RE: Tentative agreement with the Newport Beach Firefighters
Association (NBFA)
THE FOLLOWING POINTS HAVE BEEN AGREED TO BY THE
• NEGOTIATORS FOR THE NBFA AND THE CITY NEGOTIATIORS, AS A
PRODUCT OF THE MEET AND CONFER PROCESS AS REQUIRED BY THE
MEYERS, MILLIAS, AND BROWN ACT. FINAL AGREEMENT IS SUBJECT
TO RATIFICATION BY THE MEMBERS OF THE NEWPORT BEACH CITY
COUNCIL.
1. ECONOMICS
The City and the NBFA agree to change the City's J-1 Policy
(compensation policy), and incorporate it into the MOU between the City and
the NBFA. The new compensation policy is attached as exhibit #1. The
implementation of this policy involves a phase in over the life of this
agreement, and would be structured in the following manner:
1. A COLA adjustment of no less than 3% to be effective on
January 1, 1994.
2. The City will add an extra step to the merit system salary
range, (An "F" step) effective April 1, 1994. Only represented
is
employees who have been at the current top step C'E") for at least one
year will automatically advance to the new "F" step. All the other
provisions and requirement of the merit pay system shall remain
unchanged.
3. A commitment that the City will achieve a total
compensation position that represents at least 50% of the
differential between the total compensation of the firefighter
benchmark position and the average of the top five firefighting

agencies within Orange County, as of January 1, 1995. It is the
additional intent of the City to put the full force and effect of the new
• compensation policy in in place by January 1, 1996.
4. Up to three re -openers for the NBFA on issues of
importance to them, with notice of their intent to exercise this
right by September 1, 1993, and again by September 1, 1994.
2. Flex -Leave Access
The City will work with the NBFA to modify the current restrictions
on the access to flex -leave to allow for the time to be taken in 12 hour
increments. The City understands that there will be a cost associated with the
development of software to regulate the modification of this benefit, and the
City agrees to split this cost with the NBFA (50/50) to a maximum of $3,500.00
in total expense.
3. "Vacation Relief' Overtime
The City and the NBFA agree to set up a separate budgetary account for
"vacation relief" overtime, this account shall be identified in the budget as
. "Leave Coverage."
4. Ply and Benefit Information
During the life of this MOU, the City will develop a method for the
reporting and updating of accruing pay and benefits to NBFA members. The
method which will eventually be selected will be subject to the approval of
the NBFA executive board.
5. Fitness Equipment
The City agrees to carry over the purchase additional equipment for the
station fitness centers, to a maximum of $15,000. Selection of said equipment
will be at the discretion of the NBFA.
6. Budgetary Crisis Statement
• The City and the NBFA agree to develop language for an article to be
incorporated into this MOU which acknowledges the cooperation of the
NBFA during the 92-93 budget year to give up a 6% pay raise to help the City
through that budget crisis. This article will sunset with the expiration of this
MOU.
7. Fitness Evaluation/Examinations
The City agrees to allow NBFA members to include limited cancer
screening as a part of the annual fitness evaluation/examination, the
limitations will be negotiated and spelled out in a supplemental document.

The City agrees to update, adopt, and issue the Personnel Manual by no
later than December 31, 1993.
9. Duration
The term of the MOU shall be from July 1, 1993 through December 31,

10. Prevailing Rights
The City and the NBFA agree to develop a "Prevailing Rights" article
to be incorporated in this MOU.
11. Lury D
• The City agrees to amend the Fire Department's jury duty policy to
allow for employees to be excused for the entire 24 hour shift, while on jury
duty.

12. Progressive Discipline Plan
The City and the NBFA agree to develop a progressive discipline plan
to be incorporated into the Fire Department's SOP.
