RE: Tentative agreement with the Newport Beach Ocean Lifeguards
Association (NBOLA)
THE FOLLOWING POINTS HAVE BEEN AGREED TO BY THE
NEGOTIATORS FOR THE NBOLA AND THE CITY NEGOTIATORS, AS A
PRODUCT OF THE MEET AND CONFER PROCESS AS REQUIRED BY THE
MEYERS, MILLIAS, AND BROWN ACT. FINAL AGREEMENT IS SUBJECT
TO RATIFICATION BY THE MEMBERS OF THE NEWPORT BEACH CITY
COUNCIL.
1. ECONOMICS
The City and the NBOLA agree to change the City's J-1 Policy
(compensation policy), and incorporate it into the MOU between the City and
the NBOLA. The new compensation policy will set the economic adjustment
at a point which is 50% between the percentage received by the sworn Police
Department employees and the percentage received by the sworn Fire
Department employees:
1. A COLA adjustment of no less than 3% to be effective on
January 1, 1994.
2. Add an additional salary step ("F" step) to the City's merit
pay system effective April 1, 1994.
3. One additional adjustment scheduled to take place on
January 1, 1995, based on the formula described above.
4. Up to three re -openers for the NBOLA on issues of
importance to them, with notice of their intent to exercise this
right by September 1, 1993, and again by September 1, 1994.

Effective July 1, 1993, the City will improve the sun protection program
by increasing the sun care allowance from $75.00/month to $100.00 per •
month.
At a time, during the life of this MOU, selected by NBOLA the City will
provide up to $1,000.00 for the purchase of fitness equipment to be used
off duty for the intended benefit of NBOLA. The actual equipment to
be purchased shall be recommended by NBOLA, and shall require the
final approval of the Marine Department Director.
4. INCOME REPORTING PROCEDURE
The City will work with NBOLA to develop a periodic routine report
which will summarize all annual accounts including, but not
necessarily limited to; deductions, leave balances, savings balances,
and compensation reported to PERS.
5. GRIEVANCE PROCED E: is
NBOLA and the City will work together to establish a written
grievance, which is acceptable to all parties, by December 31,1993.
