As the City Council is aware, the City has been negotiating for a long period of time to
reach an agreement on a Memorandum of Understanding with the City's two Police
Associations. This process has recently included a mediation process with a
representative from the State Mediation Service. The City's management representative
and the representatives of the Newport Beach Police Employees Association and
Newport Beach Police Management Employees Association have recently reached an
agreement on various issues and now, in accordance with the City's Employer/Employee
Relations Resolution, present the agreements to the City Council for your consideration.
As you know, these agreements have undergone extensive discussions between the
parties and their attorneys. This year the parties propose a multi-year agreement which
runs from July 1992 through December 1995. In years past the City and its associations
have adopted MOU's which embody agreements on new items and simply reference all
past understandings. It has been the desire of both parties to prepare a comprehensive
MOU which incorporates understandings on past and present issues, so that only one
document must be relied upon to reflect all agreements or understandings. The desire to
create a comprehensive MOU has become a reality through the hard work of the parties
and their attorneys. The comprehensive MOU's are attached for your information.
The matters covered in the MOU's include:
1. The creation of a new compensation policy, replacing Council Policy J-1, for
these two groups which sets the goal and intent of the City to pay its Police employees at
the average of the top 5 law enforcement agencies in Orange County.
2. The creation of a new single benchmark position for comparative purposes, which
uses salaries, retirement contributions, and health contributions as the items of
comparison with the other agencies.
3. A COLA on 1-1-94 of no less than 3%, the addition of a sixth step in the current
salary schedule for all Police employees effective 4-1-94, and an adjustment on 1-1-95
which will achieve total compensation for Police employees of at least 50% of the
differential between the then total compensation in Newport Beach and the average of the
top five law enforcement agencies in Orange County.
4. A no -strike provision during the term of the agreement and during any period
during which subsequent negotiations are taking place.
5. Adjustment to the Flex Leave Program to reflect the fact that employees now,
work 81 hours in a two-week period under the nine hour shift.
6. Revision to the Master Officer Recognition Program.
7. Resolution of a dispute on the City's meet and confer process in moving to a new
health insurance provider in 1992. The MOU provides that the parties will discuss in the
near term the provider for the 1993-94 period.
8. A re -opener for both parties on the scheduling of personnel in the future. The
City is provided the right to designate a 14 day or 28 day work period pursuant to Section
29 U.S.C. 507(k), which is more commonly known as the "Seven K Exemption" under
the Fair Labor Standards Act. This will allow the City to more carefully regulate the
amount of overtime that is paid to Police employees.
9. Establishes an agreement on the City's layoff policy in anticipation of its possible
use in conjunction with the 1993-94 Budget.
10. Three re -openers for the Associations on issues of importance to them, with notice
of their intent to exercise this right by September 1, 1993.
11. Re -openers for the City and Associations on the following matters to resolve
outstanding issues: Seniority/Specialty Assignments, Court Appearance Pay, Overtime,
Military Leave, Jury Duty Leave, and Bereavement Leave.
Recommendation: The City Council approve and ratify the Memorandums of
Understanding with the Newport Beach Police Employees Association and the Newport
Beach Police Management Employees Association.
