Based upon conclusions reached after meeting with Mr. Joseph Beek, the prime leaseholder;.and members of a committee from the Beacon Bay Community Association, consisting of James B. Fredericks, President, Joe S. Earhart and John MacNab, consideration of the proposals for lease modification submitted by the Beacon Bay Community Association and the Balboa Yacht Basin; and a study of the excellent Beacon Bay Lease folio prepared by the staff; the Committee would like to make the following recom- mendations: 1. That the Council reject the present proposals. 2. That the Beacon Bay Community Association and Balboa Yacht Basin be informed that the Council considers itself bound by Section 420 of the City Charter in that the lease and extension thereof would be for a longer period than twenty - five years, and that the Council is herewith adopting a policy that any future proposals which may meet with the tentative approval of the Council must be placed on the ballot for the approval of the voters, 3. That the Beacon Bay Committee be instructed to work with the staff to develop a land use study of the area. With respect to the first recommendation, it is obvious from the staff study that neither of the proposals for lease extensions are com- mensurate with the present value of the properties. Concerning the second recommendation, most of the property adjoin- ing the waterfront is held in trust by the City of Newport Beach under tideland grants from the State of California; all of the property can be termed waterfront property, and it is the belief of the Committee that any proposal for the lease of waterfront.property of such long duration should be placed on the ballot under the same policies governing the sale of City -owned waterfront lands. Concerning the third recommendation, the Committee recognizes the fact that the residents of the Beacon Bay residential area have a definite and increasing problem relating to the secondary financing of the lease- hold improvements, and that adherence to the present lease patterns must inevitably result in a downgrading of the area. In an endeavor to effect relief for the leaseholders and to define the responsibilities of the City of Newport Beach under its trust, it is the belief of the Committee that the staff should make a study in depth to determine if the present development of the property is compatibly related to similar and contiguous- properties, and if the present lease and sub -lease commitments are functioning to the greatest benefits of the City of Newport Beach and the present leaseholders. der.. g q, Respectfully submitted, THE BEACON BAY COMMITTEE Councilman Parsons, Chairman Councilman Cook .
