SUBJECT: Tentative agreement with the Newport BeachiPolice Employes
Association (N.B.P.E.A.)
THE FOLLOWING POINTS HAVE BEEN AGREED TO BY THE
NEGOTIATORS FOR THE N.B.P.E.A. AND THE CITY'S NEGOTIATORS.
FINAL AGREEMENT IS SUBJECT TO RATIFICATION BY THE MEMBERS
OF THE N.B.P.E.A. AND THE CITY COUNCIL.
Total compensation increase for sworn personnel of 5.5%, and a total
compensation increase for non -sworn employees of 5.5%, for the
period June 29, 1991 to June ,1991.
2. The city will cap its contribution to employee health care plans at
$400.00 per month.
3. The City agrees to eliminate the one shift waiting period, to gain access
to sick leave banks, for all employees who are verifiably ill.
4. The City agrees to adopt the alternate 9/80 schedule as the standard
work schedule effective 10/1/1991, for all of the classifications
represented by the NBPEA, with the following understandings:
a. The Chief of Police shall have the authority, at his
sole discretion, to require any identified position, section or watch to
forfeit regular days off in any calendar month. Compensation for
forfeited days off shall be compensated at an overtime rate, provided
such an assignment forces the work hours past "80" within a FLSA 7K
work period.
b. Upon implementation of the 9/80 work schedule,
for all represented classes, "duty incentive (DI)" time would be
eliminated. Any "DI" hours which have been accrued will be
converted to flex -leave hours to streamline bookkeeping.
5. The City will submit a written proposal intended to clarify the J-1 Polity
language to all city employee associations, by either the 1st of
September, 1991, or 60 days after the signing of the last M.O.U. (of the
91-92 negotiating season), which ever is later. Following the
submission of the City's proposal, authorized City representatives will
engage in meet and confer dialog with association representatives in an
effort to gain feedback for the City Council as it proceeds toward a 1991
revision of the J-1 Policy. Following the dialog between the
representatives of the City and the associations, the City Council shall
vote to adopt a revised form of the J-1 Policy before the end of the
calendar year.
