRJSON ~ AR_CHITECT January 30, 2017 COASTAL DEVELOPMENT PERMIT APPLICATION APPLICANT: Kevin Moriarty 2782 Bay Shores Drive Newport Beach, CA 92663 LOCATION: 2772 Bay Shore Drive, Newport Beach PROPOSED DEVELOPMENT: Demolition of a two-story single-family residence and garage, and construction of a two-story, 29-foot high single-family residence of approximately 2,523 square feet, with an attached 469 square foot two-car garage. The proposed project also includes 280 cubic yards of grading over-excavation for compaction and drainage. All storm water and run off from non-permeable surfaces will be collected and directed toward landscaped and permeable areas or an underground drainage system. All landscaping will be non-invasive and consist of primarily drought tolerant plants species. No work is proposed on the dock. APPROVAL RATIONALE: The project site is located on a developed 4,000 square foot lot in the Bay Shore Community fronting the Newport Harbor in an established neighborhood of Newport Beach, Orange County. The subject site is located between the first public road, Coast Highway, and Newport Bay because the subject site is located in the locked gate community of Bay Shore. No public access currently exists through the site. However, the project will have no impacts on existing coastal access. Public access to the harbor exists upcoast adjacent to the Bay Shore Community at the Balboa Bay Club. The Applicant received an Approval-in-Concept from the City of Newport Beach on September 26, 2016. A letter has been submitted by William Simpson and Associates which states that the bulkhead will last for the life of the development once the proposed replacement of tiebacks and dead men is performed. The site is designated as R-1, residential land use by the City of Newport Beach and the proposed development is consistent with the zoning. The proposed project will comply with all setback and height requirements. Law water need and non-invasive landscape palette will be used to minimize the need for irrigation. The proposed development will not adversely impact coastal resources, public recreation opportunities, and is consistent with past Commission actions in the area. 3535 EAST COAST 1-liGI-IW AY, #301 -CORONA DEL MAR., CALIFORNIA 92625 -949 I 723-1091 PA2017-019 PROJECT: Moriarty Residence 2772 Bay Shore Drive Newport Beach, California In response to the increased need to address water quality and drainage issues, the following mitigation measures will be incorporated during and after construction. During the grading of the site the grading contractor is directed to leave a depression at the rear of the site a minimum of six inches below the natural grade to collect any water run off during construction. In addition, sand bags are require at the property lines, to assure water is diverted to this depressed area so no water drains into the street or boardwalk. The drainage system is designed to retain concentrated and surface sheet flow water from dry-weather run-off and minor rain events within the site. Run-off water will sheet flow toward planters. Surface area drains and downspouts are directed to an underground drainage system, which drains toward the rear of the lot. The last 15 feet of this drainline is perforated and encased in gravel so that water collected will be absorbed into the sandy sub-grade before it can go out to the street or alley. The drainage at the rear of the lot is directed over a french drain prior to draining toward the street. The STATE REGIONAL WATER QUALITY CONTROL BOARD's Water Quality Best Management Practices are incorporated into the Plans Low water need and non-invasive landscape palette will be used to minimize the need for irrigation. SECTION IV. REQUIRED ATTACHMENTS The following items must be submitted with this form as part of the application. 1. Proof of the applicant's legal interest in the property. A copy of any of the following will be acceptable: current tax bill, recorded deed, lease, easement, or current policy of title insurance. Preliminary title reports will not be accepted for this purpose. Documentation reflecting intent to purchase such as a signed Offer to Purchase along with a receipt of deposit or signed final escrow document is also acceptable, but in such a case, issuance of the permit may be contingent on submission of evidence satisfactory to the Executive Director that the sale has been completed. The identity of all persons or entities which have an ownership interest in the property superior to that of the applicant must be provided. 2. Assessor's parcel map(s) showing the page number, the applicant's property, and all other properties within 100 feet (excluding roads) of the property lines of the project site. (Available from the County Assessor.) 3. Copies of required local approvals for the proposed project, including zoning variances, use permits, etc., as noted on Local Agency Review Form, Appendix B. Appendix B must be completed and signed by the local government in whose jurisdiction the project site is located. 4. Stamped envelopes addressed to each property owner and occupant of property situated within 100 feet of the property lines of the project site (excluding roads), along with a list containing the names, addresses and assessor's parcel numbers of same. The envelopes must be plain (i.e., no return address), and regular business size (9 1/2" x 4 1/8"). Include first class postage on each one. Metered postage is not acceptable. Use Appendix C, attached, for the listing of names and addresses. Verification of all other permits, permissions or approvals applied for or granted by public agencies such as: • Department of Fish and Game • State Lands Commission • Army Corps of Engineers • U.S. Coast Guard For projects such as seawalls located on or near state tidelands or public trust lands, the Coastal Commission must have a written determination from the State Lands Commission whether the project would encroach onto such lands and, if so, whether the State Lands Commission has approved such encroachment. See memo to "Applicants for shorefront development" dated December 13, 1993. 11. For development on a bluff face, bluff top, or in any area of high geologic risk, a comprehensive, site- specific geology and soils report (including maps) prepared in accordance with the Coastal Commission's Interpretive Guidelines. Copies of the guidelines are available from the District Office. SECTION V. NOTICE TO APPLICANTS Under certain circumstances, additional material may be required prior to issuance of a coastal development permit. SECTION VI. COMMUNICATION WITH COMMISSIONERS D Yes D No Decisions of the Coastal Commission must be made on the basis of information available to all commissioners and the publ'lc. Therefore, permit applicants and interested parties and their representatives are advised not to discuss with commissioners any matters relating to a permit outside the public hearing. Such contacts may jeopardize the fairness of the hearing and result in invalidation of the Commission's decision by court. Any written material sent to a commissioner should also be sent to the commission office for inclusion in the public record and distribution to other Commissioners. SECTION VII. CERTIFICATION 1.
