Face-to-face negotiations commenced April 12, 1988, and since that date, the City negotiators and the Professional and Technical Association negotiators have met and conferred in good faith on four occasions in an effort to reach a negotiated agreement. Because of the unique challenges complicating this year's meet -and -confer process, both teams of negotiators maintained regular communications with their govern- ing bodies as they sought an equitable settlement. Attached are copies of the following items: 1. The Newport Beach Professional and Technical employee Association's original letter of demands, dated March 1, 1988. 2. The City's preliminary response to the Prof/Tech demands (presented by the City negotiators orally). 3. The Prof/Tech counter to the City's response (pre- sented by the Prof/Tech negotiators orally). 4. The City's last, best, and final offer. 5. The Professional and Technical Employee Association's response. ACTION: If desired: a.) Provide the City negotiators with additional economic authority and direct both sides to return to the bargaining table in an effort to reach an agreement. 0 -z- 0 DECLARATION OF IMPASSE (continued) OR b.) Mandate the City's last, best, and final offer, and by doing so impose it as the operating labor agreement between the City of Newport Beach and the Newport Beach Professional and Technical Employees Association. Robert Dixon Z i March 1, 1988 00: CITY MANAGER FROM: Newport Beach Professional & Technical Employees Association SUBJECT: COMPENSATION BENEFITS FOR FISCAL YEAR 1988-89 This preliminary recommendation is to expand compensation benefits for positions represented by this Association in the 1988-89 fiscal year. This request references Resolution 7173, Section 13, in the Newport Beach Personnel Manual. I. SALARIES a. Per J-1 Policy. b. Compensation adjustment for employees receiving less than the maximum benefit for major medical coverage. C. A sixth step merit increase after five years at the E step. d. Library personnel to receive equal compensation for working Saturday andlor Sunday. II. BENEFITS a. Add Martin Luther King's birthday to paid holidays. • b. Compensatory overtime to accrue at time -and -a -half rate. C. Holidays within work week to count as time worked for calculating overtime. d. To reduce traffic congestion, establish a flex -time schedule. Departments would be open 6 a.m. to 6 p.m., with core hours from 9 a.m. to 3 p.m. e. Highest one year considered on retirement. f. Consideration of new HMO, pending survey comments from FHP members. g. Establish ceiling deduction on health plan for retired employees. h. Add half-day holiday for Christmas Eve and for New Year's Eve. I. Paid membership to job-related professional organizations. No. Goal is to provide as much service as possible to public. 1 3 Paid membership to job-related professional No. Department heads now budget for such organizations. memberships. 9 9 1988-89 COMPENSATION NEGOTIATIONS PROF TECH MINUTES DATE: 19 MAY 1988 PLACE: CITY COUNCIL CONFERENCE ROOM NEGOTIATORS: AHUNA, ALVIDREZ, LARSEN (NBPTEA) MUNSON, BURKHART, & DIXON (CITY) The meeting opened at 9:00 AM. Manny Alvidrez noted that the Asociation had reviewed the City's offer of no increase which was made on the 12th and that the Association could not accept it. The Association counter proposed orally: 1. City offer should be 6% total compensation. Health costs as yet unknown. 2. Employees will receive merit increases in the form of an annual bonus based on longevity of service after "E" step. 3. Library personnel to receive time and one-half for Sunday work and may choose whether it is paid or comp time. 4. An additional holiday be established to honor Dr. King. 5. Holidays shall be counted as time worked for the purpose of calculating overtime. 6. Comp time will be earned at a time and one-half rate and may be taken in the same week it is earned at the time and one half rate. 7. A flex work schedule will be developed for Prof Teech employees. These items were discussed by all particpants as were other issues relating to surveys, range measurement, and the benchmarking of the Traffic Tech position. Managment negotiators indicated that they did not have the authority to agree to the counter proposal and would have to go back to Council. A range of proposal were discussed to reach settlement but it was determined that the two sides were far apart and that the Council would need to review the counter proposal. The meeting adjourned at 11:30. CITY OF NEWPORT BEACH MEET AND CONFER JUNE 13,1988 MEMORANDUM TO: PROFESSIONAL AND TECHNICAL ASSOCIATION FROM: Management Negotiating Team SUBJECT: CITY'S LAST BEST AND FINAL OFFER THE FOLLOWING IS A SUMMARY OF THE CITY'S LAST BEST AND FINAL OFFER FOR 1988-89 FOR EMPLOYEES REPRESENTED BY THE PROFESSIONAL AND TECHNICAL ASSOCIATION. 1. Continuation of Council Policy J-1. 2. Total compensation increase of 0.62% for period July 2, 1988 to June 30, 1989. 3. For the purpose of calculating overtime, holidays occurring during the regular work week will count as time worked. Floating holidays (employee birthday and Columbus Day off) are excluded from this provision. 4. Acting positions will be compensation after appropriate time served at an increase of 7.5%. For those at "E" - step in their range, the Acting position will be compensated at the higher of either 7.5% or the "A" step of the acting position. 5. During an employee's initial service in a position, the Department Director may on a one-time basis grant a two-step increase for an employee whose performance is exceptional. 6. Health coverage cost for new employees in the indemnity plan will be as follows: Employee plus two: 1st year $120; 2nd year $80, 3rd year $40. Employee plus one: 1st year $60; 2nd year $40, 3rd year $20. New employees enrolled in HMO's will be charged: Employee plus two: 1st year $60; 2nd year $40, 3rd year $20. 7 • 0 Employee plus one: 1st year $30; 2nd year $20, 3rd year $10. 8. City will explore methods for the stabilization of the premium paid by retirees in the City plan for health insurance. 4. City agrees to meet with representatives of the employee groups and a spokesperson for the non -represented to discuss and attempt to formulate a proposal for a consistent leave policy for the City. 10. Librarians will be removed as a benchmark for determining J-1 compensation.
