TITLE: Mission Bay Drive Street Improvements — Award of Contract
No. 7889-3 (21 R03)
ABSTRACT:
Public Works staff has received construction bids for the Mission Bay Drive Street
Improvements project and requests City Council approval to award the construction contract
to All American Asphalt. The project consists of removal and reconstruction of street asphalt
concrete and concrete curb and gutter; striping removal and replacement; adjusting manhole
rings, frames and covers; and re-establishing survey monuments on Mission Bay Drive.
RECOMMENDATION:
a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant
to Section 15301 (repair and maintenance of existing highways and streets, sidewalks,
and gutters involving no expansion of use) of the CEQA Guidelines, because this project
has no potential to have a significant effect on the environment;
b) Approve project drawings and specifications;
c) Award Contract No. 7889-3 to All American Asphalt for the total bid price of $196,691.00,
and authorize the Mayor and City Clerk to execute the contract; and
d) Establish $20,000 (approximately 10 percent) contingency to cover the cost of unforeseen
work not included in the original contract.
DISCUSSION:
The Mission Bay Drive Drainage Project was completed earlier this year to address ground
water seepage and pavement subbase failures. This project addresses the necessary street
pavement reconstruction needs of Mission Bay Drive and Malibu Circle.

At 10 a.m. on July 29, 2021, the City Clerk opened and read the following bids for this project:

The apparent low bidder for this project, All American Asphalt, submitted a bid approximately
35% percent less than the Engineer's Estimate of $300,000. Cost savings were realized in
multiple bid items: Mobilization, traffic control, curb and gutter, roadway excavation, and
signing and striping. All American Asphalt is a highly reputable contractor with a long history
of working with the City of Newport Beach. All American Asphalt submitted all the necessary
forms and possesses a Classification "A" License as required by the project specifications. A
check of the contractor's references indicates satisfactory completion of similar projects for
other public agencies.
Work necessary to complete this contract consists of full -depth repair of damaged pavement
in certain areas and then a complete grind and cap of Mission Bay Drive between Point Loma
Drive and Spy Glass Hill Road along with Malibu Circle. All American Asphalt will have 60
consecutive working days to complete the work once given the notice to proceed. Initial work
is expected to begin as soon as September 2021.
Project drawings and specifications will be available for review at the August 24, 2021 City
Council meeting.
FISCAL IMPACT:
The adopted budget includes sufficient funding for this purchase. The following funds will be
expensed:

Staff recommends establishing $20,000.00 (approximately 10 percent of total bid) for
contingency purposes and unforeseen conditions associated with construction.

Quality Act (CEQA) pursuant to Section 15301 (repair and maintenance of existing highways
and streets, sidewalks, and gutters involving no expansion of use) of the CEQA Guidelines,
California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a
significant effect on the environment.
