REGARDING: Tentative agreement with the Newport Beach Firefighters
Association (N.B.F.A.)
THE FOLLOWING POINTS HAVE BEEN AGREED TO BY THE
NEGOTIATORS FOR THE N.B.F.A. AND THE CITY'S NEGOTIATORS.
FINAL AGREEMENT IS SUBJECT TO RATIFICATION BY THE MEMBERS
OF THE N.B.F.A. AND THE CITY COUNCIL.
1. Total compensation increase of 5% for the period June 29, 1989 to June
27,1991.
2. The City will cap its contribution to employee health care plans at
$400.00 per month.
3. The City agrees to an open enrollment for NBFA members who wish
to join the flex -leave program, the enrollment will take place prior to
January 1, 1992.
4. The City will submit a written proposal intended to clarify the J-1 Policy
language to all city employee associations, by either the 1st of
September, 1991, or 60 days after the signing of the last M.O.U. (of the
91-92 negotiating season), which ever is later. Following the
submission of the City's proposal, authorized City representatives will
engage in meet and confer dialog with association representatives in an
effort to gain feedback for the City Council as it proceeds toward a 1991
revision of the J-1 Policy. Following the dialog between the
representatives of the City and the associations, the City Council shall
vote to adopt a revised form of the J-1 Policy before the end of the
calendar year.
5. Modify the basis for accrual of paid leave hours for office personnel to
be compatible with the accrual basis of those on the floor.
6. Effective with the adoption of this MOU, the CITY will establish VSS as
a permanent program, eliminating it from its pilot status. Annually,
the CITY will also budget overtime specifically for the purpose of
funding the VSS program. The budgeting method will be to calculate
the regular "vacation/flex-leave/holiday" eligibility for the entire
NBFA membership, convert that number from hours to dollars, and
use that number to budget the overtime for the VSS program. If the
actual usage of VSS hours exceeds the budgeted figure by quarterly
milestones, the Fire Chief may use whatever management controls he
deems to be appropriate for reducing overtime, including the
temporary reduction of staffing.
7. Amend Sect. #702.3 of the CITY'S flex -leave system to allow for all
holiday accumulations to be posted as they occur (total 132 hours).
8. The City agrees to eliminate the one day (12 hour) waiting period, to
gain access to sick leave banks, for employees in the flex -leave program
who are verifiably ill.
9. All other terms and conditions of the current MOU between the
N.B.F.A. remain unchanged.
