If permittee maintains broader coverage and/or higher limits than the minimums provided in this Section, the City requires and shall be entitled to the broader coverage and/or higher limits maintained by the permittee. All policies shall be issued by an agent or representative of an insurance company licensed to do business in the State of California, which has one of the three highest or best ratings from the Alfred M. Best company. All insurance policies shall contain an endorsement obligating the insurance company to furnish the Community Development Director with at least thirty {30) days written notice in advance of the cancellation of the policy. I understand the City reserves the right to require a permittee to submit the requisite insurance documents for review at any time. Permittees shall agree to defend, indemnify and hold harmless the City and its employees from and against any and all claims, demands, obligations, damages, actions, causes of action, suits, losses, judgments, fines, penalties, liabilities, costs and expenses (including without limitation, attorney's fees, disbursements and court costs) of every kind and nature whatsoever which may arise from or in any manner relate (directly or indirectly) to the issuance of the emergency temporary use permit. The purpose of this would be to expand Covid friendly entertain opportunities for the local community. The designated lot at the hotel that is being requested is the valet parking, which sits in the NE corner of the property closest to Palisades Tennis Club. (See attached map). The "drive in" would be operated Sunday through Thursday evenings. Events would not start prior to 7pm and would end no later than 10pm. There would be no amplified sound, as it would be directed through the car radios. The lot is a gated lot that would be clear of all vehicles prior to 5pm to allow for load in, is gated for controlled access to the space and is fully open air. Cars would be spaced accordingly to allow for social distancing and staff and patrons alike would be required to wear masks when moving around outside of their vehicle for any reason. Hyatt Regency Newport Beach would offer pre-packaged concessions such as chips, candy bars, popcorn and canned beverages at a "popup" concession stand located in the parking area. The proposed area is 148 spaces. The hotel would move its valet operation to a small adjacent gated lot on the nights of the drive in movie event. The alternate lot has 32 spaces and based on historic information is adequate for Sunday through Thursday evening estimated occupancy. A 27ft X 22ft inflatable screen anchored by½ inch nylon rope to 6-8 k-rails filled with sand would be installed and removed as necessary. A generator would be utilized to power all equipment. All electrical wires would be covered by electrical traffic covers. The projector utilized is 10,000 lumins and is outfitted with a black tarp attached to the back to prevent any light pollution. Parking control would be posted at the 4 way stop sign at the top of the hotel's entrance to ensure traffic flow into the hotel is smooth and does not back up on Jamboree. The max attendance per show would be estimated at 70 cars. The Sunset Strip Presents, LLC has been doing an event similar to this in West Hollywood at the Andaz since late la st summer. Tickets would have to be purchased in advance. They would not be available for sale onsite.
