Home My WebLink About16 - Lower Newport Bay Confined Aquatic Disposal Construction Project — Environmental Impact Report - Public HearingCITY OF NEWPORT BEACH NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that on Tuesday, May 25, 2021, at 4:00 p.m. or soon thereafter as the matter shall be heard, a public hearing will be conducted in the Council Chambers at 100 Civic Center Drive, Newport Beach. The City Council of the City of Newport Beach will consider an application for the construction of a confined aquatic disposal facility and dredging outside the Federal Channels in Lower Newport Harbor (Project). An environmental impact report (EIR) was prepared for the Project. Environmental Impact Report No. ER2021-001 includes Findings of Facts in Support of the EIR, and a Mitigation, Monitoring and Reporting Program. The City Council will consider whether the Project, with mitigation measures, will result in either no project -level impacts or less -than -significant project -level impacts, and there are no significant and unavoidable environmental impacts that would be caused by the Project. Additionally, the City Council will consider finding that there are no long-term environmental goals that would be compromised by the Project. Additionally, the Project will require a Standard Individual Permit, a Coastal Development Permit, a Clean Water Act Section 401 Water Quality Certification and a Surface Lease Agreement from the U.S. Army Corps of Engineers, California Coastal Commission, the Santa Ana Regional Water Quality Control Board and California State Lands, respectively. NOTICE IS HEREBY GIVEN that on Wednesday, April 14, 2021, the Harbor Commission of the City of Newport Beach reviewed the Project and, by a vote of 6-0 (1 abstention), recommended the City Council approve the Project and certify the EIR subject to the Mitigation Monitoring and Reporting Program. In addition, the Harbor Commission formed a subcommittee to address and respond to residents' concerns regarding the Project. All interested parties may appear and present testimony in regard to this Project. If you challenge this Project in court, you may be limited to raising only those issues you raised at the public hearing or in written correspondence delivered to the City at, or prior to, the public hearing. This public hearing may be continued to a specific future meeting date, and if such an action occurs, additional public notice of the continuance will not be provided. SPECIAL NOTICE REGARDING COVID-19 Given the Declaration of a State Emergency and Proclamation of Local Emergency related to COVID-19, we recommend that you submit your questions and comments in writing for City Council consideration by sending them to cityclerk(_)newportbeachca.gov. To give the City Council adequate time to review your questions and comments, please submit your written comments by Monday, May 24, 2021, at 5:00 p.m. In addition, members of the public will have the ability to participate in this meeting telephonically.
