December 20,1996 TO: HONORABLE MAYOR AND MEMBERS OF THE FROM: Dennis Danner, Administrative Services Director January 13, 1997 Agenda Item No. 5 JAN t 3 0T SUBJECT: MEMORANDUM OF UNDERSTANDING - NEWPORT BEACH MARINE SAFETY OFFICERS ASSOCIATION DISCUSSION: The current agreement with the Marine Safety Officers Association expired on December 31, 1995. The terms of the agreement were extended through the current time with the mutual consent of the City and the Association while negotiations were going on for a new agreement. It was the City's goal to provide a fair and competitive salary and benefit package to the Association members while reducing certain benefits that would achieve a long term significant cost savings to the City. The Marine Safety . Officers Association was very cooperative and helpful in achieving this goal. The City and the Association reached tentative agreement on a new contract earlier this year. The new agreement will cover the period from January 1, 1996 through December 31, 1997. Following are the significant conditions of this agreement: 1. Compensation Adjustment: A. Effective the first pay period of July, 1996, salaries for unit classifications shall be as follows: Training Coordinator $52,536.00 MSS With EMT 52,536.00 MSS Dive 53,849.00 MSS Boat. 53,849.00 MSS Dive Boat 55,163.00 MS Lieutenant 60,416.00 MS Lieutenant Dive 61,730.00 The above amounts include existing Supervisory pay, Dive pay and EMT . pay. EMT to be a minimum job requirement. Base pay is to be further adjusted by percentage equivalent to that granted to Fire Unit personnel during the term of the agreement. 0 6 B. Effective July 1, 1996 - The City will pick up the full cost (1.75%) of the Employer PERS rate increase for the 1996-97 fiscal year. C.. .Salary Study - The City will have an independent consultant conduct a job audit of Marine Safety classes versus Firefighter to determine if a larger differential is warranted. 2. Revised Salary Schedule: Effective October 1, 1996 two lower salary steps, 10% and 5% below the current starting salary steps, will be added to the salary range for all unit personnel. 3. Flex Leave Accrual Schedule for New Hires: The following flex leave accrual rates would apply for employees hired after October 1,1996: Years of Continuous Service 1 but less than 5 5 but less than 10 10 but less than 15 16 but less than 20 20 and over Accrual per pay period/hrs 4.92 5.53 6.46 7.28 7.93 Days per Year 16.00 18.00 21.00 23.00 26.00 Newly hired employees will not be eligible for flex leave spillover pay. 4. Revised Holiday Schedule: Effective July 1, 1996, one floating holiday shall be eliminated from the holiday accrual schedule. 5. Flex Leave: Effective July 1, 1997 - 8 hours of flex leave per year will be eliminated from each range of the flex leave accrual schedule for current employees. In addition, current employees must use 80 hours of flex leave the previous calendar year before being eligible for spillover pay the subsequent year (40 hours for calendar year 1996 only). ... 9 r 6. Tuition Reimbursement: Effective July 1, 1996, tuition reimbursement shall be capped at $1,000 per employee. 7. Health Insurance Opt Out: Effective October 1, 1996, the City will implement a system whereby employees with proof of alternative medical coverage could opt out of the City plan and receive, in lieu, $200 monthly cash payment. 8. Retiree Medical: Agree to achieve cost containment of retiree medical insurance through meetings of the Medical Advisory Committee. Cap at $400 per month contribution by City and active employees. 9. Buy Back Pay: Buy back of premium flex and vacation time will be at the rate of 109% of base pay for the term of the agreement. 10. Court Standby Pay: 4 hours for every 8 hours on standby, while off duty. 11. Emergency Call Duty Pay: Two hours emergency call -out duty pay in addition to regular shift. Such pay at the rate of 1 ?/2 times the regular hourly rate. 12. Health Insurance Opt Out: Effective October 1, 1996, the City will implement a system whereby employees with proof of alternative medical coverage could opt out of the City plan and receive, in lieu, $200 monthly cash payment. 13. Progressive Discipline and Grievance Procedure: The language in the existing MOU regarding the progressive discipline plan and grievance procedure shall be carried forward in the new MOU. 14. Overtime: Paid time off will be considered hours worked for overtime calculation purposes. ANALYSIS: As stated previously, in entering negotiations this year with the various employee organizations, it was the City's goal to provide a fair and competitive salary and benefit package to the association members while reducing certain benefits that would achieve a long term significant cost savings to the City. The Marine Safety Officers Association was very cooperative and innovative in achieving this goal. RECOMMENDATION: It is recommended that the City Council approve the attached Memorandum of Understanding between the City and the Marine Safety Officers Association which covers the period from January 1, 1996 through December 31, 1997.
