F-11 JAN 2 5 1988 TO: CITY COUNCIL APPROVED FROM: Public Works Department SUBJECT: APPLICATION OF GARY VOSE TO CONSTRUCT NON-STANDARD BRICK PAVEMENT IN THE ALLEYS IN BLOCK 26, EASTSIDE ADDITION TO BALBOA TRACT (CITY BLOCK BOUNDED BY I STREET, J STREET, BALBOA BOULEVARD, AND EAST BAY AVENUE) (EP -88-14) RECOMMENDATION: If desired, approve the application subject to: 1. Execution of an agreement for non-standard improvements, and 2. An encroachment permit from the Public Works Department. DISCUSSION: Mr. Vose, owner of three houses in the subject block, has applied for an encroachment permit to install non-standard brick pavement over portland cement concrete pavement that is to be constructed by the City in both of the alleys in the City block; and to assume the burden of maintaining all of the non-standard improvements abutting property in the block, including property that he does not own. His intention is to produce at a later date substitute agreements from the other owners of property in the block which will relieve him from the burden of maintaining non-standard improvements that do not abut his property. As part of this plan to improve his property, Mr. Vose intends to underground the utilities in the alley. The undergrounding project will be a private undertaking. The location of the non-standard improvements is shown on the attached sketch. Council Policy L-6, "Private Encroachments in Public Rights of Way," provides that the prior approval of the City Council is required for any struc- tural encroachment into the public right of way that exceeds three feet in height or encroaches more than one foot into the public right of way. Recommendation for approval is based on the opinion that the improve- ment will be of general benefit to the neighborhood and will not be a burden on th public. / �2, )44 Benjamin B.
