The donation will be used to cover all costs for purchasing and equipping a passenger van for use by the Police Explorers program. RECOMMENDATION: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Accept a restricted donation in the amount of $49,987.01 for the purchase and upfit of a Ford Transit passenger van for the Police Explorers program and deposit the funds in the Police Equipment Fund Private Donations Account, 75304-561005. DISCUSSION: Replacement of the Explorers' van was planned and budgeted in FY 2019-20 due to the age and condition of the vehicle, in accordance with City Council Policy F-9 — City Vehicle/Equipment Replacement Guidelines. Mr. Dwight Manley, a longtime supporter of the Police Explorers program, offered to donate funds to cover all costs to purchase and equip the new passenger van for the Explorers' use. (Mr. Manley had also donated the van that was decommissioned.) The vehicle replacement was handled through the customary City of Newport Beach (City) procurement process during FY 2020-21, using encumbered funds from FY 2019-20, where it was originally budgeted. FISCAL IMPACT: There is a positive fiscal impact to this item: restoring City funds expended to purchase and outfit the Explorers' van. Funds were allocated from Fund 753 (the Police Equipment Fund) to the Police Department's Rolling Stock expenditure account (75304-911016) and Equipment N.O.C. ("Upfit") expenditure account (75304-911024). Mr. Manley's donation will be used to reimburse Fund 753 for the costs of the vehicle. The adopted budget includes sufficient funding for ongoing fuel and maintenance costs for the vehicle. 8-1 Donation of Police Explorers Program Vehicle July 13, 2021 Page 2 ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item). 8-2
