TITLE: 2020-2021 Playground Improvements Project — Award of Contract
No. 7934-1
The current City of Newport Beach (City) Capital Improvement Program includes funding
for the repair and/or replacement of playground equipment and rubber surfacing at
several City -owned parks. Staff has now received bids to utilize the 2020-2021
Playground Improvements Project funding and requests City Council approval to award
the work to R.E. Schultz Construction, Inc. (R.E. Schultz) of Orange, CA.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301—Class 1 (Rehabilitation of Deteriorated Facilities) of the
CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because this
project results in no expansion of an existing use;
b) Approve the project plans and specifications with modifications as discussed in this
report;
c) Award Contract No. 7934-1 to R.E. Schultz for the adjusted bid price of $279,915 and
authorize the Mayor and City Clerk to execute the contract; and
d) Establish a contingency amount of $25,193 (approximately 9 percent) to cover the
cost of unforeseen work not included in the original contract.
DISCUSSION:
As part of the annual Playground Refurbishment Program, staff identified Bonita Creek
Park playground as needing maintenance due to the poor condition of the equipment and
rubber surfacing. The improvements address safety concerns and accessibility
compliance. Bonita Creek Park playground will receive new play equipment with shade
structures and new rubber surfacing.

The design of the play equipment includes components that are accessible from the
ground level and elevated components that will be accessible via a transfer platform. Staff
developed bidding documents and put the project out for public bids.
At 10 a.m. on July 8, 2021, the City Clerk opened and read the following bids for this
project:
Due to material cost escalation and work force availability, base bid costs came in
approximately 14.2 percent higher than the Engineer's Estimate of $260,000. In order to
stay within budget, the project scope was amended to refurbish the Bonita Creek
playground sand, versus replacing, as it was replenished earlier this year. Additionally,
the off-site improvements allowance will be removed and the project will focus only on
improvements within the immediate playground area. This modified scope results in an
adjusted bid price of $279,915, which is 7.7 percent higher than the Engineer's Estimate.
The work necessary for the completion of the modified contract scope consists of
removing and disposing of existing improvements, including current rubber wear course
surface and playground equipment; furnishing and installing flexible play surface systems,
playground equipment, and a picnic area with tables; and other incidental items to
complete the work in place as required by the contract documents.
Staff recommends awarding the contract to R.E. Schultz, the apparent low bidder. R.E.
Schultz possesses a valid and current California State General Engineering "A"
Contractor's License and a "D-34" (prefabricated equipment) license; a subcontractor who
holds a "D-12" (synthetic products/rubber surfacing) license; a Certified Playground
Safety Inspector certification; and is a Landscape Structure Certified Installer, as required
by the contract documents. A check of the contractor's references indicates satisfactory
completion of similar projects for the City and other public agencies. Additionally, R.E.
Schultz holds a City on-call maintenance/repair services agreement for playground
equipment and installation services.
Pursuant to the contract documents, the contractor has 90 consecutive working days (60
days for procurement and 30 days for construction) to complete the project.
FISCAL IMPACT:
Sufficient funding is available in the current Capital Improvement Program budget for the
award of this contract. The proposed project will be funded from the Building Excise Tax
(BET) fund ($10,102 from 14101-980000-20P01 and $300,000 from 14101-980000-
21 P01).

The BET fund is used to account for property development taxes imposed on construction
and occupancy of all residential, commercial, industrial units, and mobile home parks for
which a building or construction permit is issued. BET funds shall only be used for
acquiring, improving, expanding and equipping City fire stations, City libraries and City
parks as provided by Chapter 3.12 of the Newport Beach Municipal Code.
