F-13 TO: CITY COUNCIL NOV 28� 1�9�88 l FROM: Public Works Department SUBJECT: APPLICATION OF DONALD ZELLNER TO CONSTRUCT 5 FOOT HIGH MASONRY WALL, STEEL FENCE; PLANTERS UP TO 4 FEET IN HEIGHT; GRADE BEAMS SUPPORTING A DRIVEWAY; AND NON-STANDARD PAVEMENT IN THE SERVICE ROAD, ALL ENCROACHING 12 FEET INTO THE PUBLIC RIGHT-OF-WAY ADJACENT TO 3601 OCEAN BOULEVARD, CORONA DEL MAR (EP 88-314) RECOMMENDATIONS: 1. Approve the application subject to: a. Elimination of the masonry wall and any portion of steel fence crossing the roadway. b. Execution of an agreement for non-standard improvements. c. An Encroachment Permit from the Public Works Department. d. A Building Permit from the Building Department. DISCUSSION: Attached is a set of sketches that accompanied an application to construct a 5 foot high masonry wall, steel fence; planters up to 4 feet in height; grade beams supporting a driveway; and non-standard pavement in the service road, all encroaching 12 feet into the public right-of-way adjacent to 3601 Ocean Boulevard, Corona Del Mar. The location is shown on the attached sketch. Council Policy L-6, "Private Encroachments in the Public Rights -of -Way," requires the prior approval of the City Council for any private encroachment that encroaches more than 1 foot into the public right-of-way, or is over 3 feet in height. The applicant has withdrawn his request for a steel gate across the roadway, preferring to wait until a third house is build at the end of the road- way. The staff recommends denial of any gate, fence or wall crossing the road- way. The recommendation for approval of the planters, grade beams, driveway, and non-standard pavement is based on approvals of similar encroachments in the past. The applicant has also applied for a modification which will permit encroachments into the front setback for a glass roof, and for higher fences in the side setbacks., Benjamin B. I believe that you had indicated that a recommendation of denial of that portion of our request was forthcoming from your office. We still wish to have the entry columns accepted as per the drawings. For the benefit of all concerned, this letter will also acknowledge that any expenses relative to this encroachment, i.e. permits, construction, etc., will be borne by the owner Mr. Donald Zeliner.
