SUBJECT: Assignment of Balboa Yacht Basin Lease
from the old Irvine Company to the new
Irvine Company
The City has received a request from the new Irvine Company
to consent to the assignment of the Irvine Company's interest .
in the Balboa Yacht Basin lease.
The City of Newport Beach entered into a lease with J. A. Seek,
Carroll B. Beek, Barton Beek and Joseph Allan Beek, Jr. on
January 9, 1950 for, among other things, the operation of the
Balboa Yacht Basin. Thereafter on February 28, 1950 the
Beeks sublet the Balboa Yacht Basin to Hugh W. Haley and
Margaret E. Meisinger, which lease was recorded on March 13,
1950. Thereafter, the City Council by resolution No. 7475
adopted on July 12, 1971 consented to an assignment of said
lease to The Irvine Company, a West Virginia.Corporation.
With the contemplated acquisition of the present Irvine Company,
a West Virginia Corporation, and its merger with Taubman- Allen-
Irvine, Inc., and the formation of a surviving corporation
called The Irvine Company, the purchasers have requested the
City of Newport Beach consent to the assignment of the lease
for the Balboa Yacht Basin. While the assignment may not be
absolutely necessary, counsel for the purchasers.of The
Irvine Company desires the City to formally consent to the
assignment so there can be no question regarding the rights
and duties of the parties under the lease. The purchasers of

The Irvine Company are contemplating entering into a formal
assignment of their rights from the old Irvine Company and
have entered into an agreement to assume all of the duties of
The Irvine Company under the sublease.
The City Council should adopt a resolution authorizing the
consent to sublease should the Council determine that the
assignment is in the best interest of the City.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY Of
NEWPORT BEACH,CHANGING.,THE NAME-OF RUDDER-ROAD-TO
BEACON BAY
WHEREAS, the Planning Commission of.the City has recom-
mended to the City Council'the changing of the name of Rudder Road
in the City of Newport Beach; and
WHEREAS, Section 34051.1 of the Government Code autho-
rizes the legislative body to change the name.of any city:street
by adoption of a resolution; and
WHEREAS, after consideration of said recommendatio.n..it
appears that it would be in the interests of the City and.conveni-w
ent to the public to change the name of Rudder Road its hereinafter
set forth;
NOW, THEREFORE,, BE IT,RESOLVED.by..the City Council of
the City of Newport Beach that the name of that certain street known
as Rudder Road, as.shown.on the drawing designated "Com. # 1,
Beacon Bay Com. Assoc. St, Name ame Change", a copy of which is attacheo
hereto,,, marked Exhibit "A", and by this,reference.incorporated
herein and.- made a part hereof, be changed.to,Beacon Bay,
BE IT FURTHER RESOLVED that the.City Clerk is directed to
forwarda certified copy of this resolution to the Board of Super�
visors of Orange County in accordance with the provisions of
Section 34092 of the Government Code,

REPORT OF: Planning Commission,

SUBJECT: Street Name Change
Rudder Road to Beacon Bay,
Procedure Followed by,the Planning Commission
The Planning Commission received a letter from the Beacon Bay
Community Association requesting that the name Rudder Road be
changed to Beacon Bay. Reports from the Fire, Police, Public
Works and Planning Departments were considered. No public hear-
ing was held:
The Request
The original request-from the Association was to change the name .
of only that portion of Rudder Road between Harbor Island.Road
and the bend in Rudder Road. The Commission indicated to the
petitioner that it would be improper planning practice to con -
sider the proposed name change for only a portion of the subject
street. For this reason additional signatures of the residents
were sought along the balance of Rudder Road: The Planning.Commis-
sion file contains signatures of all but three residents of Rudder
Road consenting to the change.
The purpose of the change,.in the,applicant's words, is for better
identification of the community,and to aid guests and tradespeople
in finding the development.
Findings of the Planning Commission.
1. The Fire, Police,.Public Works and Planning
Departments objected to the - change because of

F c( Approximately 50� of the residents of:Beacon
Street in Newport Heights, when contacted by
the petitioner, objected to any change of
their street name.
:y 3. The majority of the residents along Rudder
Road favor the change.

Recommendation of Planning Commission
The Planning Commission recommends that the City Council adopt,
the necessary resolution to change the name of Rudder Road to
Beacon Bay.
