SUBJECT: VACATION AND ABANDONMENT OF A PORTION OF A PUBLIC UTILITY
EASEMENT RESERVATION
LOCATION: Westerly of the Bayside Shopping Center over the portion of
Abandoned and Vacated Bayside Drive
RECOMMENDATION:
Adopt a resolution declaring the City's intention to vacate
and abandon a portion of a public utility easement reservation,
and setting April 9, 1973 as the date for the public hearing
concerning the vacation and abandonment.
DISCUSSION:
A portion of old Bayside Drive westerly of the Bayside Shopping
Center was vacated and abandoned by Council actions on May 25, 1970 and
May 8, 1972. A "blanket" public utility easement was reserved over the
right-of-way when it was vacated and abandoned for street purposes.
Since that time, the utilities occupying a portion of the
"blanket" easement have been relocated. This has resulted in a request
from The Irvine Company, the owner of the underlying fee simple interest,
for the City to vacate and abandon the cleared portion of the public utility
easement.
The request seems reasonable and it is recommended that the
vacation and abandonment proceedings be accomplished. There is no apparent
requirement, either present or future, for retention of this portion of the
public utility easement reservation.
A sketch of the portion of the public utility easement to be
vacated and abandoned is attached for reference purposes.

Dear Mr. Devlin:
Tract No. 3660, M.M. 144/9, 10, 11 (copy attached) shows
a " 10' foo$ Vialkway and Storm Drain Easement" across the northeasterly
edge of lot No, 27�. the residence of lessees, Mr. and Mrs. Elmer Wilke,
3007 Setting Sun Drive, Corona del Mar,, (Phone 640-4786). The lot is
located on the northwest rim of Jasmine Creek Canyon, north of the dam
on Harbor View Drive,
The Irvine Co., owner of the land, subject to the ease-
ment, dedicated to the city, has informed us that the Company does not
desire access there, that the easement has never been open to the public;
that it would be hazardous if opened, and that the Company has no ob-
jection to the city vacating the walkway portion of the easement.
Based upon our discussion with you and your staff, it
is understood that the portion of the easement for a walkway was ob-
tained as a potential access when there was a possibility of the
Grant Howald Park being .roved northward,
Now it appears the high Harbor View Dam, Jasmine Creek
development and the very steep canyon walls make this a small box
canyon inappropriate for such use.
Under the circumstances summarized above, it is requested
that the city vacate the walkway portion of the easement. The ease-
ment would then be the same as others in the area; the lessees(IVilkes)

would landscape the area and be relieved of one source of concern,
but realizint that the city would, of course, have to come in as
required by the underground storm drain.
